43	43	rejection a proposed amendmen t to Section 1 of
44	44	Article VIII of the Oklahoma Constitution; making

54	54	BE IT RESOLVED BY THE S ENATE AND THE HOUSE OF RE PRESENTATIVES OF THE
55	55	1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
56	56	SECTION 1. The Secretary of State shall refer to the peo ple for
57	57	their approval or rejection, as and in the manner provided by law,
58	58	the following proposed amendment to Section 1 of Article VIII of the
59	59	Oklahoma Constitution to read as follows:
60	60	Section 1. The Governor, and other elective state officers ,
61	61	including the Justices of the Sup reme Court, and district attorneys
62	62	shall be liable and s ubject to impeachment for wilful willful
63	63	neglect of duty, corruption in office, habitual drunkenness,
64	64	incompetency, or any offense involving moral turpitude committed

91	91	while in office. All elected sta te officers, including Justices of
92	92	the Supreme Court and Judges of the Court of Criminal Appeals, and
93	93	district attorneys shall be automatically suspended from office upon
94	94	their being declared guilty of a felony by a court of compete nt
95	95	jurisdiction and thei r pay and allowances, otherwise payable to such
96	96	official, shall be withheld during the period of such suspension.
97	97	In the event such verdict of guilty is reversed by a court of
98	98	competent jurisdiction on appeal, such accumulated pay and
99	99	allowances which have been withheld shall be paid to such official
100	100	and he or she shall be automatically reinstated in office to serve
101	101	the remaining part of the term for which he or she was elected.
102	102	Such official shall not be entitled to any pay or all owances for a
103	103	period of time after the term of office would otherwise have expired
104	104	and he or she shall not be entitled to reinstateme nt in office after
105	105	the expiration of the term for which he or she was elected.
106	106	Whenever any Justice of the Supreme Court o r Judge of the Court of
107	107	Criminal Appeals is suspended by reasons of this section, the
108	108	Governor shall be authorized to appoint a temporary Ju stice or Judge
109	109	to serve during the period of such suspension and such temporary
110	110	Justice or Judge shall be paid for his or her services the
111	111	compensation allowed for such regular Justice or Judge.
112	112	SECTION 2. The Ballot Title for t he proposed Constitutional
113	113	amendment as set forth in SECTION 1 of this resolution shall be in
114	114	the following form:
