3939 An Act relating to child care; mandating payment of
4040 child care provider c ontract on weekly basis;
4141 requiring child care reimbursement to be based on
4242 enrollment and daily attendance; providing for rate
4343 determination based on tier level; providing for
4444 potential loss of benefit for certain absences;
4545 requiring Department of Human Services to conduct
4646 annual market rate survey; providing for
4747 codification; providing a n effective date; and
4848 declaring an emergency.

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. NEW LAW A new section of law to be codified
5656 in the Oklahoma Statutes as Section 230.74 of Titl e 56, unless there
5757 is created a duplication in numbering, reads as follows:
5858 A. A child care facility licensed by the Department of Human
5959 Services with a current child care provider c ontract shall receive
6060 reimbursement at the beginning of each week , fifty percent (50%)
6161 which shall be based on enrollment and fifty percent (50%) which
6262 shall be based on actual daily attendance. The rate shall be
6363 determined by the tier level of the child care facility where the

9090 child is enrolled and the age of each child on th e contract for the
9191 child care subsidy program minus the family copayment.
9292 B. The Electronic Benefit Transfer (EBT) card of the child
9393 shall only be swiped in on days in attendance and shall not be
9494 required to be swiped out. In the event that a child misse s ten
9595 (10) consecutive days of attendance without prior approval from the
9696 child care facility and a caseworker from the Department, the child
9797 may lose approval for the child care subsidy program and may be
9898 required to reapply in the program.
9999 C. The Department shall conduct an annual market rate survey to
100100 ensure compliance with the seventy -fifth percentile (75%) payment
101101 rate as required by the federal Child Care and Development Block
102102 Grant.
103103 SECTION 2. This act shall become effective July 1 , 2023.
104104 SECTION 3. It being immediately necessary for the preservation of
105105 the public peace, health or safety, an emergency is hereby declared
106106 to exist, by reason whereof this act shall take effect and be in
107107 full force from and after its pas sage and approval.
