79	79	WHEREAS, the founders of the Constitution of the United States,
80	80	through the enactment of Article V, empowered state le gislators to
81	81	be guardians of liberty against future abuses of power by the
82	82	federal government; and
83	83	WHEREAS, in U.S. Term Limits, Inc. v. Thornton, 514 U.S. 779
84	84	(1995), the United States Supreme Court declared that states could
85	85	not individually impose term limits on their own federal delegations
86	86	through state statutes, but could collectively pass a term limits
87	87	amendment to the Constitution of the United States; and
88	88	WHEREAS, Article V of the Constitution of the United States
89	89	requires Congress to propose amend ments to the Constitution of the

142	142	Senate or call a Constitutional Convention upon application of two -
143	143	thirds (2/3) of state legislatures, and requi res ratification by

145	145	WHEREAS, without term limits, congressional members have an
146	146	advantage in elections that virtually guarantees a lifetime of
147	147	reelections; and
148	148	WHEREAS, term limits for members of Congress will allow an equal
149	149	balance of power to all states, with leadership positions based on
150	150	merit instead of political favors and tenure of members .
151	151	NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF
152	152	REPRESENTATIVES OF THE 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
153	153	Section 1. The Oklahoma Legislature hereby makes an application
154	154	to Congress, as provided by Article V of the Constitution of the
155	155	United States of America, to call a convention limited to proposing
156	156	an amendment to the Constitution of the United States of America to
157	157	set a limit on the number of terms that a person may be elected as a
158	158	Member of the United States House of Representatives and to set a
159	159	limit on the number of terms that a person may be elected as a
160	160	Member of the United States Senate.
161	161	Section 2. The Secretary of State is hereby directed to
162	162	transmit copies of t his application to the President and Secretary
163	163	of the Senate of the United States and to the Speaker, Clerk and
164	164	Judiciary Committee Chair of the House of Representatives of the

221	221	Section 3. This application shall be considered as covering the
222	222	same subject matter as the applications from other States to
223	223	Congress to call a convention to set a limit on the number of terms
224	224	that a person may be elected to the House of Representatives of the
225	225	Congress of the United States and the Senate of the United States;
226	226	and this application shall be aggregated with same for the purpose
227	227	of attaining the two -thirds (2/3) of states necessary to require
228	228	Congress to call a limit ed convention on this subject, but shall not
229	229	be aggregated with any other applications on any other s ubject.
230	230	Section 4. This application constitutes a continuing
231	231	application in accordance with Article V of the Constitution of the
232	232	United States of America u ntil the legislatures of at least two -
233	233	thirds (2/3) of the several states have made applications on t he
234	234	same subject.
