9797 WHEREAS, Section 2 of Article XXIV of the Oklahoma Constitution

152152 WHEREAS, the last proposal providing for a Consti tutional
153153 Convention was submitted to a vote of the people March 17, 1970; and
154154 WHEREAS, a State Question to eliminate the re quirement that a
155155 Constitutional Conven tion proposal be submitted to the people every
156156 twenty (20) years was defeated at the General El ection held November
157157 8, 1994; and
158158 WHEREAS, the original Constitutional Convention was comprised of
159159 one hundred twelve membe rs, with fifty-five delegates from Ind ian
160160 Territory, fifty-five delegates from Oklaho ma Territory, and two
161161 members from Osage tribal land; and
162162 WHEREAS, it is incumbent upon the Legislature to enact a law
163163 providing for a Constitutional Convention and to sub mit the law to a
164164 vote of the people.
165165 NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF
166166 REPRESENTATIVES OF THE 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
167167 SECTION 1. There is hereby called a Constitutional Convention
168168 for the purpose of altering, revising, or amending the current
169169 Constitution, or to propose a ne w Constitution for this state, to be
170170 submitted to the people for their approval or rejection.
171171 SECTION 2. The Constitutional Convention shall co nvene at
172172 twelve o’clock noon, July 12, 2024, in Oklahoma City at the State
173173 Capitol.

225225 SECTION 3. A. Delegates shall be chosen as follows:
226226 1. There shall be sixty-eight delegates selected from the
227227 Legislature: forty-eight delegates shall be members of the House of
228228 Representatives, and twenty delegates shall be members of the
229229 Senate. There shall be two members of the Senate from each election
230230 class and four members of the House of Represen tatives from each
231231 election class. The composition of delegates shall reflect the
232232 party affiliation of the Senate and House of Representatives at time
233233 of passage. Thirty-four members shall reside west of Interstate 35
234234 and thirty-four members shall reside east of I nterstate 35. For
235235 purposes of this paragrap h, if Interstate 35 passes through the
236236 district of a legislator, th e entire district shall be considered to
237237 be west of Interstate 35;
238238 2. Twelve delegates shall be selected by lot pursuant to
239239 subsection D of this section from the Executive Department of
240240 government agencies, boards, and commissions within this state;
241241 provided, none shall be statewide elected officials. Six of the
242242 Executive Department delegates shall resid e west of Interstate 35
243243 and six of the Executive Department delegates shall reside east of
244244 Interstate 35. For purposes of thi s paragraph, if Interstate 35
245245 passes through a county, other than Payne County, the entire county
246246 shall be considered to be west of Interstate 35;
247247 3. Six delegates shall be selected by lot pursuant to
248248 subsection D of this section from the Judicial Departm ent of

300300 government within thi s state; provided, none shall be justices or
301301 judges subject to statewide retention ballot. Three of the judicial
302302 delegates shall reside west of Interstate 35 and three of the
303303 judicial delegates shall reside east of Interstate 35. For purposes
304304 of this paragraph, if Interstate 35 passes through a county, ot her
305305 than Payne County, the entire county shall be considered to be west
306306 of Interstate 35; and
307307 4. Twenty delegates from the public at larg e shall be selected
308308 by lot, pursuant to subsection D of this section. No at-large
309309 delegate shall be a statewide elect ed official. Nine of the at-
310310 large delegates shall reside west of Interstate 35, nine of the at-
311311 large delegates shall reside east of Interstate 35, and two of the
312312 at-large delegates shall be from Osage tribal land. Two of the at-
313313 large delegates shall be enrolled students from the two
314314 comprehensive state univ ersities. The delegate from the University
315315 of Oklahoma shall be one of the nine delegates from west of
316316 Interstate 35 and the delegate from Oklahoma State University shall
317317 be one of the nine delegates from east of Interstate 35. For
318318 purposes of this paragraph, if Interstate 35 passes through a
319319 county, other than Payne County, the entire county shall be
320320 considered to be west o f Interstate 35.
321321 B. An individual shall be eligible to serve as a delegate if
322322 the individual is at least twenty -one (21) years of age and is a
323323 qualified elector.

375375 C. Except as provided in paragraph 5 of subsection D of this
376376 section, an individual shall be eligible for consideratio n for
377377 selection as a delegate pursuant to only one of the categories
378378 provided for in subsect ion A of this section.
379379 D. Delegates selected by lot shall be chosen pursuant to the
380380 following procedure:
381381 1. Members of the House of R epresentatives who wish to se rve as
382382 delegates to the Constitutional Convention sha ll submit their names
383383 to the Speaker of the House of Rep resentatives. From the list of
384384 names submitted, the Speaker of the House of Representatives shall
385385 select two delegates and the Minority Leader of the House of
386386 Representatives shall select two delegat es. Names shall be drawn by
387387 lot according to procedures established by the Constitutional
388388 Convention Commission to select the re mainder of the delegates from
389389 the House of Representatives. If an insuffi cient number of
390390 Representatives meeting the qualifica tions required by paragraph 1
391391 of subsection A of this section submit th eir names for
392392 consideration, the Constitutional Convention Commission shall
393393 provide for selection of the balance of membership from the
394394 membership of the House of Representatives or for mer members of the
395395 House of Representatives, subject to the qualificati ons provided for
396396 in paragraph 1 of subsection A of this se ction;
397397 2. Members of the Senate who wish to s erve as delegates to the
398398 Constitutional Convention shall submit their names to th e President

450450 Pro Tempore of the Senate. From the list of names submitte d, the
451451 President Pro Tempore of the Senate shall select tw o delegates and
452452 the Minority Leader of the Sen ate shall select two delegat es. Names

459459 the balance of membership from the membership of the Senate or
460460 former members of the Senate, subject to the q ualifications provided
461461 for in paragraph 1 of subsecti on A of this section;
462462 3. Members of Executive Department agencies, boa rds, and
463463 commissions who wish to serve as delegates to the Constitutional
464464 Convention shall submit their n ames to the Governor. Name s shall be
465465 drawn by lot according to procedures estab lished by the
466466 Constitutional Convention Commission. If an insufficient number of
467467 individuals from the Executive Department of gov ernment meeting the
468468 qualifications required by paragraph 2 of subsection A of this
469469 section submit their names for consideratio n, the Constitutional
470470 Convention Commission shall provide for selection of the balance of
471471 membership from within the Executive Dep artment or from former
472472 officers or employees f rom the Executive Departmen t;

524524 4. Members of the Judicial Department who wish to serve as
525525 delegates to the Constitutional Convention shall submit their names
526526 to the Chief Justice of the Oklahoma Supreme Court. Names shall be
527527 drawn by lot according to proc edures established by the
528528 Constitutional Convention Commission. If an insuffici ent number of
529529 individuals from the Judicial Department of government mee ting the
530530 qualifications required by paragraph 3 of subsect ion A of this
531531 section submit their names for c onsideration, the Constitut ional
532532 Convention Commission shall provide for selecti on of the balance of
533533 membership from within the Judicial Department or f rom former
534534 justices or judges from the Judicial Department ; and
535535 5. Members of the public at large shall submit their names to
536536 the Lieutenant Governor. Names shall be drawn by lot acc ording to
537537 procedures established by the Constitutional Convention Commis sion.
538538 If an insufficient number of individuals meeting th e qualifications
539539 required by paragraph 4 of subsection A of this section submit their
540540 names for consideration, the Constitutio nal Convention Commission
541541 shall provide for selection of the balance of membershi p from
542542 persons who have submitted their names pursuant to paragraphs 1
543543 through 4 of this subsection.
544544 E. Persons wishing to serve as delegates shall submit their
545545 applications by February 1, 2024. By February 15, 2024, the persons
546546 to whom the applications have been submitted sha ll forward the

598598 applications to the Constitutional Convention Commission. Delegat es
599599 shall be selected by March 1, 2024.
600600 F. There is hereby created a Co nstitutional Convention
601601 Commission. The purpose of the Commission is to develop the form to
602602 be used for application to serve as a delegate , establish the
603603 procedure for drawing names by lot, supervise the selection process
604604 for delegates to the Constitution al Convention, and provide lists of
605605 alternates to serve in case of a vacancy. Th e Constitutional
606606 Convention Commission shall be composed o f the Governor or a
607607 designee, the Chief Justice of the Supreme Court or a designee, the
608608 Speaker of the House of Repre sentatives or a designee, the President
609609 Pro Tempore of the Senate or a designee, a member of the House of
610610 Representatives appointed by the Speaker of the House of
611611 Representatives, and a member of the Senate appointed by the
612612 President Pro Tempore of the Sen ate. The Commission members shall
613613 select the chair and vice chair from the Commission membership. The
614614 Commission shall conduct public hearings prior to the delegate
615615 selection process to gather input from the public for issues to be
616616 addressed by the Const itutional Convention.
617617 SECTION 4. A. The Secretary of State shall call the
618618 Constitutional Convention to order and preside until one of the
619619 delegates is chosen President of the Constitutional Convention by
620620 vote of the Convention.

672672 B. Prior to the selection of a President, the delegates shall
673673 take the following oath to support the Constitution of the United
674674 States and to faithfully discharge the ir duties as delegates:
675675 “I do solemnly swear or affirm that to the best of my abilities,
676676 I will, as a delegate to the Constitutional Convention, uphold the
677677 Constitution and laws of the United States of America and the State
678678 of Oklahoma. I will not v ote to allow consideration of or to
679679 approve any unauthorized amendment proposed for ratification to the
680680 Oklahoma Constitution.”
681681 Any delegate who violates the oath contained in this subsection
682682 shall be recalled and replaced by the appointing authority and, upon
683683 conviction, shall be gui lty of a misdemeanor.
684684 C. The Convention may employ staff necessary to assis t the
685685 delegates in performing their duties. The staff of the Senate and
686686 House of Representatives shall provide additional assistance as
687687 called upon by the President.
688688 D. After choosing a President, the Convention shall organize
689689 itself and select such other officers as it dee ms necessary.
690690 E. The Convention may establish rul es for the Convention. Any
691691 parliamentary question n ot provided for by the Oklaho ma Constitution
692692 or the rules of the Constitutional Convention shall be governed by
693693 Mason’s Manual of Legislative Procedure.

745745 F. A simple majority of t he delegates shall consti tute a quorum
746746 to transact business. A simple majori ty of the delegates shall be
747747 necessary for the adoption of any m easure.
748748 G. The original Constitution and all ame ndments added by the
749749 initiative petition process or the legislative referendum process by
750750 July 12, 2024, shall be the working draft for conside ration by the
751751 Constitutional Convention. No article of the Cons titution shall be
752752 reviewed by the Convention for possible alterations, revisions, or
753753 amendments, unless t he motion to do so receives the appr oval of two-
754754 thirds (2/3) of the delegates. Thereaft er, any proposed alteration,
755755 revision, or amendment to an artic le shall require a simple majority
756756 for adoption. To reverse any previous action taken by the
757757 Convention pertaining to an alteration, revision , or amendment, two-
758758 thirds (2/3) of the delegates mus t approve the motion.
759759 SECTION 5. The Constitutional Convention shall adjourn sine die
760760 no later than June 30, 2025.
761761 SECTION 6. The delegates to the Constitutional Conventi on shall
762762 receive no compensation but shall receive r eimbursement for mileage
763763 and per diem as provided in the Stat e Travel Reimbursement Act for
764764 the time that the Constitutional Convention is in session up to a
765765 maximum of ninety (90) days.
766766 SECTION 7. All expenses incurred by the Constitution al
767767 Convention acting within t he scope of authority as provide d for in
768768 this resolution and all expenses of holdi ng the election for

822822 for by the state; an d it is made the express duty o f the Legislature
823823 to provide for payment of the ex penses.
824824 SECTION 8. The delegates shall be subject to all rules and
825825 regulations promulgated by the Ethics Commission and all state and
826826 federal laws to which le gislators are subject.
827827 SECTION 9. Any alteration, revision , or amendment of the
828828 current Constitution or new Constitution proposed by the
829829 Constitutional Convent ion shall be submitted to the electors of the
830830 state for adoption or rejection at the General Election to be hel d
831831 in 2028.
832832 SECTION 10. A special election is hereby ordered to be held
833833 throughout this state on or before November 9, 2023, at which time
834834 the proposed Constitutional Convention, as set forth in SECTION 1 of
835835 this resolution, shall be su bmitted to the people of Oklahoma for
836836 their approval or rejection as and in the manner provided by law.
837837 SECTION 11. The Ballot Title for the proposed question to be
838838 put before the people as provided herein shall be in the following

894894 This measure calls a state Co nstitutional Convention. It would
895895 begin on July 12, 2024. It would end by June 30, 2025. It
896896 would review the State Cons titution. It could alter, amend, or
897897 revise the Constitution. It could propose a new State
898898 Constitution. There would be one hundred six delegates. Sixty-
899899 eight delegates would be from t he State Legislature. Twelve
900900 delegates would be from the Executive D epartment. They would be
901901 from agencies, boards, and commissions. Six delegates would be
902902 judges. Twenty members would be from the publ ic at large. Most
903903 delegates would be picked by lot. A few delegates would be
904904 selected by leadership of the Legislature . Delegates would be
905905 paid for travel expenses for each day that the Convention meets.
906906 Payment is limited. Delegates can be paid for n o more than
907907 ninety days. Any change in the Constitu tion or new Constitution
908908 must be presented for approval to state vot ers. This would
909909 happen at the General Electio n in 2028.
