79	79	BE IT RESOLVED BY THE SENATE AND THE HOUSE OF RE PRESENTATIVES OF THE
80	80	1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:
81	81	SECTION 1. The Secretary of St ate shall refer to the people for
82	82	their approval or rejection, as and in the manner provided by law,
83	83	the repeal of Section 3 and the following proposed amendment to
84	84	Section 4 of Article VII -B of the Oklahoma Constitution to rea d as
85	85	follows:
86	86	Section 4. When a vacancy in any Judi cial Office, however
87	87	arising, occurs or is certain to occur, the Judicial Nominating
88	88	Commission shall choose and submit to the Governor and the Chief
89	89	Justice of the Supreme Court three (3) nominees, each of whom has

142	142	a Judicial Officer if appointed. The the Governor shall appoint one
143	143	(1) of the nominees a nominee to fill the vacancy, but if he fails
144	144	to do so within sixty (60) days the Chie f Justice of the Supreme
145	145	Court shall appoint one (1) of the nominees, the appointment to be
146	146	certified by the Secretary of State and to be confirmed by the
147	147	Senate. If the Senate is not in session when an appointment is
148	148	made, the Governor may call the Senat e into special session no mor e
149	149	than once per quarter to advise and consent on any such appointment .
150	150	SECTION 2. The Ballot Title for the proposed Constitutional
151	151	amendment as set forth in SECTION 1 of th is resolution shall be in
152	152	the following form:

155	155	THE GIST OF THE PROPOSITION IS AS FOLLOWS:
156	156	This measure would amend Article 7 -B of the Oklahoma
157	157	Constitution. The measure would repeal Secti on 3 of Article 7-B
158	158	which created the Judicial Nominating Commission. The measure
159	159	would amend Section 4 of Article 7 -B to establish a process for
160	160	appointing Supreme Court justices and Court of Criminal Appeals
161	161	judges. The Governor will appoint new judges an d justices,
162	162	subject to confirmation by the Senate. Appellate judges will
163	163	stand for retention elections every 6 years as they do under
164	164	current law.
