40	40	An Act relating to school athletics; defining terms;
41	41	directing school athletic association to establish a
42	42	new category of competition; permitting certain
43	43	schools to elect to compete in new category;
44	44	specifying composition of existing category;
45	45	prescribing frequency for category election;
46	46	declaring applicability of election ; providing for
47	47	codification; and providing an effective date.

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 27-201 of Title 70, unless there
57	57	is created a duplication in number ing, reads as follows:
58	58	A. As used in this section:
59	59	1. "Schools of restricted enrollment " means schools that:
60	60	a. admit students based on entrance requirements
61	61	established by the school for admission and
62	62	enrollment,

89	89	b. decline enrollment of students based on standards
90	90	which differ from those established by the State
91	91	Department of Education ,
92	92	c. control enrollment size for the maintenance of a
93	93	maximum size standard, and
94	94	d. use tuition or costs of attendance as factors for
95	95	admission and enrollment; and
96	96	2. "Schools of unrestricted enrollment" means schools that:
97	97	a. admit all students for enrollment and attendance who
98	98	live within the established boundaries of the school s,
99	99	b. may accept transfer students who are living outside
100	100	the established boundaries of the sc hools,
101	101	c. follow residency rules of the State Department of
102	102	Education for school district residents and transfe r
103	103	students, and
104	104	d. do not collect tuition and fees for enro llment or
105	105	attendance.
106	106	B. Beginning with the 202 4-2025 school year, a school athletic
107	107	association, as defined in Section 27-102 of Title 70 of the
108	108	Oklahoma Statutes, shall establish a new category of competition for
109	109	schools of restricted enrollment. Schools of restricted enrollment
110	110	may elect to compete in the schools of restricted enrollme nt
111	111	category by requesting a move pursuan t to guidelines determined by
112	112	the school athletic association.

139	139	C. The existing alignment of classifications within the school
140	140	athletic association shall be in a category known as school s of
141	141	unrestricted and restrict ed enrollment and shall include schools of
142	142	unrestricted enrollment and schools of restricted enrollment .
143	143	Existing standards of enrollment size divisions for classes of
144	144	competition established by the school athletic associatio n shall
145	145	remain in effect for the schools of unrestricted and restricte d
146	146	enrollment.
147	147	D. Schools of restricted enrollment shall elect once every four
148	148	(4) years in which category they want to compet e. The election
149	149	shall be applicable to all competitions which are governed by the
150	150	school athletic association.
151	151	SECTION 2. This act shall become effective November 1, 2023.
