8585 BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA:
8686 SECTION 1. NEW LAW A new section of law to be codified
8787 in the Oklahoma Statutes as Section 567.4c of Title 59, unless there
8888 is created a duplication in numbering, reads as follow s:
8989 A. 1. An Advanced Practice Registered Nurse recognized by the
9090 Oklahoma Board of Nursing as a Certified Nurse Practition er or
9191 Clinical Nurse Specialist who holds a Doctor of Nursing P ractice
9292 (DNP) degree and who has completed a minimum of two thousand (2,000)

144144 hours of practice with prescriptive authority supervised by a
145145 physician or a supervising Advanced Practice Registered Nurse may
146146 apply to the Oklahoma Board of Nursing for authority to prescribe
147147 and order independent of supervision.
148148 2. The application for independent prescriptive autho rity shall
149149 include proof that the Certified Nurse Practitioner or Clinical
150150 Nurse Specialist:
151151 a. has satisfied the educational requirements stated in
152152 Section 567.5a of Title 59 of the Oklahoma Statutes,
153153 b. holds a Doctor of Nursing P ractice (DNP) degree,
154154 c. has successfully passed a national certification
155155 examination recognized by the Board that measures the
156156 Advanced Practice Registered Nurse role and specialty
157157 competencies,
158158 d. holds a valid, current license in the appropriate
159159 Advanced Practice Registered Nurse role issued by the
160160 Board and is in good standing with the Board , and
161161 e. has completed a minimum of two thousand (2,000) hours
162162 of practice with prescriptive authority supervised by
163163 a physician or supervising Advanced Practice
164164 Registered Nurse.
165165 3. Independent prescriptive authority granted under this
166166 subsection shall be valid until the expi ration of the current
167167 license to practice and may be r enewed upon application to the Board

219219 at the same time and for the same period as the renewal of the
220220 license to practice.
221221 B. An Advanced Practice Registered Nurse who has obtained
222222 independent prescriptive authority under subsection A of this
223223 section shall either:
224224 1. Practice exclusively in one or more Medically Underserved
225225 Areas (MUAs) designated by the Health R esources and Services
226226 Administration;
227227 2. Provide care exclusively to one or more Medically
228228 Underserved Populations (MUPs ) designated by the Health R esources
229229 and Services Administration ; or
230230 3. Meet the conditions of both paragraph 1 and paragraph 2 of
231231 this subsection.
232232 C. 1. A Certified Nurse Practitioner or Clinical Nurse
233233 Specialist who has obtained independent prescriptive authority under
234234 subsection A of this section and who has completed a minimum of
235235 eight thousand (8,000) hours of practice with independen t
236236 prescriptive authority may serve as a supervising Advanced Practice
237237 Registered Nurse.
238238 2. Notwithstanding paragraph 1 of this subsection, an Advanced
239239 Practice Registered Nurse who has been licensed and in practice for
240240 a minimum of five (5) years as of the effective date of this act
241241 without a lapse of work, upon obtainment of independent prescriptive

293293 authority under subsection A of this section , may serve as a
294294 supervising Advanced Practice Registered Nurse.
295295 3. The Board may at its discretion prescribe by rule additional
296296 qualifications for supervising Advanced Practice Registered Nurses
297297 including, but not limited to, qualifications pertaining to the
298298 Advanced Practice Registered Nurse role or specialty.
299299 D. The Board shall review any application submitted under this
300300 section and shall approve or deny the application, stati ng the
301301 reason or reasons for denial, if denied. The Board shall mail the
302302 approval or denial letter to the applicant within fourteen (14)
303303 calendar days of receip t of the application. If denied, the
304304 applicant may reapply using th e process prescribed by subsection A
305305 of this section.
306306 E. The Board may suspend or revoke independent prescriptive
307307 authority granted under this section for good cause at any time.
308308 F. The Board may establish a fe e for the review of initial and
309309 renewal applications under the provisions of this section.
310310 SECTION 2. This act shall become effective November 1, 2023.
