152	152		WHEREAS, the last proposal providing for a Consti tutional
153	153		Convention was submitted to a vote of the people March 17, 1970; and
154	154		WHEREAS, a State Question to eliminate the re quirement that a
155	155		Constitutional Conven tion proposal be submitted to the people every
156	156		twenty (20) years was defeated at the General El ection held November
157	157		8, 1994; and
158	158		WHEREAS, the original Constitutional Convention was comprised of
159	159		one hundred twelve membe rs, with fifty-five delegates from Ind ian
160	160		Territory, fifty-five delegates from Oklaho ma Territory, and two
161	161		members from Osage tribal land; and
162	162		WHEREAS, it is incumbent upon the Legislature to enact a law
163	163		providing for a Constitutional Convention and to sub mit the law to a
164	164		vote of the people.
165	165		NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF
166	166		REPRESENTATIVES OF THE 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
167	167		SECTION 1. There is hereby called a Constitutional Convention
168	168		for the purpose of altering, revising, or amending the current
169	169		Constitution, or to propose a ne w Constitution for this state, to be
170	170		submitted to the people for their approval or rejection.
171	171		SECTION 2. The Constitutional Convention shall co nvene at
172	172		twelve o’clock noon, July 12, 2024, in Oklahoma City at the State
173	173		Capitol.

225	225		SECTION 3. A. Delegates shall be chosen as follows:
226	226		1. There shall be sixty-eight delegates selected from the
227	227		Legislature: forty-eight delegates shall be members of the House of
228	228		Representatives, and twenty delegates shall be members of the
229	229		Senate. There shall be two members of the Senate from each election
230	230		class and four members of the House of Represen tatives from each
231	231		election class. The composition of delegates shall reflect the
232	232		party affiliation of the Senate and House of Representatives at time
233	233		of passage. Thirty-four members shall reside west of Interstate 35
234	234		and thirty-four members shall reside east of I nterstate 35. For
235	235		purposes of this paragrap h, if Interstate 35 passes through the
236	236		district of a legislator, th e entire district shall be considered to
237	237		be west of Interstate 35;
238	238		2. Twelve delegates shall be selected by lot pursuant to
239	239		subsection D of this section from the Executive Department of
240	240		government agencies, boards, and commissions within this state;
241	241		provided, none shall be statewide elected officials. Six of the
242	242		Executive Department delegates shall resid e west of Interstate 35
243	243		and six of the Executive Department delegates shall reside east of
244	244		Interstate 35. For purposes of thi s paragraph, if Interstate 35
245	245		passes through a county, other than Payne County, the entire county
246	246		shall be considered to be west of Interstate 35;
247	247		3. Six delegates shall be selected by lot pursuant to
248	248		subsection D of this section from the Judicial Departm ent of

301	301		judges subject to statewide retention ballot. Three of the judicial
302	302		delegates shall reside west of Interstate 35 and three of the
303	303		judicial delegates shall reside east of Interstate 35. For purposes
304	304		of this paragraph, if Interstate 35 passes through a county, ot her
305	305		than Payne County, the entire county shall be considered to be west
306	306		of Interstate 35; and
307	307		4. Twenty delegates from the public at larg e shall be selected
308	308		by lot, pursuant to subsection D of this section. No at-large
309	309		delegate shall be a statewide elect ed official. Nine of the at-
310	310		large delegates shall reside west of Interstate 35, nine of the at-
311	311		large delegates shall reside east of Interstate 35, and two of the
312	312		at-large delegates shall be from Osage tribal land. Two of the at-
313	313		large delegates shall be enrolled students from the two
314	314		comprehensive state univ ersities. The delegate from the University
315	315		of Oklahoma shall be one of the nine delegates from west of
316	316		Interstate 35 and the delegate from Oklahoma State University shall
317	317		be one of the nine delegates from east of Interstate 35. For
318	318		purposes of this paragraph, if Interstate 35 passes through a
319	319		county, other than Payne County, the entire county shall be
320	320		considered to be west o f Interstate 35.
321	321		B. An individual shall be eligible to serve as a delegate if
322	322		the individual is at least twenty -one (21) years of age and is a
323	323		qualified elector.

375	375		C. Except as provided in paragraph 5 of subsection D of this
376	376		section, an individual shall be eligible for consideratio n for
377	377		selection as a delegate pursuant to only one of the categories
378	378		provided for in subsect ion A of this section.
379	379		D. Delegates selected by lot shall be chosen pursuant to the
380	380		following procedure:
381	381		1. Members of the House of R epresentatives who wish to se rve as
382	382		delegates to the Constitutional Convention sha ll submit their names
383	383		to the Speaker of the House of Rep resentatives. From the list of
384	384		names submitted, the Speaker of the House of Representatives shall
385	385		select two delegates and the Minority Leader of the House of
386	386		Representatives shall select two delegat es. Names shall be drawn by
387	387		lot according to procedures established by the Constitutional
388	388		Convention Commission to select the re mainder of the delegates from
389	389		the House of Representatives. If an insuffi cient number of
390	390		Representatives meeting the qualifica tions required by paragraph 1
391	391		of subsection A of this section submit th eir names for
392	392		consideration, the Constitutional Convention Commission shall
393	393		provide for selection of the balance of membership from the
394	394		membership of the House of Representatives or for mer members of the
395	395		House of Representatives, subject to the qualificati ons provided for
396	396		in paragraph 1 of subsection A of this se ction;
397	397		2. Members of the Senate who wish to s erve as delegates to the
398	398		Constitutional Convention shall submit their names to th e President

450	450		Pro Tempore of the Senate. From the list of names submitte d, the
451	451		President Pro Tempore of the Senate shall select tw o delegates and
452	452		the Minority Leader of the Sen ate shall select two delegat es. Names
453	453		shall be drawn by lot according to procedu res established by the
454	454		Constitutional Convention Commission to select t he remainder of the
455	455		delegates from the Senate. If an insu fficient number of Senators
456	456		meeting the qualifications required by paragra ph 1 of subsection A
457	457		of this section submit their nam es for consideration, the
458	458		Constitutional Convention Commission shall pr ovide for selection of
459	459		the balance of membership from the membership of the Senate or
460	460		former members of the Senate, subject to the q ualifications provided
461	461		for in paragraph 1 of subsecti on A of this section;
462	462		3. Members of Executive Department agencies, boa rds, and
463	463		commissions who wish to serve as delegates to the Constitutional
464	464		Convention shall submit their n ames to the Governor. Name s shall be
465	465		drawn by lot according to procedures estab lished by the
466	466		Constitutional Convention Commission. If an insufficient number of
467	467		individuals from the Executive Department of gov ernment meeting the
468	468		qualifications required by paragraph 2 of subsection A of this
469	469		section submit their names for consideratio n, the Constitutional
470	470		Convention Commission shall provide for selection of the balance of
471	471		membership from within the Executive Dep artment or from former
472	472		officers or employees f rom the Executive Departmen t;

524	524		4. Members of the Judicial Department who wish to serve as
525	525		delegates to the Constitutional Convention shall submit their names
526	526		to the Chief Justice of the Oklahoma Supreme Court. Names shall be
527	527		drawn by lot according to proc edures established by the
528	528		Constitutional Convention Commission. If an insuffici ent number of
529	529		individuals from the Judicial Department of government mee ting the
530	530		qualifications required by paragraph 3 of subsect ion A of this
531	531		section submit their names for c onsideration, the Constitut ional
532	532		Convention Commission shall provide for selecti on of the balance of
533	533		membership from within the Judicial Department or f rom former
534	534		justices or judges from the Judicial Department ; and
535	535		5. Members of the public at large shall submit their names to
536	536		the Lieutenant Governor. Names shall be drawn by lot acc ording to
537	537		procedures established by the Constitutional Convention Commis sion.
538	538		If an insufficient number of individuals meeting th e qualifications
539	539		required by paragraph 4 of subsection A of this section submit their
540	540		names for consideration, the Constitutio nal Convention Commission
541	541		shall provide for selection of the balance of membershi p from
542	542		persons who have submitted their names pursuant to paragraphs 1
543	543		through 4 of this subsection.
544	544		E. Persons wishing to serve as delegates shall submit their
545	545		applications by February 1, 2024. By February 15, 2024, the persons
546	546		to whom the applications have been submitted sha ll forward the

598	598		applications to the Constitutional Convention Commission. Delegat es
599	599		shall be selected by March 1, 2024.
600	600		F. There is hereby created a Co nstitutional Convention
601	601		Commission. The purpose of the Commission is to develop the form to
602	602		be used for application to serve as a delegate , establish the
603	603		procedure for drawing names by lot, supervise the selection process
604	604		for delegates to the Constitution al Convention, and provide lists of
605	605		alternates to serve in case of a vacancy. Th e Constitutional
606	606		Convention Commission shall be composed o f the Governor or a
607	607		designee, the Chief Justice of the Supreme Court or a designee, the
608	608		Speaker of the House of Repre sentatives or a designee, the President
609	609		Pro Tempore of the Senate or a designee, a member of the House of
610	610		Representatives appointed by the Speaker of the House of
611	611		Representatives, and a member of the Senate appointed by the
612	612		President Pro Tempore of the Sen ate. The Commission members shall
613	613		select the chair and vice chair from the Commission membership. The
614	614		Commission shall conduct public hearings prior to the delegate
615	615		selection process to gather input from the public for issues to be
616	616		addressed by the Const itutional Convention.
617	617		SECTION 4. A. The Secretary of State shall call the
618	618		Constitutional Convention to order and preside until one of the
619	619		delegates is chosen President of the Constitutional Convention by
620	620		vote of the Convention.

672	672		B. Prior to the selection of a President, the delegates shall
673	673		take the following oath to support the Constitution of the United
674	674		States and to faithfully discharge the ir duties as delegates:
675	675		“I do solemnly swear or affirm that to the best of my abilities,
676	676		I will, as a delegate to the Constitutional Convention, uphold the
677	677		Constitution and laws of the United States of America and the State
678	678		of Oklahoma. I will not v ote to allow consideration of or to
679	679		approve any unauthorized amendment proposed for ratification to the
680	680		Oklahoma Constitution.”
681	681		Any delegate who violates the oath contained in this subsection
682	682		shall be recalled and replaced by the appointing authority and, upon
683	683		conviction, shall be gui lty of a misdemeanor.
684	684		C. The Convention may employ staff necessary to assis t the
685	685		delegates in performing their duties. The staff of the Senate and
686	686		House of Representatives shall provide additional assistance as
687	687		called upon by the President.
688	688		D. After choosing a President, the Convention shall organize
689	689		itself and select such other officers as it dee ms necessary.
690	690		E. The Convention may establish rul es for the Convention. Any
691	691		parliamentary question n ot provided for by the Oklaho ma Constitution
692	692		or the rules of the Constitutional Convention shall be governed by
693	693		Mason’s Manual of Legislative Procedure.

745	745		F. A simple majority of t he delegates shall consti tute a quorum
746	746		to transact business. A simple majori ty of the delegates shall be
747	747		necessary for the adoption of any m easure.
748	748		G. The original Constitution and all ame ndments added by the
749	749		initiative petition process or the legislative referendum process by
750	750		July 12, 2024, shall be the working draft for conside ration by the
751	751		Constitutional Convention. No article of the Cons titution shall be
752	752		reviewed by the Convention for possible alterations, revisions, or
753	753		amendments, unless t he motion to do so receives the appr oval of two-
754	754		thirds (2/3) of the delegates. Thereaft er, any proposed alteration,
755	755		revision, or amendment to an artic le shall require a simple majority
756	756		for adoption. To reverse any previous action taken by the
757	757		Convention pertaining to an alteration, revision , or amendment, two-
758	758		thirds (2/3) of the delegates mus t approve the motion.
759	759		SECTION 5. The Constitutional Convention shall adjourn sine die
760	760		no later than June 30, 2025.
761	761		SECTION 6. The delegates to the Constitutional Conventi on shall
762	762		receive no compensation but shall receive r eimbursement for mileage
763	763		and per diem as provided in the Stat e Travel Reimbursement Act for
764	764		the time that the Constitutional Convention is in session up to a
765	765		maximum of ninety (90) days.
766	766		SECTION 7. All expenses incurred by the Constitution al
767	767		Convention acting within t he scope of authority as provide d for in
768	768		this resolution and all expenses of holdi ng the election for

822	822		for by the state; an d it is made the express duty o f the Legislature
823	823		to provide for payment of the ex penses.
824	824		SECTION 8. The delegates shall be subject to all rules and
825	825		regulations promulgated by the Ethics Commission and all state and
826	826		federal laws to which le gislators are subject.
827	827		SECTION 9. Any alteration, revision , or amendment of the
828	828		current Constitution or new Constitution proposed by the
829	829		Constitutional Convent ion shall be submitted to the electors of the
830	830		state for adoption or rejection at the General Election to be hel d
831	831		in 2028.
832	832		SECTION 10. A special election is hereby ordered to be held
833	833		throughout this state on or before November 9, 2023, at which time
834	834		the proposed Constitutional Convention, as set forth in SECTION 1 of
835	835		this resolution, shall be su bmitted to the people of Oklahoma for
836	836		their approval or rejection as and in the manner provided by law.
837	837		SECTION 11. The Ballot Title for the proposed question to be
838	838		put before the people as provided herein shall be in the following

894	894		This measure calls a state Co nstitutional Convention. It would
895	895		begin on July 12, 2024. It would end by June 30, 2025. It
896	896		would review the State Cons titution. It could alter, amend, or
897	897		revise the Constitution. It could propose a new State
898	898		Constitution. There would be one hundred six delegates. Sixty-
899	899		eight delegates would be from t he State Legislature. Twelve
900	900		delegates would be from the Executive D epartment. They would be
901	901		from agencies, boards, and commissions. Six delegates would be
902	902		judges. Twenty members would be from the publ ic at large. Most
903	903		delegates would be picked by lot. A few delegates would be
904	904		selected by leadership of the Legislature . Delegates would be
905	905		paid for travel expenses for each day that the Convention meets.
906	906		Payment is limited. Delegates can be paid for n o more than
907	907		ninety days. Any change in the Constitu tion or new Constitution
908	908		must be presented for approval to state vot ers. This would
909	909		happen at the General Electio n in 2028.
