7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 59 O.S. 2021, Section 650, is
7979 amended to read as follows:
8080 Section 650. A. This act section shall be known and may be
8181 cited as the “Oklahoma Interventional Pain Management and Treatment
8282 Act”.
8383 B. As used in this section:
8484 1. “Chronic pain” means a pain state which is subacute,
8585 persistent and intractable;
8686 2. “Fluoroscope” means a radiologic instrument equipped with a
8787 fluorescent screen on which opaque internal structures ca n be viewed

140140 X-rays throughout the body
141141 “Fluoroscopy” means a medical imaging procedure that uses an X-
142142 ray beam to take real-time footage of moving internal body parts
143143 such as bones, muscles, joints, organs, and tissue to display a
144144 consistent radiographic picture progressively onto a screen ; and
145145 3. “Interventional pain management ” means the practice of
146146 medicine delivery of health care servic es devoted to the diagnosis
147147 and treatment of chroni c pain, through the use of such techniques
148148 as:
149149 a. ablation of targeted nerves,
150150 b. percutaneous precision needle place ment within the
151151 spinal column with placement of drugs such as local
152152 anesthetics, steroid s, and analgesics in targeted
153153 areas of the spinal c olumn, or
154154 c. surgical techniques, such as laser or endoscopic
155155 diskectomy, intrathecal infusion pumps and spinal cord
156156 stimulators, or
157157 d. fluoroscopy.
158158 C. It shall be unlawful to practice or offer to practic e
159159 interventional pain management in this state unle ss such person has:
160160 1. Has been duly licensed under the provisions of the Oklahoma
161161 Allopathic Medical and Surgical L icensure and Supervision Act or the
162162 Oklahoma Osteopathic Medicine Act; or

214214 2. Is a Certified Registered Nurse Anesthetist licensed in
215215 accordance with the Oklahoma Nurs ing Practice Act who holds a valid
216216 certification in Non surgical Pain Management from the National Board
217217 of Certification and Recertification for Nurse Anesthetists and
218218 practices in accordance with the certification.
219219 D. Nothing in this section shall be construed to forbid the
220220 administration of lumbar intra -laminar epidural steroid injections
221221 or peripheral nerve blocks by a certified registered nurse
222222 anesthetist when requested to do so by a physician and under the
223223 supervision of A Certified Registered Nurse Anesthetist who meets
224224 the criteria of subsection C of this section may:
225225 1. Practice interventional pain management , except for surgical
226226 techniques, in collaboration with an allopathic or osteopathic
227227 physician licensed in this s tate and under conditions in which
228228 timely on-site consultation by such allopathic or osteopathic
229229 physician is availab le.
230230 E. A certified registered nurse anesthetist shall no t operate;
231231 2. Operate a freestanding pain management facility without
232232 direct supervision of a in collaboration with an allopathic or
233233 osteopathic physician who is board -certified in interventional pa in
234234 management or its equivalent ; and
235235 3. Perform procedural sedation.
236236 E. Nothing in this section shall authorize a Certified
237237 Registered Nurse Anesthetist to prescribe or dispense any opioid or

291291 SECTION 2. This act shall become effective November 1, 2023.
