46	46	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
47	47	SECTION 1. AMENDATORY 21 O.S. 2021, Section 1289.24e, is
48	48	amended to read as follows:

50	50	SECOND AMENDMENT SANCTUARY STATE ACT
51	51	A. The State Legislature hereby occupies and preemp ts the
52	52	entire field of legislation by any agency of this state or any
53	53	political subdivision in this state to infringe upon the righ ts of a
54	54	citizen of the State of Oklahom a, the unalienable right to keep and
55	55	bear arms as guaranteed to them by the Second Ame ndment of the
56	56	United States Constitution.
57	57	B. Any federal, state, county or municipal act, law, executive
58	58	order, administrative ord er, court order, rule, policy or regula tion
59	59	ordering the buy-back, confiscation or surrender of firearms,
60	60	firearm accessories or ammunition from law-abiding citizens of this

87	87	state shall be considered an infringement on the rights of citizens
88	88	to keep and bear arms as guaranteed by the Second Ame ndment of the
89	89	United States Constitution of the United States and Section 26 of
90	90	Article II, Section 26 of the Constitution of Oklahoma Constitution.
91	91	C. It shall be the duty of the courts and law enforcement
92	92	agencies of this state to protect the rights of law-abiding citizens
93	93	to keep and to bear arms within t he borders of this state and to
94	94	protect these rights from the infringemen t provided under the
95	95	provisions of this act the Second Amendment Sanctuary State Act.
96	96	Pursuant to the provisions of this section, a county sheriff shall
97	97	have the authority to detain or arrest any federal employee
98	98	operating within the county of the jurisdiction of the sheriff while
99	99	enforcing any federal act, law, executive order, ad ministrative
100	100	order, court order, rule, policy, or r egulation in violation of
101	101	subsection B of this section.
102	102	D. The preemption provided in this act the Second Amendment
103	103	Sanctuary State Act shall include:
104	104	1. Any regulation of arms and ammunition, pursuant to the
105	105	National Firearms Act of 1934, prohibited or regulated on or after
106	106	the effective date of this act April 26, 2021; and
107	107	2. Any regulations regulation or provision of the Gun Control
108	108	Act of 1968, prohibited or regulated on or after the effective date
109	109	of this act April 26, 2021.
110	110	E. For purposes of this section:

137	137	1. "Arms" is defined as shall mean any firearm, firearm part,
138	138	accessory or ammunition required to render that firearm operable and
139	139	effective;
140	140	2. "Infringement" shall mean any law that reduces, represses,
141	141	diminishes or subverts the right to keep and bear arms, ammunition,
142	142	parts and accessories in any amount that is legal as of the
143	143	effective date of this act April 26, 2021, of any citizen in this
144	144	state; and
145	145	3. "Law-abiding citizen" means shall mean a person who is not
146	146	otherwise precluded under st ate law from possessing a firearm and
147	147	shall not be constru ed to include anyone who is not legally present
148	148	in the United States or this state.
149	149	SECTION 2. This act shall become effective November 1, 2023.
