79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
81	81	amended to read as follows:
82	82	Section 11-105.1. A. All curriculum and materials including
83	83	supplementary materia ls which will be used to teach or will be used
84	84	for or in connection with a sex education class or program which is
85	85	designed for the exclusive pur pose of discussing sexual behavior or
86	86	attitudes, or any test, survey , or questionnaire whose primary
87	87	purpose is to elicit responses on sexual behavio r or attitudes shall
88	88	be available through the superinten dent or a designee of the sch ool
89	89	district for inspection by parents and guardians of the student who

142	142	questionnaire. Such curriculum, mate rials, classes, programs,
143	143	tests, surveys, or questionnaires shall include information ab out
144	144	consent and shall have as one of its their primary purposes the
145	145	teaching of or informing students about the practice of abstinence.
146	146	For the purposes of this section, “consent” shall have the same
147	147	meaning as that provide d by Section 113 of Title 21 of the Ok lahoma
148	148	Statutes. The Prior to its introduction and in sufficient time for
149	149	a parent or legal guardian to respond, the superintendent or a
150	150	designee of the school district shall provide prior written
151	151	notification to the parents or guardians of the students involved of
152	152	their right to inspect the curriculum and material and of their
153	153	obligation to notify the school in writing if they do not want their
154	154	child to participate in the class, program, test, survey , or
155	155	questionnaire. Each local board of education shall determine the
156	156	means of providing written notification to the parents and guardian
157	157	which will ensure effective notice in an efficient and appropriate
158	158	manner. No student shall be required to participate in a sex
159	159	education class or program which discusses sexual behavior or
160	160	attitudes if a parent or guardian of the student objects in writing
161	161	to such participation. If the type of program referred to in this
162	162	section is a part of or is taught during a credit course, a stude nt
163	163	may be required to enroll in the course but shall not be required to
164	164	receive instruction in or participate in the program if a paren t or

216	216	guardian objects in writing , and the student shall not be penalized
217	217	for not receiving in struction in or participating in the program.
218	218	B. The superintendent or a desig nee of a school district in
219	219	which sex education is taught or a program is offered which is
220	220	designed for the exclusive purpose of discussing sexual behavior or
221	221	attitudes shall approve all cu rriculum and materials which will be
222	222	used for such education and an y test, survey, or questionnaire whose
223	223	primary purpose is to e licit responses on sexual behavior or
224	224	attitudes used in the school prior to their use in the classroom or
225	225	school. The teacher i nvolved in the class, program, testing , or
226	226	survey shall submit the curriculum, materials, tests , or surveys to
227	227	the superintendent or a designee for approval prior to their use in
228	228	the classroom or school. This section shall not apply to those
229	229	students enrolled in classes, programs, testings tests, or surveys
230	230	offered through an alternative education program.
231	231	C. Curriculum and materials provided pursuant to this section
232	232	to students in grades kindergarten through six shall be prohibited
233	233	from including information on sexual orientation or gender identity.
234	234	For grades in which information on sexual orientation or gender
235	235	identity is allowed, the teacher providing instruction shall ensure
236	236	equal time is spent on the two -gender perspective.
237	237	SECTION 2. This act shall become effective July 1, 2023.
238	238	SECTION 3. It being immediately necessary for the preservation
239	239	of the public peace, health , or safety, an emergency is hereby
