4646 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4747 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1289.24e, is
4848 amended to read as follows:

5050 SECOND AMENDMENT SANCTUARY STATE ACT
5151 A. The State Legislature hereby occupies and preemp ts the
5252 entire field of legislation by any agency of this state or any
5353 political subdivision in this state to infringe upon the righ ts of a
5454 citizen of the State of Oklahom a, the unalienable right to keep and
5555 bear arms as guaranteed to them by the Second Ame ndment of the
5656 United States Constitution.
5757 B. Any federal, state, county or municipal act, law, executive
5858 order, administrative ord er, court order, rule, policy or regula tion
5959 ordering the buy-back, confiscation or surrender of firearms,
6060 firearm accessories or ammunition from law-abiding citizens of this

8787 state shall be considered an infringement on the rights of citizens
8888 to keep and bear arms as guaranteed by the Second Ame ndment of the
8989 United States Constitution of the United States and Section 26 of
9090 Article II, Section 26 of the Constitution of Oklahoma Constitution.
9191 C. It shall be the duty of the courts and law enforcement
9292 agencies of this state to protect the rights of law-abiding citizens
9393 to keep and to bear arms within t he borders of this state and to
9494 protect these rights from the infringemen t provided under the
9595 provisions of this act the Second Amendment Sanctuary State Act.
9696 Pursuant to the provisions of this section, a county sheriff shall
9797 have the authority to detain or arrest any federal employee
9898 operating within the county of the jurisdiction of the sheriff while
9999 enforcing any federal act, law, executive order, ad ministrative
100100 order, court order, rule, policy, or r egulation in violation of
101101 subsection B of this section.
102102 D. The preemption provided in this act the Second Amendment
103103 Sanctuary State Act shall include:
104104 1. Any regulation of arms and ammunition, pursuant to the
105105 National Firearms Act of 1934, prohibited or regulated on or after
106106 the effective date of this act April 26, 2021; and
107107 2. Any regulations regulation or provision of the Gun Control
108108 Act of 1968, prohibited or regulated on or after the effective date
109109 of this act April 26, 2021.
110110 E. For purposes of this section:

137137 1. "Arms" is defined as shall mean any firearm, firearm part,
138138 accessory or ammunition required to render that firearm operable and
139139 effective;
140140 2. "Infringement" shall mean any law that reduces, represses,
141141 diminishes or subverts the right to keep and bear arms, ammunition,
142142 parts and accessories in any amount that is legal as of the
143143 effective date of this act April 26, 2021, of any citizen in this
144144 state; and
145145 3. "Law-abiding citizen" means shall mean a person who is not
146146 otherwise precluded under st ate law from possessing a firearm and
147147 shall not be constru ed to include anyone who is not legally present
148148 in the United States or this state.
149149 SECTION 2. This act shall become effective November 1, 2023.
