85	85	BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA:
86	86	SECTION 1. NEW LAW A new section of law to be codified
87	87	in the Oklahoma Statutes as Section 567.4c of Title 59, unless there
88	88	is created a duplication in numbering, reads as follow s:
89	89	A. 1. An Advanced Practice Registered Nurse recognized by the
90	90	Oklahoma Board of Nursing as a Certified Nurse Practition er or
91	91	Clinical Nurse Specialist who holds a Doctor of Nursing P ractice
92	92	(DNP) degree and who has completed a minimum of two thousand (2,000)

144	144	hours of practice with prescriptive authority supervised by a
145	145	physician or a supervising Advanced Practice Registered Nurse may
146	146	apply to the Oklahoma Board of Nursing for authority to prescribe
147	147	and order independent of supervision.
148	148	2. The application for independent prescriptive autho rity shall
149	149	include proof that the Certified Nurse Practitioner or Clinical
150	150	Nurse Specialist:
151	151	a. has satisfied the educational requirements stated in
152	152	Section 567.5a of Title 59 of the Oklahoma Statutes,
153	153	b. holds a Doctor of Nursing P ractice (DNP) degree,
154	154	c. has successfully passed a national certification
155	155	examination recognized by the Board that measures the
156	156	Advanced Practice Registered Nurse role and specialty
157	157	competencies,
158	158	d. holds a valid, current license in the appropriate
159	159	Advanced Practice Registered Nurse role issued by the
160	160	Board and is in good standing with the Board , and
161	161	e. has completed a minimum of two thousand (2,000) hours
162	162	of practice with prescriptive authority supervised by
163	163	a physician or supervising Advanced Practice
164	164	Registered Nurse.
165	165	3. Independent prescriptive authority granted under this
166	166	subsection shall be valid until the expi ration of the current
167	167	license to practice and may be r enewed upon application to the Board

219	219	at the same time and for the same period as the renewal of the
220	220	license to practice.
221	221	B. An Advanced Practice Registered Nurse who has obtained
222	222	independent prescriptive authority under subsection A of this
223	223	section shall either:
224	224	1. Practice exclusively in one or more Medically Underserved
225	225	Areas (MUAs) designated by the Health R esources and Services
226	226	Administration;
227	227	2. Provide care exclusively to one or more Medically
228	228	Underserved Populations (MUPs ) designated by the Health R esources
229	229	and Services Administration ; or
230	230	3. Meet the conditions of both paragraph 1 and paragraph 2 of
231	231	this subsection.
232	232	C. 1. A Certified Nurse Practitioner or Clinical Nurse
233	233	Specialist who has obtained independent prescriptive authority under
234	234	subsection A of this section and who has completed a minimum of
235	235	eight thousand (8,000) hours of practice with independen t
236	236	prescriptive authority may serve as a supervising Advanced Practice
237	237	Registered Nurse.
238	238	2. Notwithstanding paragraph 1 of this subsection, an Advanced
239	239	Practice Registered Nurse who has been licensed and in practice for
240	240	a minimum of five (5) years as of the effective date of this act
241	241	without a lapse of work, upon obtainment of independent prescriptive

294	294	supervising Advanced Practice Registered Nurse.
295	295	3. The Board may at its discretion prescribe by rule additional
296	296	qualifications for supervising Advanced Practice Registered Nurses
297	297	including, but not limited to, qualifications pertaining to the
298	298	Advanced Practice Registered Nurse role or specialty.
299	299	D. The Board shall review any application submitted under this
300	300	section and shall approve or deny the application, stati ng the
301	301	reason or reasons for denial, if denied. The Board shall mail the
302	302	approval or denial letter to the applicant within fourteen (14)
303	303	calendar days of receip t of the application. If denied, the
304	304	applicant may reapply using th e process prescribed by subsection A
305	305	of this section.
306	306	E. The Board may suspend or revoke independent prescriptive
307	307	authority granted under this section for good cause at any time.
308	308	F. The Board may establish a fe e for the review of initial and
309	309	renewal applications under the provisions of this section.
310	310	SECTION 2. This act shall become effective November 1, 2023.
