5454 BE IT RESOLVED BY THE S ENATE AND THE HOUSE OF RE PRESENTATIVES OF THE
5555 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
5656 SECTION 1. The Secretary of State shall refer to the peo ple for
5757 their approval or rejection, as and in the manner provided by law,
5858 the following proposed amendment to Section 1 of Article VIII of the
5959 Oklahoma Constitution to read as follows:
6060 Section 1. The Governor, and other elective state officers ,
6161 including the Justices of the Sup reme Court, and district attorneys
6262 shall be liable and s ubject to impeachment for wilful willful
6363 neglect of duty, corruption in office, habitual drunkenness,
6464 incompetency, or any offense involving moral turpitude committed

9191 while in office. All elected sta te officers, including Justices of
9292 the Supreme Court and Judges of the Court of Criminal Appeals, and
9393 district attorneys shall be automatically suspended from office upon
9494 their being declared guilty of a felony by a court of compete nt
9595 jurisdiction and thei r pay and allowances, otherwise payable to such
9696 official, shall be withheld during the period of such suspension.
9797 In the event such verdict of guilty is reversed by a court of
9898 competent jurisdiction on appeal, such accumulated pay and
9999 allowances which have been withheld shall be paid to such official
100100 and he or she shall be automatically reinstated in office to serve
101101 the remaining part of the term for which he or she was elected.
102102 Such official shall not be entitled to any pay or all owances for a
103103 period of time after the term of office would otherwise have expired
104104 and he or she shall not be entitled to reinstateme nt in office after
105105 the expiration of the term for which he or she was elected.
106106 Whenever any Justice of the Supreme Court o r Judge of the Court of
107107 Criminal Appeals is suspended by reasons of this section, the
108108 Governor shall be authorized to appoint a temporary Ju stice or Judge
109109 to serve during the period of such suspension and such temporary
110110 Justice or Judge shall be paid for his or her services the
111111 compensation allowed for such regular Justice or Judge.
112112 SECTION 2. The Ballot Title for t he proposed Constitutional
113113 amendment as set forth in SECTION 1 of this resolution shall be in
114114 the following form:
