52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 69 O.S. 2021, Section 1711, is
54	54	amended to read as follo ws:
55	55	Section 1711. The A. Except as provided in subsection B of
56	56	this section, the Oklahoma Turnpike Authority, subject to the
57	57	provisions hereof, is hereby authorized to fix, revise, charge and
58	58	collect tolls for the use of each turnpike project and the dif ferent
59	59	parts or sections thereof, except for use by law enforcement
60	60	officers responsible for enforcing the traffic laws and the general
61	61	laws of the state and federal governments on turnpikes, who shall be
62	62	entitled to free use of every such project in the p erformance of
63	63	official duties conne cted with such turnpike project, and to

90	90	contract with any person, partnership, association or corporation
91	91	desiring the use of any part thereof, including the right -of-way
92	92	adjoining the paved portion, for placing thereon t elephone,
93	93	telegraph, electric light or power lines, gas stations, garages,
94	94	stores, hotels, restaurants and advertising signs, or for any other
95	95	purpose except for tracks for railroad or railway use, and to f ix
96	96	the terms, conditions, rents and rates of charg es for such use.
97	97	Such tolls, subject to the other restrictions hereof, shall be so
98	98	fixed and adjusted in respect of the aggregate of tolls from t he
99	99	turnpike project or projects in connection with which the bonds of
100	100	any issue shall have been issued as to p rovide a fund sufficient
101	101	with other revenues, if any, to pay (a) the cost of maintaining,
102	102	repairing, and operating such turnpike project or projec ts, and (b)
103	103	the principal of and the interest of such bonds as the same shall
104	104	become due and payable, and to c reate reserves for such purposes.
105	105	The tolls and all other revenues derived from the turnpike project
106	106	or projects in connection with which the bond s of any issue shall
107	107	have been issued, except such part ther eof as may be necessary to
108	108	pay such cost of mainte nance, repair, and operation and to provide
109	109	such reserves therefor as may be provided for in the resolution
110	110	authorizing the issuance of such bonds or in the trust agreement
111	111	securing the same shall be set as ide at such regular intervals as
112	112	may be provided in such resolution or such trust agr eement in a
113	113	sinking fund which is hereby pledged to, and charged with, the

140	140	payment of (a) the interest upon suc h bonds as such interest shall
141	141	fall due, (b) the principal o f such bonds as the same shall fall
142	142	due, (c) the necessary charges of paying agents f or paying principal
143	143	and interest, and (d) the redemption price or the purchase price of
144	144	bonds retired by call o r purchase as therein provided, which are a
145	145	charge against such fund. The use and disposition of monies to th e
146	146	credit of such sinking fund shall be subject to the provisions of
147	147	the resolution authorizing the issuance of such bonds or of such
148	148	trust agreement. Except as may otherwise be provided in such
149	149	resolution or such trust agreement, such sinking fund shall b e a
150	150	fund for all such bonds without distinction or priority of one over
151	151	another. The monies in the sinking fund, less such reserve as may
152	152	be provided in such resolution or trust agreement, if not used
153	153	within a reasonable time for the purchase of bonds for cancellation
154	154	as above provided, sh all be applied to the redemption of bonds at
155	155	the redemption price then applicable. Any person who leases, rents ,
156	156	or acquires control of any gas station, garage, store, hot el, or
157	157	restaurant must have been a resident of, o r been doing business in,
158	158	Oklahoma for the past five (5) years. Notwithstanding anything else
159	159	herein contained to the contrary, the Oklahoma Corporation
160	160	Commission of the State of Oklahoma shall exercise the jurisdic tion
161	161	now or hereafter vested in it to r egulate and control the operation
162	162	of motor carriers of passengers and freight, using or desiring to
163	163	use any turnpike project, in the manner and to the extent that it

190	190	regulates or controls such carriers using the highw ays of the state.
191	191	The Authority shall not discriminate against any group or class or
192	192	individual member thereof in fixing the amount of toll, rents, or
193	193	charge for the use of the turnpike project.
194	194	B. The Oklahoma Turnpike Authority shall not charge tolls for
195	195	the use of any turnpike by the follo wing:
196	196	1. Law enforcement officers responsible for enforcing the
197	197	traffic laws and the general laws of the state and federal
198	198	governments on turnpikes who use the turnpike in the performance of
199	199	official duties connected with such turnpike project; or
200	200	2. Public school transportation equipment and auxiliary
201	201	transportation equipment as defined by Section 9 -104 of Title 70 of
202	202	the Oklahoma Statutes.
203	203	C. The Oklahoma Turnpike Authority is authorized to promulgate
204	204	any rules necessary to administer the purposes of t his section.
205	205	SECTION 2. This act shall become effective November 1, 2023.
