40	40	An Act relating to municipal roads; amending 11 O.S.

42	42	improvement, repair, and mainten ance of municipal
43	43	roads; modifying when board of county commissioners
44	44	may construct, improve, repair, or maintain roadways;

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 11 O.S. 2021, Section 36-113, is
54	54	amended to read as follows :
55	55	Section 36-113. A The Department of Transportation may, or the
56	56	board of county commissioners of any county or federally recognized
57	57	tribal government shall, by agreement with the g overning body of a
58	58	municipality having a population less than five thousand (5,000)
59	59	persons, construct, improve, repair or maintain any of the streets
60	60	of the municipality.
61	61	B. The board of county commissioners may construct, improve,
62	62	repair, or maintain an y of the streets of a municipality having a
63	63	population of less than five thousand (5,000) persons subject to

90	90	agreement between the governing bodies of the county and the
91	91	municipality without regard to whether the municipality has passed a
92	92	sales tax with proceeds earmarked to construct, improve, repair or
93	93	maintain any of the streets or roadways of such municipality ;
94	94	provided, that the municipality has budgeted revenues of the
95	95	municipality to construct, improve , repair, or maintain any of the
96	96	streets or roadways of such municipali ty; provided, the county has a
97	97	population of less than one hundred fifty thousand (150,000)
98	98	persons.
99	99	C. The board of county commissioners may construct, improve,
100	100	repair or maintain any of the streets of a municipality having a
101	101	population of greater than five thousand (5,000) persons but less
102	102	than fifteen thousand (15,000) persons if the municipality has
103	103	passed a sales tax or fee with the proceeds earmarked to construct,
104	104	improve, repair or maintain any of the streets or roadways of suc h
105	105	municipality; provided, that the county has a population of less
106	106	than one hundred fifty thousand (150,000) persons.
107	107	D. C. Notwithstanding any provision of this section, the board
108	108	of county commissioners may construct, improve, repair, or maintain
109	109	any of the streets of a municipality if the county has a population
110	110	in excess of one hundred fifty thousand (150,000) persons according
111	111	to the most recent Federal Decennial Census. The agreements entered
112	112	into pursuant to the provisions of this subsection may be performed
113	113	without regard to whether the municipality has passed a sales tax

142	142	SECTION 2. This act shall become effective November 1, 2023.
