7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
8181 amended to read as follows:
8282 Section 11-105.1. A. All curriculum and materials including
8383 supplementary materia ls which will be used to teach or will be used
8484 for or in connection with a sex education class or program which is
8585 designed for the exclusive pur pose of discussing sexual behavior or
8686 attitudes, or any test, survey , or questionnaire whose primary
8787 purpose is to elicit responses on sexual behavio r or attitudes shall
8888 be available through the superinten dent or a designee of the sch ool

141141 will be involved with the class, program or, test, survey, or
142142 questionnaire. Such curriculum, mate rials, classes, programs,
143143 tests, surveys, or questionnaires shall include information ab out
144144 consent and shall have as one of its their primary purposes the
145145 teaching of or informing students about the practice of abstinence.
146146 For the purposes of this section, “consent” shall have the same
147147 meaning as that provide d by Section 113 of Title 21 of the Ok lahoma
148148 Statutes. The Prior to its introduction and in sufficient time for
149149 a parent or legal guardian to respond, the superintendent or a
150150 designee of the school district shall provide prior written
151151 notification to the parents or guardians of the students involved of
152152 their right to inspect the curriculum and material and of their
153153 obligation to notify the school in writing if they do not want their
154154 child to participate in the class, program, test, survey , or
155155 questionnaire. Each local board of education shall determine the
156156 means of providing written notification to the parents and guardian
157157 which will ensure effective notice in an efficient and appropriate
158158 manner. No student shall be required to participate in a sex
159159 education class or program which discusses sexual behavior or
160160 attitudes if a parent or guardian of the student objects in writing
161161 to such participation. If the type of program referred to in this
162162 section is a part of or is taught during a credit course, a stude nt
163163 may be required to enroll in the course but shall not be required to
164164 receive instruction in or participate in the program if a paren t or

216216 guardian objects in writing , and the student shall not be penalized
217217 for not receiving in struction in or participating in the program.
218218 B. The superintendent or a desig nee of a school district in
219219 which sex education is taught or a program is offered which is
220220 designed for the exclusive purpose of discussing sexual behavior or
221221 attitudes shall approve all cu rriculum and materials which will be
222222 used for such education and an y test, survey, or questionnaire whose
223223 primary purpose is to e licit responses on sexual behavior or
224224 attitudes used in the school prior to their use in the classroom or
225225 school. The teacher i nvolved in the class, program, testing , or
226226 survey shall submit the curriculum, materials, tests , or surveys to
227227 the superintendent or a designee for approval prior to their use in
228228 the classroom or school. This section shall not apply to those
229229 students enrolled in classes, programs, testings tests, or surveys
230230 offered through an alternative education program.
231231 C. Curriculum and materials provided pursuant to this section
232232 to students in grades kindergarten through six shall be prohibited
233233 from including information on sexual orientation or gender identity.
234234 For grades in which information on sexual orientation or gender
235235 identity is allowed, the teacher providing instruction shall ensure
236236 equal time is spent on the two -gender perspective.
237237 SECTION 2. This act shall become effective July 1, 2023.
238238 SECTION 3. It being immediately necessary for the preservation
239239 of the public peace, health , or safety, an emergency is hereby
