---|
98 | 56 | | Conservation Code. |
---|
99 | 57 | | B. The Director shall consult with the Commission regardi ng the |
---|
100 | 58 | | administration of the affairs of the Depa rtment of Wildlife |
---|
101 | 59 | | Conservation. The C ommission is authorized and empowered to require |
---|
102 | 60 | | from the Director complete reports and information relative to the |
---|
103 | 87 | | affairs of the Department at the time and in the mann er the |
---|
104 | 88 | | Commission may deem advisable. |
---|
105 | 89 | | C. The Commission shall meet in regular session at least nine |
---|
106 | 90 | | times per year not to exceed one mee ting per month with not more |
---|
107 | 91 | | than two consecutive calendar months between mee tings and in special |
---|
108 | 92 | | sessions as may be ca lled by the Chair or a majority of the |
---|
109 | 93 | | Commission. The Commission may hold any regular or special session |
---|
110 | 94 | | at any location within this st ate. Should a location be chosen |
---|
111 | 95 | | other than Commission headquarters in Oklah oma City for a regular or |
---|
112 | 96 | | special meeting, notice shall be posted at Commission headquarte rs |
---|
113 | 97 | | in Oklahoma City and advertised in t he local newspaper of the city |
---|
114 | 98 | | in which the meeting is to be held, at least one time during each of |
---|
115 | 99 | | the two (2) weeks prior to the meeting. The advertisements shall |
---|
116 | 100 | | include time, date, and address of location of the meeting. |
---|
117 | 101 | | D. In addition to the other p owers and duties prescribed by |
---|
118 | 102 | | law, the Commission shall: |
---|
146 | 103 | | 1. Institute an affirmative action plan for hiring women and |
---|
147 | 104 | | minorities throughout the agency; |
---|
148 | 105 | | 2. Elect a chair, vice-chair vice chair, and secretary, who |
---|
149 | 106 | | shall perform the duties required of them by statute s, rules of the |
---|
150 | 107 | | Commission, and the Constitution of the State of Oklahoma. The |
---|
151 | 108 | | chair, vice-chair vice chair, and secretary shall receive no extra |
---|
152 | 109 | | compensation; |
---|
153 | 136 | | 3. Appoint a Director, and determine the qualifications of the |
---|
154 | 137 | | Director and all assistants and employees. A Commissioner shall not |
---|
155 | 138 | | be eligible for employment in any position within the Department; |
---|
156 | 139 | | 4. Prescribe rules and policies for the transaction of its |
---|
157 | 140 | | business and the control of the Department; |
---|
158 | 141 | | 5. Develop and impl ement a plan to provide step raises for |
---|
159 | 142 | | Commission employees so that discrepancies of pay levels within a |
---|
160 | 143 | | pay grade are eliminated; |
---|
161 | 144 | | 6. Acquire by purchase, lease, gift, or devise, waters, real |
---|
162 | 145 | | property, and personal property incident to the exercise of it s |
---|
163 | 146 | | functions and to maintain, operate, and dispose of the same; |
---|
164 | 147 | | 7. Acquire real property by condemnation only when the Attorney |
---|
165 | 148 | | General or other counsel deems it an appropriate means of clearing |
---|
166 | 149 | | title from willing or unavailable sellers; |
---|
167 | 150 | | 8. Supervise the establishment, extension, im provement, and |
---|
168 | 151 | | operation of the wildlife refuges, propagation areas or stations, |
---|
196 | 152 | | public hunting areas, public fishin g areas, game management areas, |
---|
197 | 153 | | and fish hatcheries; |
---|
198 | 154 | | 9. Prescribe the manner of cooperation with the Oklahoma |
---|
199 | 155 | | Tourism and Recreation Depart ment, colleges and universities within |
---|
200 | 156 | | the state, other state agencies, any agency of the federal |
---|
201 | 157 | | government, and any city, town, school district, or any other agency |
---|
202 | 158 | | or organization in study of conservation and propagation of w ildlife |
---|
203 | 159 | | and in the establish ment, maintenance, and operation of visual |
---|
204 | 186 | | educational facilities, recreational facilities, and hunting and |
---|
205 | 187 | | fishing facilities, in the study and propagation of wildlife; |
---|
206 | 188 | | 10. Supervise the letting of all contracts and purchases for |
---|
207 | 189 | | the Department, with all purchases of personal property to be made |
---|
208 | 190 | | through the Office of Management and Enterprise Services; |
---|
209 | 191 | | 11. Authorize all claims or expenditures prior to incurring |
---|
210 | 192 | | payment except as otherwise provided in this Code; |
---|
211 | 193 | | 12. Prescribe rules on the use of Departme nt-owned vehicles by |
---|
212 | 194 | | the Director, department heads and other essential employees as the |
---|
213 | 195 | | Commission deems necessary in order to perform their duties; |
---|
214 | 196 | | 13. Prescribe rules for the s ale of all regular or special |
---|
215 | 197 | | licenses; |
---|
216 | 198 | | 14. Publicize and encourage the con servation and appreciation |
---|
217 | 199 | | of wildlife and all other natural resources; |
---|
218 | 200 | | 15. Regulate the seasons and harvest of wil dlife; |

251 | 206 | | Commission may deem to be in the best interest of the state; and |

252 | 207 | | 18. Provide the Governor and the Legislature with an annu al |
---|
253 | 208 | | inventory of all property and equipment. |
---|
254 | 235 | | E. Five (5) years after the effective date of this act, and |
---|
255 | 236 | | every five (5) years thereafter, the Commission shall prepare a |
---|
256 | 237 | | report for the Legislature with proposed licensing fees based on the |
---|
257 | 238 | | latest Consumer Price Index year-to-date percent change release as |
---|
258 | 239 | | of the date of the annual average county wage data release from the |
---|
259 | 240 | | Bureau of Economic Analysis of the U.S. Department of Commerce for |
---|
260 | 241 | | Legislature approval or rejection . |
---|
261 | 242 | | SECTION 2. AMENDATORY 29 O.S. 2021, Section 4-110, is |
---|
262 | 243 | | amended to read as follows: |
---|
263 | 244 | | Section 4-110. A. Except as otherwise provi ded in the Oklahoma |
---|
264 | 245 | | Wildlife Conservation Code, no person shall fish, pursue, harass, |
---|
265 | 246 | | catch, kill, take in any manner, use, have in possessi on, sell, or |
---|
266 | 247 | | transport all or any portion of fish without having first procured a |
---|
267 | 248 | | license for such from the Director or from any of the authorized |
---|
268 | 249 | | agents of the Department of Wildlife Conservation. The Oklahoma |
---|
269 | 250 | | Wildlife Conservation Commission may designa te two (2) days per year |
---|
304 | 284 | | 1. Legal residents under sixteen (16) eighteen (18) years of |
---|
305 | 285 | | age and nonresidents under sixteen (16) eighteen (18) years of age |
---|
306 | 286 | | from states which do not requi re nonresident fishing licenses for |

315 | 295 | | 4. Legal resident veterans having a disability of sixty percent |

316 | 296 | | (60%) or more and registered with the veterans registr y created by |
---|
317 | 297 | | the Oklahoma Department of Veterans Affairs; provided, that if the |

---|

350 | 303 | | 5. 4. Legal resident owners or tenants, their spouses, parents, |
---|
351 | 304 | | grandparents, children and their spouses, grandchildren an d their |
---|
352 | 305 | | spouses who fish in private ponds o n land owned or leased by them; |
---|
353 | 306 | | 6. 5. Any legal resident or nonresident who is a patient of an |
---|
354 | 307 | | institution of the State of Oklahoma this state established for the |
---|
355 | 334 | | care and treatment of mental illness or alcohol or drug depende ncy |
---|
356 | 335 | | or any developmentally di sabled person residing in any group hom e or |
---|
357 | 336 | | other institution or developmentally disabled persons when |
---|
358 | 337 | | accompanied by an attendant of the institution or legal gu ardian of |
---|
359 | 338 | | the patient, or when fishing on institutional property; |
---|
360 | 339 | | 7. Any legal resident or non resident under eighteen (18) years |
---|
361 | 340 | | of age who is in the legal and physical custody of the State of |
---|
362 | 341 | | Oklahoma or one of its agencies by court order; |
---|
363 | 342 | | 8. Any legal resident or nonresident under eighteen (18) years |
---|
364 | 343 | | of age who is in the physical custody of a ch ild care facility as |
---|
365 | 344 | | defined by Section 402 of Title 10 of the Oklahoma Statutes; |
---|
366 | 345 | | 9. 6. Any legal resident or nonresident who is legally blind or |
---|
367 | 346 | | who has any other physical impairment, as certified by a physician |
---|
368 | 347 | | licensed in this state or any state which borders this state, which |
---|
369 | 348 | | prevents the person from properly using fishing apparatus without |
---|
370 | 349 | | the assistance of another person, and any one person actually |
---|
371 | 350 | | accompanying and actually assisting such legally blind or otherwise |
---|
399 | 351 | | physically impaired person while t he latter is fishing. This |
---|
400 | 352 | | certification shall be carried by the individual while fishing; |
---|
401 | 353 | | 10. Nonresidents under fourteen (14) years of age; |
---|
402 | 354 | | 11. 7. Any legal resident or nonresident who is a Job Corps |
---|
403 | 355 | | trainee of this state, provi ded that the trainees s hall have on |
---|
404 | 356 | | their persons a duly autho rized identification card issued by their |
---|
405 | 357 | | respective Job Corps Center and shall present the card upon request, |
---|
406 | 384 | | in lieu of a fishing license. The trainees shall return their cards |
---|
407 | 385 | | to their respective Job Corps Center when the trainees leave their |
---|
408 | 386 | | respective Job Corps training programs; |
---|
409 | 387 | | 12. 8. Any legal resident having a proven disability which |
---|
410 | 388 | | renders the resident nonambulatory and confined to a wheelchair as |
---|
411 | 389 | | certified by a physician licensed i n this state or any stat e which |
---|
412 | 390 | | borders this state; |
---|
413 | 391 | | 13. 9. Any legal resident who is fishing with a pole and line, |
---|
414 | 392 | | trotline, or throwline in streams, natural lakes, natural pon ds, and |
---|
415 | 393 | | mine pits in the county in which the person is a resident, or in |
---|
416 | 394 | | streams, natural lakes, natura l ponds, and mine pits which form a |
---|
417 | 395 | | part of the boundary line of the county in which the person is a |
---|
418 | 396 | | resident, when using any bait other than commercial or artificial |
---|
419 | 397 | | bait, blood, stink bait, cut fish, and shrimp; and |
---|
420 | 398 | | 14. 10. Any legal resident or nonresi dent participating in an |
---|
421 | 399 | | aquatic education event or clinic sanctioned by the Department of |
---|
422 | 400 | | Wildlife Conservation. |
---|
456 | 433 | | 2. Annual fishing license for legal resi dents sixteen (16) or |
---|
457 | 434 | | seventeen (17) years of age - Four Dollars ($4.00); and |
---|
458 | 435 | | 3. Two-day fishing license for legal residents - Fourteen |
---|
459 | 436 | | Dollars ($14.00). |
---|
460 | 437 | | D. Of the fees collected pursuant to the provisions of |
---|
461 | 438 | | paragraphs 1 and 3 of subsection C of this se ction, Five Dollars |
---|
462 | 439 | | ($5.00) of the license fee shall be for the Oklahoma Wildlife Land |
---|
463 | 440 | | Stamp and shall be deposited in the Oklahoma Wildlife Land Fund |
---|
464 | 441 | | created pursuant to the provisions of S ection 4-141 of this title. |
---|
465 | 442 | | E. Except as otherwise provided for i n the Oklahoma Wildlife |
---|
466 | 443 | | Conservation Code, the nonresident fishi ng licenses issued pursuant |
---|
467 | 444 | | to the provisions of this section and the fee for each shall be: |
---|
468 | 445 | | 1. Annual fishing license for no nresidents - Fifty-four Dollars |
---|
469 | 446 | | ($54.00) Sixty-five Dollars ($65.00), provided the Commissi on may |
---|
470 | 447 | | enter into reciprocity agreement s with states wherein nonresident |
---|
471 | 448 | | license fees shall be in conformity with such reciprocal agreements; |
---|
472 | 449 | | 2. Six-day fishing license for nonresidents – Thirty-four |
---|
473 | 450 | | Dollars ($34.00); and |
---|
506 | 482 | | F. Of the fees collected pursuant to the provisions of |
---|
507 | 483 | | paragraphs 1, 2 and 3 of subsection E of this section, Five Dol lars |
---|
508 | 484 | | ($5.00) of the annual license fee for nonresidents, One Dollar and |
---|
509 | 485 | | fifty cents ($1.50) of the six-day fishing license f or nonresidents |
---|
510 | 486 | | fee and One Dollar and fifty cents ($1.50) of the one-day fishing |
---|
511 | 487 | | license for nonresidents fee shall be deposited in the Wildlife Land |
---|
512 | 488 | | Acquisition Fund created pursuant to the provisions of Section 4-132 |
---|
513 | 489 | | of this title. Of the fees collecte d pursuant to the provisions of |
---|
514 | 490 | | paragraphs 1, 2 and 3 of subsectio n E of this section, Five D ollars |
---|
515 | 491 | | ($5.00) of the license fee shall be for the Oklahoma Wildlife Land |
---|
516 | 492 | | Stamp and shall be deposited in the Oklahoma Wildlife Land Fund |
---|
517 | 493 | | created pursuant to the p rovisions of Section 4-141 of this title. |
---|
518 | 494 | | G. D. Legal residents who have resided in this sta te for at |
---|
519 | 495 | | least six (6) months and who are receiving Social Security |
---|
520 | 496 | | Disability benefits, Supplemental Security Income benefits, |
---|
521 | 497 | | disability benefits under the Rai lroad Retirement Act, 45 U.S.C.A., |
---|
522 | 498 | | Section 231a, postal employees receiving disability benefit s |
---|
523 | 499 | | pursuant to 5 U.S.C., Section 8451 (1 998) or legal residents who are |
---|
524 | 500 | | one hundred percent (100%) disabled and are receiving disability |
---|
557 | 532 | | H. E. 1. Any person arrested while violating the provisions of |
---|
558 | 533 | | this section who does not meet the requirements of subsection K H of |
---|
559 | 534 | | this section, may purchase a substitute temporary thirty-day license |
---|
560 | 535 | | from the arresting game warden in lieu of posting bond. The fee for |
---|
561 | 536 | | a substitute license purchased pursuant to the provisions of this |
---|
562 | 537 | | subsection shall be: |
---|
563 | 538 | | a. for legal residents, Fifty Dollars ($50.00) One |
---|
564 | 539 | | Hundred Dollars ($100.00), and |
---|
565 | 540 | | b. for nonresidents, Ninety Dollars ($90.00) One Hundred |
---|
566 | 541 | | Fifty Dollars ($150.00). |
---|
567 | 542 | | 2. Except as otherwise provided by this subsection, the fe es |
---|
568 | 543 | | from licenses purchase d pursuant to the provisions of this |
---|
569 | 544 | | subsection shall be deposited in the Wildlife Conservation Fund to |
---|
570 | 545 | | be used exclusively for developing, managing, preser ving, and |
---|
571 | 546 | | protecting wildlife and wildlife habitat. |
---|
572 | 547 | | I. F. Unless a substitute license is purchased as provided for |
---|
573 | 548 | | by subsection H E of this section, any resident of this state |
---|
574 | 549 | | convicted of violating the provisions of this section shall be |
---|
575 | 550 | | punished by the imposition of a fine of not less than Twenty -five |
---|
608 | 582 | | violating this section shall be punished by a fine of not less than |
---|
609 | 583 | | Fifty Dollars ($50.00) nor more than Two Hundred Dollars ($200.00) |
---|
610 | 584 | | or by imprisonment in the county jail for a period not more than |
---|
611 | 585 | | thirty (30) days, or by both such f ine and imprisonment. |
---|
612 | 586 | | K. H. Any person producing proof in court that a current |
---|
613 | 587 | | fishing license issued by the Department of Wildlife Conservation to |
---|
614 | 588 | | that person was in for ce at the time of the alleged offense shall be |
---|
615 | 589 | | entitled to dismissal of a charge of viol ating this section upon |
---|
616 | 590 | | payment of court costs. If proof of a current fishing license |
---|
617 | 591 | | issued by the Department to the person that was in force at the time |
---|
618 | 592 | | of the alleged offense is presented to the court or district |
---|
619 | 593 | | attorney within seventy -two (72) hours after the violation, the |
---|
620 | 594 | | charge shall be dismissed without payment of court costs. |
---|
621 | 595 | | SECTION 3. AMENDATORY 29 O.S. 2021, Section 4-112, as |
---|
622 | 596 | | last amended by Section 2, Chapter 208, O.S.L. 2022 (29 O.S. Supp. |
---|
623 | 597 | | 2022, Section 4-112), is amended to read as follows: |
---|
624 | 598 | | Section 4-112. A. Except as otherwise provided for in the |
---|
625 | 599 | | Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae |
---|
626 | 600 | | Act, no person may hunt, pursue, trap, harass , catch, kill, take or |
---|
659 | 632 | | year as free hunting days in which residents of this state may hunt |
---|
660 | 633 | | without first procuring a hunting license pursuant to the provisions |
---|
661 | 634 | | of this section. |
---|
662 | 635 | | B. The following legal residents of Oklahoma shall be exempt |
---|
663 | 636 | | from the annual hunting license requirement of paragraph 1 of |
---|
664 | 637 | | subsection E of this section and the following nonresidents shall be |
---|
665 | 638 | | exempt from the annual nonresident hunting licenses required |
---|
666 | 639 | | pursuant to paragraph 1 of subsection C of this section: |
---|
667 | 640 | | 1. Legal residents under sixteen (16) eighteen (18) years of |
---|
668 | 641 | | age; |
---|
669 | 642 | | 2. Legal residents sixty-five (65) years of age or older |
---|
670 | 643 | | provided they have obtained a senior citizen lifetime hunting or |
---|
671 | 644 | | combination hunting and fishing l icense pursuant to the provisions |
---|
672 | 645 | | of Section 4-114 of this title; |
---|
673 | 646 | | 3. Legal residents born on or before January 1, 1923; |
---|
674 | 647 | | 4. Legal resident veterans having a disability of sixty percent |
---|
675 | 648 | | (60%) or more and registered with the veterans registry created by |
---|
676 | 649 | | the Oklahoma Department of Veterans Affairs; provided, that if the |

719 | 691 | | trapping, harassing, catching, killing, taking, or attempting to |
---|
720 | 692 | | take in any manner any species of rattlesnake during an organized |
---|
721 | 693 | | rattlesnake-hunting event or festival and who has a rattlesna ke |
---|
722 | 694 | | permit issued pursuant to Section 4-143 of this title. |
---|
723 | 695 | | C. Except as otherwise provided for in the Oklahoma Wildlife |
---|
724 | 696 | | Conservation Code, the nonresident hunting licenses issued pursuant |
---|
725 | 697 | | to this section and the fee for each license shall be: |
---|
726 | 698 | | 1. Annual hunting license for nonresident s hunting game other |

727 | 699 | | than deer, antelope, elk, or bear which expires one (1) year after |

1065 | 1030 | | 12. 9. Hunting license for antelope for residents – Fifty |

1066 | 1031 | | Dollars ($50.00). Residents hunting in big game or combination big |

1067 | 1032 | | game and upland game commercial hunting areas shall be exempt from |
---|
1068 | 1033 | | this license; and |
---|
1069 | 1034 | | 13. Bonus, special or additional gun hunting license for deer |
---|
1070 | 1035 | | for residents - Nineteen Dollars ($19.00). The following persons |
---|
1071 | 1036 | | shall be exempt: |
---|
1072 | 1037 | | a. residents with proper certification from the U nited |
---|
1073 | 1038 | | States Department of Veterans Affairs or its |
---|
1074 | 1039 | | successor, certifying that the person is a disabled |
---|
1075 | 1040 | | veteran in receipt of compensation at the one-hundred- |
---|
1076 | 1041 | | percent rate and registered with the veterans registry |
---|
1077 | 1042 | | created by the Oklahoma Department of Vetera ns |
---|
1078 | 1043 | | Affairs; provided, that if the veteran has previously |
---|
1079 | 1044 | | received the exemption pursuant to this subparagraph, |
---|
1080 | 1045 | | no registration with the veterans registry shall be |
---|
1081 | 1046 | | required, and |
---|
1114 | 1078 | | shall be deposited in the Oklahoma Wildlife Land Fund created |
---|
1115 | 1079 | | pursuant to the provisions of Section 4-141 of this title. |
---|
1116 | 1080 | | G. F. The provisions of this section shall not be c onstrued to |
---|
1117 | 1081 | | require a hunting license, resident or nonresident, of any person |
---|
1118 | 1082 | | merely because the person participates, as owner o r handler of an |
---|
1119 | 1083 | | entry, as an official, or as a spectator in the conduct of a field |
---|
1120 | 1084 | | trial or performance test of dogs, whether a resident or nonresident |
---|
1121 | 1085 | | of this state. No license to hunt shall be required of any person |
---|
1122 | 1086 | | engaged in training or working dogs, provided that person is in no |
---|
1123 | 1087 | | way engaged in hunting and does not take or attempt to take in any |
---|
1124 | 1088 | | manner any game. |
---|
1125 | 1089 | | H. G. 1. Any person arrested for hunting game other than deer, |
---|
1126 | 1090 | | antelope, elk, bear or turkey without a valid hunting license as |
---|
1127 | 1091 | | required by the provisions of subsection A of this section may |
---|
1128 | 1092 | | purchase a substitute temporary thirty-day license from the |
---|
1129 | 1093 | | arresting game warden in lieu of posting bond. Proof of hunter |
---|
1130 | 1094 | | safety certification will not be required for the temporary |
---|
1131 | 1095 | | substitute license. The fee for a substitute license purchased |
---|
1132 | 1096 | | pursuant to the provisions of this subsection shall be: |
---|
1164 | 1127 | | 2. Except as otherwise provided for by this subsection, the |
---|
1165 | 1128 | | fees from licenses purchased pursuant to the provisions of this |
---|
1166 | 1129 | | subsection shall be deposited in the Wildli fe Conservation Fund to |
---|
1167 | 1130 | | be used exclusively for developing, managing, preserving, and |
---|
1168 | 1131 | | protecting wildlife and wildlife habitat. |
---|
1169 | 1132 | | I. H. Any person producing proof in court that a current |
---|
1170 | 1133 | | hunting license issued by the Department of Wildlife Conservation to |
---|
1171 | 1134 | | that person was in force at the time of the alleged offense shall be |
---|
1172 | 1135 | | entitled to dismissal of a charge of violating this section upon |
---|
1173 | 1136 | | payment of court costs. If proof of a current hunting license |
---|
1174 | 1137 | | issued by the Department to the person that was in force at the time |
---|
1175 | 1138 | | of the alleged offense is presented to the court or district |
---|
1176 | 1139 | | attorney within seventy-two (72) hours after the violation, the |
---|
1177 | 1140 | | charge shall be dismissed without payment of court costs. |
---|
1178 | 1141 | | J. I. Unless a substitute license is purchased as provided for |
---|
1179 | 1142 | | by subsection H G of this section, any resident convicted of |
---|
1180 | 1143 | | violating the provisions of this section shall be punished by the |
---|
1181 | 1144 | | imposition of a fine of not less than Twenty-five Dollars ($25.00) |
---|
1182 | 1145 | | nor more than Two Hundred Dollars ($200.00), or by imprisonmen t in |
---|
1215 | 1177 | | imposition of a fine of not less than Two Hundred Dollars ($200.00) |
---|
1216 | 1178 | | nor more than Five Hundred Dollars ($500.00), or by imprisonment in |
---|
1217 | 1179 | | the county jail for a period not to exceed six (6) months, or by |

1219 | 1181 | | L. K. The Oklahoma Wildlife Cons ervation Commission shall |
---|
1220 | 1182 | | promulgate any rules necessary to implement the provisions of this |

1221 | 1183 | | section. |
---|
1222 | 1184 | | SECTION 4. AMENDATORY 29 O.S. 2021, Section 4-112A, is |
---|
1223 | 1185 | | amended to read as follows: |
---|
1224 | 1186 | | Section 4-112A. A. No person thirty (30) twenty (20) years of |
---|
1225 | 1187 | | age or younger may purchase or receive any hunting license or |
---|
1226 | 1188 | | hunting tag unless the person possesses and can exhibit a |
---|
1227 | 1189 | | certificate of competency and safety in the us e and handling of |
---|
1228 | 1190 | | firearms from the Department of Wildlife Conservation . The |
---|
1229 | 1191 | | Department shall charge no fee for the issuance of certificates. |
---|
1230 | 1192 | | Persons under ten (10) years of age may take the hunter education |
---|
1231 | 1193 | | course but are not eligible to be tested for a nd receive hunter |
---|
1232 | 1194 | | safety certification. A hunter safety certificate is sued by another |
---|
1233 | 1195 | | state or country and approved by the Department of Wildlife |
---|
1266 | 1227 | | if they are accompanied by a licensed hunter eighteen (18) years of |
---|
1267 | 1228 | | age or older who possesses a certi ficate of hunter safety or is |
---|
1268 | 1229 | | exempt from the hunter safety certificati on requirements. The |
---|
1269 | 1230 | | accompanying hunter shall be in sight of the youth hunter and shall |
---|
1270 | 1231 | | be able to communicate with the youth hunter in a normal voice |
---|
1271 | 1232 | | without the aid of any communica tion device. A youth hunter who |
---|
1272 | 1233 | | possesses a certificate of hunter safe ty may hunt small game without |
---|
1273 | 1234 | | an accompanying hunter as long as the youth hunter carries the |
---|
1274 | 1235 | | certification on their person. |
---|
1275 | 1236 | | C. Persons under thirty (30) twenty-one (21) years of age who |
---|
1276 | 1237 | | do not possess a certificate o f hunter safety may purchase or |
---|
1277 | 1238 | | receive any hunting license or permit which is required by law with |
---|
1278 | 1239 | | the designation apprentice listed on the hunter education line of |
---|
1279 | 1240 | | the license or permit. A person holding a license or permit with |
---|
1280 | 1241 | | the apprentice designati on shall be allowed to hunt only if th ey are |
---|
1281 | 1242 | | accompanied by a licensed hunter eighteen (18) years of age or older |
---|
1282 | 1243 | | who possesses a certificate of hunter safety or is exempt from the |
---|
1283 | 1244 | | hunter safety certification requirements or is accompanied by a |
---|
1284 | 1245 | | person exempt from the hunting license requiremen ts. In addition, |
---|
1317 | 1277 | | the hunting license requirement. When hunting big game, the |
---|
1318 | 1278 | | accompanying hunter shall be within arm’s length of the appr entice |
---|
1319 | 1279 | | hunter or close enough so that the accompanying hunter can |
---|
1320 | 1280 | | immediately take control of the firearm or archery equipment of the |
---|
1321 | 1281 | | apprentice hunter. When hunting small game, the accompanying hunter |
---|
1322 | 1282 | | shall be in sight of the apprentice hunter and shall be able to |
---|
1323 | 1283 | | communicate with the appren tice hunter in a normal voice without the |
---|
1324 | 1284 | | aid of any communication device. |
---|
1325 | 1285 | | D. Legal residents who do not possess a certificate of hunter |
---|
1326 | 1286 | | safety may purchase a lifetime hunting license or lifetime |
---|
1327 | 1287 | | combination hunting/f ishing license with the designation ap prentice |
---|
1328 | 1288 | | listed on the hunter education line of the license. A resident |
---|
1329 | 1289 | | holding a lifetime license with the apprentice designation shall be |
---|
1330 | 1290 | | allowed to hunt only if they comply with the accompanying hunter |
---|
1331 | 1291 | | requirements as set forth in subsection C of this section. Upon |
---|
1332 | 1292 | | obtaining a certificate of hunter safety, a resident holding a |
---|
1333 | 1293 | | lifetime license with the apprentice designation shall be entitled |
---|
1334 | 1294 | | to renew their license without the apprentice designation. |
---|
1368 | 1327 | | a member of the National Guard. In addition, the provisions of this |
---|
1369 | 1328 | | section shall not apply to any person who is a resident landowner or |
---|
1370 | 1329 | | a resident tenant, while hunting game other t han deer or antelope, |
---|
1371 | 1330 | | upon land owned or leased by the person. The provisions of this |
---|
1372 | 1331 | | subsection shall not exempt nonresidents owning land in this state |
---|
1373 | 1332 | | nor any person leasing land, for the purpose of hunting. |
---|
1374 | 1333 | | G. Any person convicted of violating the pro visions of this |
---|
1375 | 1334 | | section shall be punished by the imposition of a fine of not less |
---|
1376 | 1335 | | than Fifty Dollars ($50.00) nor more than Two Hundred Dollars |
---|
1377 | 1336 | | ($200.00) or by imprisonment in the county jail for a period not to |
---|
1378 | 1337 | | exceed thirty (30) days, or by both fine and imprisonment. |
---|
1379 | 1338 | | SECTION 5. AMENDATORY 29 O.S. 2021, Section 4-113, as |

1426 | 1384 | | SECTION 6. AMENDATORY 29 O.S. 2021, Section 4-113.1, is |

1785 | 1736 | | C. 1. The Oklahoma waterfowl hunting stamp fee and waterfowl |

1786 | 1737 | | license shall each be Nine Dollars ($9.00). The remainder of the |

1787 | 1738 | | fee shall be deposited in the Wildlife Conservation Fund, to be used |
---|
1788 | 1739 | | exclusively in the State of Okla homa, for the purpose of developing, |

1832 | 1782 | | E. F. 1. Any person arrested for hunting or taking any |

1833 | 1783 | | waterfowl during the open season on waterfowl without a valid |

1834 | 1784 | | Oklahoma waterfowl hunting stamp or license as required by the |
---|
1835 | 1785 | | provisions of subsection A of this section may purchase a substitute |
---|
1836 | 1786 | | temporary thirty-day stamp or license from the arresting game warden |
---|
1837 | 1787 | | in lieu of posting bond. Proof of hunter safety certification shall |
---|
1838 | 1788 | | not be required for the temporary substitute stamp or license. The |
---|
1872 | 1821 | | 2. The fees from the temporary stamp and license purchased |

1873 | 1822 | | pursuant to the provisions of this subsection shall be deposited in |

1879 | 1828 | | F. G. Any person convicted of violating any of the pr ovisions |

1880 | 1829 | | of this section shall be punished by a fine of not less than Twenty- |

1881 | 1830 | | five Dollars ($25.00) nor more than One Hundred Dollars ($100.00). |
---|
1882 | 1831 | | G. H. Nothing in this title shall prohibit a person from |

1883 | 1832 | | hunting waterfowl exclusively on their own property wi thout an |

1884 | 1833 | | Oklahoma waterfowl hunting stamp or l icense. |
