71	71	employer to provide notice prior to vaccination;
72	72	prohibiting termination and disciplinary action for
73	73	refusal to submit to medical services; construing
74	74	provision; amending 40 O.S. 2021, Section 192, which
75	75	relates to penalties; updating statutory reference;

81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 40 O.S. 2021, Section 191, is
83	83	amended to read as follows:
84	84	Section 191. A. It shall be unlawful for any person,
85	85	partnership, associat ion, or corporation, either for hi mself,
86	86	herself, or itself, or in a representative or fiduciary capacity, to
87	87	require any employee or applicant for employment, as a condition of
88	88	employment or continued employment, to submit to, or take, a
89	89	physical or medical examination, without providing such examination
90	90	at no cost therefor to such employee or applicant for employment, or

142	142	without furnishing, upon the request of the employee or applicant
143	143	for employment within thirty (30) days after such examination, free
144	144	of charge, to such employee or appli cant for employment, a true and
145	145	correct copy, either original or duplicate original, of the
146	146	examiner’s report of such examination. It shall further be unlawful
147	147	for any such person, partnership, association or corporation to
148	148	require any employee or applica nt for employment to pay, either
149	149	directly or indirectly, any part of the cost of any such
150	150	examination, report, or copy of report. Provided that the report of
151	151	any physical examination furnished in accordance with this sect ion
152	152	shall not be made the basis or predicate for any action in damages
153	153	against the physician and surgeon making and furnishing such report.
154	154	B. 1. It shall be unlawful for any p erson, partnership,
155	155	association or corporation, either for himself, herself or itself,
156	156	or in a representative or fiduciary capacity, to require any
157	157	employee or applicant for employment, as a condition of employment
158	158	or continued employm ent, to submit to or take any vaccination,
159	159	injection, shot or medication for any virus, disease or condition.
160	160	2. An employee or applicant for employment may voluntarily
161	161	submit to and take a vaccination, injection, shot or medication as
162	162	recommended by an employer provided that such person has first
163	163	received, read, and signed a written statement explaining:

215	215	a. the person’s right to refuse for reason of health,
216	216	religion, or conscience without retaliation or
217	217	discrimination, and
218	218	b. the ingredients have never been disclosed and
219	219	therefore cannot know what is actually be ing put in
220	220	the employee’s body.
221	221	C. An employer shall recognize the right of individual bodily
222	222	autonomy and the rights of indi viduals to make their own healthcare
223	223	decisions, and no employee or applicant for employment shall be
224	224	terminated, disciplined, or refused employment based upon a refusal
225	225	to submit to any health service, medical testing, medical
226	226	intervention, medical treatment, or vaccine based on their
227	227	religious, philosophical, or personal beliefs.
228	228	D. Nothing in this section shall be interpreted to prohibit
229	229	health or safety requirements that do not include a vaccination ,
230	230	injection, shot, or medication.
231	231	SECTION 2. AMENDATORY 40 O.S. 2021, Section 192, is
232	232	amended to read as follows:
233	233	Section 192. Each and every violation of an y provision of
234	234	Section 1 191 of this act title shall constitute a misdemeanor,
235	235	punishable by a fine in any amount not exceeding O ne Hundred Dollars
236	236	($100.00).
237	237	SECTION 3. It being immediately necessary for the preservation
238	238	of the public peace, health or safety, an emergency is h ereby
