39	39	An Act relating to child care; mandating payment of
40	40	child care provider c ontract on weekly basis;
41	41	requiring child care reimbursement to be based on
42	42	enrollment and daily attendance; providing for rate
43	43	determination based on tier level; providing for
44	44	potential loss of benefit for certain absences;
45	45	requiring Department of Human Services to conduct
46	46	annual market rate survey; providing for
47	47	codification; providing a n effective date; and

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. NEW LAW A new section of law to be codified
56	56	in the Oklahoma Statutes as Section 230.74 of Titl e 56, unless there
57	57	is created a duplication in numbering, reads as follows:
58	58	A. A child care facility licensed by the Department of Human
59	59	Services with a current child care provider c ontract shall receive
60	60	reimbursement at the beginning of each week , fifty percent (50%)
61	61	which shall be based on enrollment and fifty percent (50%) which
62	62	shall be based on actual daily attendance. The rate shall be
63	63	determined by the tier level of the child care facility where the

90	90	child is enrolled and the age of each child on th e contract for the
91	91	child care subsidy program minus the family copayment.
92	92	B. The Electronic Benefit Transfer (EBT) card of the child
93	93	shall only be swiped in on days in attendance and shall not be
94	94	required to be swiped out. In the event that a child misse s ten
95	95	(10) consecutive days of attendance without prior approval from the
96	96	child care facility and a caseworker from the Department, the child
97	97	may lose approval for the child care subsidy program and may be
98	98	required to reapply in the program.
99	99	C. The Department shall conduct an annual market rate survey to
100	100	ensure compliance with the seventy -fifth percentile (75%) payment
101	101	rate as required by the federal Child Care and Development Block
102	102	Grant.
103	103	SECTION 2. This act shall become effective July 1 , 2023.
104	104	SECTION 3. It being immediately necessary for the preservation of
105	105	the public peace, health or safety, an emergency is hereby declared
106	106	to exist, by reason whereof this act shall take effect and be in
107	107	full force from and after its pas sage and approval.
