8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112A, is
8383 amended to read as follows:
8484 Section 4-112A. A. No person thirty (30) years of age or
8585 younger may purchase or receive any hunting li cense or hunting tag
8686 unless the person possesses an d can exhibit a certificate of
8787 competency and safety in the use and handling of firearms from the
8888 Department of Wildlife Conservation. The Department shall charge no
8989 fee for the issuance of certificates. Persons under ten (10) years
9090 of age may take the h unter education course but are not eligible to

142142 be tested for and receive hunter safety certification. A hunter
143143 safety certificate issued by another state or country and approv ed
144144 by the Department of Wildl ife Conservation shall be deemed to meet
145145 the requirements of this section.
146146 B. A youth hunter under sixteen (16) years of age hunt ing small
147147 game shall be exempt f rom the hunter safety certification
148148 requirements set forth in sub section A of this section if they are
149149 accompanied by a licensed hunter eighteen (18) years of age or older
150150 who possesses a certificate of hunter safety or is e xempt from the
151151 hunter safety certification requirements. The accompanying hunter
152152 shall be in sight of the youth hunter and sh all be able to
153153 communicate with the youth hunter in a normal voice without the aid
154154 of any communication device. A youth hunter wh o possesses a
155155 certificate of hunter safety may hunt small game without an
156156 accompanying hunter as long as the youth hunter carr ies the
157157 certification on their person.
158158 C. Persons under thirty (30) years of age who do not possess a
159159 certificate of hunter safet y may purchase or receive any hu nting
160160 license or permit which is required by law with the designa tion
161161 apprentice listed on the hunter education line of the license or
162162 permit. A person holding a license or permit with the apprentice
163163 designation shall be al lowed to hunt only if they are a ccompanied by
164164 a licensed hunter eighteen (18) years of age or old er who possesses
165165 a certificate of hunter safety or is exempt from the hunter saf ety

217217 certification requirements or is accompanied by a person exempt from
218218 the hunting license requirements. In addition, all persons under
219219 ten (10) years of age, when hunting b ig game, regardless of hunter
220220 safety certification, shall be accompanied by a li censed hunter
221221 eighteen (18) years of age or older who possesses a certificate o f
222222 hunter safety or is exempt fro m the hunter safety certification
223223 requirements or is accompanied by a person exempt from the h unting
224224 license requirement. When hunting big game, the accompanying hunter
225225 shall be within arm's length of the apprentice hunter or close
226226 enough so that the acco mpanying hunter can immediately take control
227227 of the firearm or ar chery equipment of the appren tice hunter. When
228228 hunting small game, the accompan ying hunter shall be in sight of the
229229 apprentice hunter and shall be able to com municate with the
230230 apprentice hunter in a normal voice without the aid of any
231231 communication device .
232232 D. Legal residents who do not possess a certificate of hunter
233233 safety may purchase a lifetime hunting license or lifetime
234234 combination hunting/fishing license with the designation apprentice
235235 listed on the hunter education line of the license. A resident
236236 holding a lifetime license wi th the apprentice designation shall be
237237 allowed to hunt only if they comply with the accompanying hunter
238238 requirements as set forth in subsection C of this section. Upon
239239 obtaining a certificate of hunter safety, a resident holdi ng a

292292 to renew their license without the apprentice designation.
293293 E. No person may purchase or receive a hunting guide license
294294 unless the person possesses and can exhibit a c ertificate of
295295 competency and safety in the us e and handling of firearms from the
296296 Department of Wildlife Conservation . The Department shall charge no
297297 fee for the issuance of this certificate. A hunter safety
298298 certificate issued by another state or country and approved by the
299299 Department of Wildlife Co nservation shall be deemed to meet the
300300 requirements of this subsection. The exemption provided in
301301 subsection G of this section shall not apply to the requirements of
302302 this subsection.
303303 F. The Department of Wildlife Conservation sh all promulgate
304304 rules necessary for the certification of programs for hunter s afety
305305 offered by other public or private organizations.
306306 F. The G. Except as provided in subsection E of this sectio n,
307307 the provisions of this section shall no t apply to any person who has
308308 an honorable discharge from the United States Armed Forces, who is
309309 currently on active duty in the United States Armed Forces or a
310310 member of the National Guard. In addition, the provisions of this
311311 section shall not apply to a ny person who is a re sident landowner or
312312 a resident tenant, while hunting game other than deer or antelope,
313313 upon land owned or leased by the person. The provisions of this

365365 subsection shall not exempt nonresidents owning land in this state
366366 nor any person leasing land, for the purpose of hunting.
367367 G. H. Any person convicted of violating the provisions of this
368368 section shall be punished by the imposition of a fine of not less
369369 than Fifty Dollars ($50.00) nor more than Two Hundred Dollars
370370 ($200.00) or by imprisonme nt in the county jail for a period not to
371371 exceed thirty (30) days, or by both fine and impriso nment.
372372 SECTION 2. NEW LAW A new section of law to be codified
373373 in the Oklahoma Statutes as Section 4-112B of Title 29, unless there
374374 is created a duplication in numbering, reads as follows:
375375 A. Except as otherwise provided in the Oklah oma Wildlife
376376 Conservation Code, no person shall assist, accompany, transport,
377377 guide, or aid persons in the taking of game for compensation or
378378 other consideration without having first procured a license
379379 specified in subsection B of this section from the Dir ector of the
380380 Department of Wildlife Conservation or from any of the authorized
381381 agents of the Department.
382382 B. The Department shall pr omulgate rules for a hunting guide
383383 license for persons who assist, accompany, transport, guide, or aid
384384 persons in the taking of game for compensation or other
385385 consideration. All persons making application for a hunting guide
386386 license shall:
387387 1. Be eighteen (18) years of age or older;

439439 2. Be able to produce a valid license to operate a motor
440440 vehicle or other positive proof of id entification, age, and
441441 residency, and any such license issued shall show such data as well
442442 as the date and time of i ssuance; and
443443 3. Receive a certificate of competency and safety in use and
444444 handling of firearms pursuant to subsection E of Section 4 -112A of
445445 Title 29 of the Oklahoma Statutes .
446446 C. The fee for a license under this section shall not exceed
447447 Two Hundred Dollars ($200.00) annually.
448448 D. The provisions of this section shall not apply to landowners
449449 or agricultural lessee who provide such service s on properties they
450450 own or lease.
451451 E. The provisions of this section shall not exempt a perso n
452452 procuring a guide lice nse pursuant to this section from any other
453453 hunting licenses as required by law.
454454 F. Any person convicted of violating the provisions of this
455455 section shall be punished by a fine not more than Two Thousand
456456 Dollars ($2,000.00).
457457 SECTION 3. This act shall become effective November 1, 2023.
