77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. AMENDATORY 59 O.S. 2021, Section 650, is
79	79	amended to read as follows:
80	80	Section 650. A. This act section shall be known and may be
81	81	cited as the “Oklahoma Interventional Pain Management and Treatment
82	82	Act”.
83	83	B. As used in this section:
84	84	1. “Chronic pain” means a pain state which is subacute,
85	85	persistent and intractable;
86	86	2. “Fluoroscope” means a radiologic instrument equipped with a
87	87	fluorescent screen on which opaque internal structures ca n be viewed

140	140	X-rays throughout the body
141	141	“Fluoroscopy” means a medical imaging procedure that uses an X-
142	142	ray beam to take real-time footage of moving internal body parts
143	143	such as bones, muscles, joints, organs, and tissue to display a
144	144	consistent radiographic picture progressively onto a screen ; and
145	145	3. “Interventional pain management ” means the practice of
146	146	medicine delivery of health care servic es devoted to the diagnosis
147	147	and treatment of chroni c pain, through the use of such techniques
148	148	as:
149	149	a. ablation of targeted nerves,
150	150	b. percutaneous precision needle place ment within the
151	151	spinal column with placement of drugs such as local
152	152	anesthetics, steroid s, and analgesics in targeted
153	153	areas of the spinal c olumn, or
154	154	c. surgical techniques, such as laser or endoscopic
155	155	diskectomy, intrathecal infusion pumps and spinal cord
156	156	stimulators, or
157	157	d. fluoroscopy.
158	158	C. It shall be unlawful to practice or offer to practic e
159	159	interventional pain management in this state unle ss such person has:
160	160	1. Has been duly licensed under the provisions of the Oklahoma
161	161	Allopathic Medical and Surgical L icensure and Supervision Act or the
162	162	Oklahoma Osteopathic Medicine Act; or

214	214	2. Is a Certified Registered Nurse Anesthetist licensed in
215	215	accordance with the Oklahoma Nurs ing Practice Act who holds a valid
216	216	certification in Non surgical Pain Management from the National Board
217	217	of Certification and Recertification for Nurse Anesthetists and
218	218	practices in accordance with the certification.
219	219	D. Nothing in this section shall be construed to forbid the
220	220	administration of lumbar intra -laminar epidural steroid injections
221	221	or peripheral nerve blocks by a certified registered nurse
222	222	anesthetist when requested to do so by a physician and under the
223	223	supervision of A Certified Registered Nurse Anesthetist who meets
224	224	the criteria of subsection C of this section may:
225	225	1. Practice interventional pain management , except for surgical
226	226	techniques, in collaboration with an allopathic or osteopathic
227	227	physician licensed in this s tate and under conditions in which
228	228	timely on-site consultation by such allopathic or osteopathic
229	229	physician is availab le.
230	230	E. A certified registered nurse anesthetist shall no t operate;
231	231	2. Operate a freestanding pain management facility without
232	232	direct supervision of a in collaboration with an allopathic or
233	233	osteopathic physician who is board -certified in interventional pa in
234	234	management or its equivalent ; and
235	235	3. Perform procedural sedation.
236	236	E. Nothing in this section shall authorize a Certified
237	237	Registered Nurse Anesthetist to prescribe or dispense any opioid or

291	291	SECTION 2. This act shall become effective November 1, 2023.
