6868 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6969 SECTION 1. NEW LAW A new section of law to be codified
7070 in the Oklahoma Statutes as Section 2607.1 of Title 63, unless there

9898 As used in this act:
9999 1. "Biological sex" means the biological indication of male and
100100 female in the context of reproductive potential or capacity, such as
101101 sex chromosomes, naturally occurring sex hormones, gonads, and
102102 nonambiguous internal and external genitalia present at birth,
103103 without regard to an individual 's psychological, chosen, or
104104 subjective experience of gender;
105105 2. "Cross-sex hormones" means:
106106 a. testosterone or other androgens given to biological
107107 females in amounts that are larger or more potent than
108108 would normally occur naturally in healthy biological
109109 sex females, and
110110 b. estrogen given to biological males in amounts that are
111111 larger or more potent than would normally occur
112112 naturally in healthy biological sex males;
113113 3. "Gender" means the psychological, behavioral, social, and
114114 cultural aspects of being male or female;
115115 4. "Gender reassignment surgery " means any medical or surgical
116116 service that seeks to surgically alter or remove healthy physical or
117117 anatomical characteristics o r features that are typical for the
118118 individual's biological sex, in order to instill or create
119119 physiological or anatomical characteristics that resemble a sex
120120 different from the individual 's biological sex, including but not
121121 limited to genital or nongenita l gender reassignment surgery

148148 performed for the purpose of assisting an individual with a gender
149149 transition;
150150 5. "Gender transition" means the process in which a person goes
151151 from identifying with and living as a gender that corresponds to his
152152 or her biological sex to identifying with and living as a gender
153153 different from his or her biological sex, and may involve social,
154154 legal, or physical changes;
155155 6. a. "Gender transition procedures " means any medical or
156156 surgical service, including but not limited to
157157 physician's services, inpatient and outpatient
158158 hospital services, or prescribed drugs related to
159159 gender transition, that seeks to:
160160 (1) alter or remove physica l or anatomical
161161 characteristics or features that are typical for
162162 the individual's biological sex, or
163163 (2) instill or create physiological or anatomical
164164 characteristics that resemble a sex different
165165 from the individual's biological sex, including
166166 but not limited to medical services that provide
167167 puberty-blocking drugs, cross -sex hormones, or
168168 other mechanisms to promote the development of
169169 feminizing or masculinizing features in the
170170 opposite biological sex, or genital or nongenital
171171 gender reassignment surgery pe rformed for the

200200 b. Gender transition proced ures do not include:
201201 (1) services to persons born with a medically
202202 verifiable disorder of sex development, including
203203 a person with external biological s ex
204204 characteristics that are irresolvably ambiguous,
205205 such as those born with 46 XX chromosomes with
206206 virilization, 46 XY chromosomes with
207207 undervirilization, or having both ovarian and
208208 testicular tissue,
209209 (2) services provided when a physician has otherwise
210210 diagnosed a disorder of sexual development that
211211 the physician has determined through genetic or
212212 biochemical testing that the person does not have
213213 normal sex chromosome structure, sex steroid
214214 hormone production, or sex steroid hormone
215215 action,
216216 (3) the treatment of any infection, injury, disease,
217217 or disorder that has been caused by or
218218 exacerbated by the performan ce of gender
219219 transition procedures, whether or not the gender
220220 transition procedure was performed in accordance
221221 with state and federal law, or

248248 (4) any procedure undertaken because the individual
249249 suffers from a physical disorder, physical
250250 injury, or physical illness that would, as
251251 certified by a physician, place the individual in
252252 imminent danger of death or impairment of major
253253 bodily function unless surgery is performed;
254254 7. "Genital gender reassignment surgery " means a medical
255255 procedure performed for the pur pose of assisting an individual with
256256 a gender transition, including but not limited to:
257257 a. surgical procedures such as penectomy, orchiectomy,
258258 vaginoplasty, clitoroplasty, or vulvoplasty for
259259 biologically male patients or hysterectomy or
260260 ovariectomy for biologically female patients,
261261 b. reconstruction of the fixed part of the urethra with
262262 or without a metoidioplasty, or
263263 c. phalloplasty, vaginectomy, scroto plasty, or
264264 implantation of erection or testicular prostheses for
265265 biologically female patients;
266266 8. "Health care professional" means a person who is licensed,
267267 certified, or otherwise authorized by the laws of this state to
268268 administer health care in the ordin ary course of the practice of his
269269 or her profession;

296296 9. "Nongenital gender reassignment surgery " means medical
297297 procedures performed for the purpose of assisting an individual with
298298 a gender transition, including but not limited to:
299299 a. surgical procedures fo r biologically male patients,
300300 such as augmentation mammoplasty, facial feminization
301301 surgery, liposuction , lipofilling, voice surgery,
302302 thyroid cartilage reduction, gluteal augmentation,
303303 hair reconstruction, or various aesthetic procedures,
304304 or
305305 b. surgical procedures for biologically female patients,
306306 such as subcutaneous mastectomy, voice surgery,
307307 liposuction, lipofilling, pectoral implants, or
308308 various aesthetic procedures;
309309 10. "Physician" means a person who is licensed to practice
310310 medicine in this state;
311311 11. "Puberty-blocking drugs" means gonadotropin-releasing
312312 hormone analogues or other synthetic drugs used in biological males
313313 to stop luteinizing hormone secretion and therefore testosterone
314314 secretion, or synthetic drugs used in biological females which stop
315315 the production of estrogens and progesterone, when used to delay or
316316 suppress pubertal development in ch ildren for the purpose of
317317 assisting an individual with a gender transition; and
318318 12. "Public funds" means state, county, or local government
319319 monies, in addition to any department, agency, or instrumentality

346346 authorized or appropriated under state law or der ived from any fund
347347 in which such monies are deposited.
348348 SECTION 2. NEW LAW A new section of law to be codified
349349 in the Oklahoma Statutes as Section 2607.2 of Title 63, unless there
350350 is created a duplication in numbering, reads as follo ws:
351351 A. A physician or other health care professional shall not
352352 perform or attempt to perform gender transition procedures to any
353353 individual under twenty-one (21) years of age.
354354 B. A physician or other health care professional shall not
355355 refer any individual under twenty-one (21) years of age to any
356356 health care professional for gender transition procedures.
357357 C. A physician or other health care professional is not
358358 prohibited from providing any of the following procedures which are
359359 not gender transition proced ures to an individual under twenty-one
360360 (21) years of age:
361361 1. Services to persons born with a medically verifiable
362362 disorder of sex development, including a person with exter nal
363363 biological sex characteristics that are irresolvably ambiguous, such
364364 as those born with 46 XX chromosomes with virilization, 46 XY
365365 chromosomes with undervirilization, or having both ovarian and
366366 testicular tissue;
367367 2. Services provided when a physician has otherwise diagnosed a
368368 disorder of sexual development that the physician has det ermined
369369 through genetic or biochemical testing that the person does not have

396396 normal sex chromosome structure, sex steroid hormone production, or
397397 sex steroid hormone action;
398398 3. The treatment of any infection, injury, disease, or disorder
399399 that has been caused by or exacerbated by the performance of gender
400400 transition procedures, whether or not the gender transition
401401 procedure was performed in accordance with state and federal la w or
402402 whether funding for the gender transition procedure is permissible
403403 under Section 3 of this act; or
404404 4. Any procedure undertaken because the individual suffers from
405405 a physical disorder, physical injury, or physical illness that
406406 would, as certified by a physician, place the individual in imminent
407407 danger of death or impairment of m ajor bodily function unless
408408 surgery is performed.
409409 SECTION 3. NEW LAW A new section of law to be codified
410410 in the Oklahoma Statutes as Section 2607.3 of Title 63, unless there
411411 is created a duplication in numbering, reads as follows:
412412 A. Public funds shall not be directly or indirectly used,
413413 granted, paid, or distributed to any entity, organization, or
414414 individual that provides gender transition pr ocedures to an
415415 individual under twenty-one (21) years of age. Any violation shall
416416 result in the loss of such funding.
417417 B. Health care services furnished in the following situations
418418 shall not include gender transition procedures to an individual
419419 under twenty-one (21) years of age:

446446 1. By or in a health care facility owned by the state or a
447447 county or local government; or
448448 2. By a physician or other hea lth care professional employed by
449449 the state or a county or local government.
450450 C. The state Medicaid program shall not reimburse or provide
451451 coverage for gender transition pr ocedures to an individual under
452452 twenty-one (21) years of age.
453453 SECTION 4. NEW LAW A new section of law to be codified
454454 in the Oklahoma Statutes as Section 2607.4 of Title 63, unless there
455455 is created a duplication in numbering, reads as follows:
456456 A. 1. As provided in subsection A of Section 2 of this act, a
457457 physician or other health care professional performing or attempting
458458 to perform gender transition proce dures to any individual under
459459 twenty-one (21) years of age shall, upon conviction, be guilty of a
460460 felony punishable by fine not to exceed One Hundred Thousand D ollars
461461 ($100,000.00), or by confinement in the custody of the Department of
462462 Corrections for a term not to exceed ten (10) years, or by both such
463463 fine and imprisonment .
464464 2. Prosecution for a criminal violation of this subsection
465465 shall be commenced not later than the date as of whi ch the
466466 individual receiving gender transition procedures attains the age of
467467 forty-five (45) years.
468468 B. 1. As provided in subsection B of Section 2 of this act, a
469469 physician or other hea lth care professional found to have knowingly

496496 referred any individual under twenty-one (21) years of age to any
497497 health care professional for gender transition procedures shall,
498498 upon conviction, be guilty of a felony.
499499 2. Prosecution for a criminal violation of this subsection
500500 shall be commenced not later than the date as of w hich the
501501 individual receiving gender transition procedures attains the age of
502502 forty-five (45) years.
503503 C. 1. Any referral for or provision of gender transition
504504 procedures to an individu al under twenty-one (21) years of age is
505505 unprofessional conduct and sha ll, upon an adverse ruling by the
506506 appropriate licensing board, result in immediate revocation of the
507507 license or certificate of the physician or other health care
508508 professional.
509509 2. Disciplinary proceedings against the physician or other
510510 health care professional must be commenced not later than the date
511511 as of which the individual receiving gen der transition procedures
512512 attains the age of forty-five (45) years.
513513 D. 1. A person may assert a n actual or threatened violation of
514514 this act as an independent civil act ion or defense in a judicial or
515515 administrative proceeding and obtain compensatory damages ,
516516 injunctive relief, declaratory relief, or any other appropriate
517517 relief.

544544 2. A person shall bring a claim for a violation of this act no
545545 later than the date as of which the individual receiving gen der
546546 transition procedures attai ns the age of forty-five (45) years.
547547 3. An individual under eighteen (18) years of age may bring an
548548 action throughout thei r minority through a parent or next friend,
549549 and may bring an action in their own name upon reaching majority at
550550 any time from that point until twenty -seven (27) years after
551551 reaching the age of majority.
552552 4. Notwithstanding any other provision of law, an ac tion under
553553 this subsection may be commenced, and relief may be granted, in a
554554 judicial proceeding without regard to whether the person commencing
555555 the action has sought or exhausted available administrative
556556 remedies.
557557 5. In any action or proceeding to enforc e a provision of this
558558 act, a prevailing party who establishes a violati on of this act
559559 shall recover reasonable attorney fees.
560560 E. 1. The Attorney General may bring an action to enforce
561561 compliance with this act.
562562 2. This act does not deny, impair, or other wise affect any
563563 right or authority of the Attorney General, the State o f
564564 Oklahoma, or any agency, officer, or employee of the state,
565565 acting under any law other than this act, to institute or
566566 intervene in any proceeding.
