8383 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
8484 1ST SESSION OF THE 56TH OKLAHOMA LEGISLATURE:
8585 SECTION 1. The Secretary of State shall re fer to the people for
8686 their approval or rejection, as and in the manner provided by law,
8787 the following proposed amendment to the Oklahoma Constitution by
8888 adding a new Section 9 E to Article X to read as follows:
8989 Section 9. A. There is hereby created Public Infrastructure

142142 B. Municipalities may approve the creation of public
143143 infrastructure districts, which may incur indebtedness and issue
144144 public infrastructure district bonds to pay for all or part of the
145145 cost of public improvements within such di stricts. The cost of all
146146 indebtedness so incurred shall be levi ed and assessed by the board
147147 of trustees of a public infrastructure district on the property
148148 benefited by such improvements following the passage and approval of
149149 the organization of a public infrastructure district pursuant to
150150 subsection C of this section . The board shall collect the special
151151 assessments so levied and use the same to reimburse the public
152152 infrastructure district for the amount paid or to be paid by it on
153153 the bonds issued for such improvements not to exceed ten (10) mills
154154 for the purpose of p roviding funds for the purpose of support,
155155 organization, operation , and maintenance of such services .
156156 C. A public infrastructure district shall not be created
157157 unless:
158158 1. A petition, if there are any registered voters within the
159159 applicable area, is filed with the municipality that contains the
160160 signatures of one hundred percent (100%) of regis tered voters within
161161 the applicable area approving the creation of the public
162162 infrastructure district; or
163163 2. A petition is filed with the municipality that contains the
164164 signatures of one hundred percent (100 %) of surface property owners

216216 within the applicable area consenting to the creation of the public
217217 infrastructure district.
218218 D. The municipality may impose limitations on the powers of the
219219 public infrastructure distr ict through the governing document
220220 presented by the public infrastructure d istrict applicant.
221221 E. The levy shall be in addition to all oth er levies authorized
222222 by this Constitution, and when app roved, shall be made for the
223223 repayment of public infras tructure districts bonds issued by the
224224 public infrastructure districts for the public improvements agreed
225225 upon by the voters of the district as pr ovided by the governin g
226226 document.
227227 F. The Legislature s hall be authorized to enact such laws as
228228 may be necessary in ord er to implement public inf rastructure
229229 districts in the State of Oklahoma.
230230 SECTION 2. The Ballot Title for the proposed C onstitutional
231231 amendment as set forth in SECTION 1 of th is resolution shall be in
232232 the following form:

236236 This measure adds a new section of law to t he State
237237 Constitution. It adds Section 9 E to Article 10. It allows for
