5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 69 O.S. 2021, Section 1711, is
5454 amended to read as follo ws:
5555 Section 1711. The A. Except as provided in subsection B of
5656 this section, the Oklahoma Turnpike Authority, subject to the
5757 provisions hereof, is hereby authorized to fix, revise, charge and
5858 collect tolls for the use of each turnpike project and the dif ferent
5959 parts or sections thereof, except for use by law enforcement
6060 officers responsible for enforcing the traffic laws and the general
6161 laws of the state and federal governments on turnpikes, who shall be
6262 entitled to free use of every such project in the p erformance of
6363 official duties conne cted with such turnpike project, and to

9090 contract with any person, partnership, association or corporation
9191 desiring the use of any part thereof, including the right -of-way
9292 adjoining the paved portion, for placing thereon t elephone,
9393 telegraph, electric light or power lines, gas stations, garages,
9494 stores, hotels, restaurants and advertising signs, or for any other
9595 purpose except for tracks for railroad or railway use, and to f ix
9696 the terms, conditions, rents and rates of charg es for such use.
9797 Such tolls, subject to the other restrictions hereof, shall be so
9898 fixed and adjusted in respect of the aggregate of tolls from t he
9999 turnpike project or projects in connection with which the bonds of
100100 any issue shall have been issued as to p rovide a fund sufficient
101101 with other revenues, if any, to pay (a) the cost of maintaining,
102102 repairing, and operating such turnpike project or projec ts, and (b)
103103 the principal of and the interest of such bonds as the same shall
104104 become due and payable, and to c reate reserves for such purposes.
105105 The tolls and all other revenues derived from the turnpike project
106106 or projects in connection with which the bond s of any issue shall
107107 have been issued, except such part ther eof as may be necessary to
108108 pay such cost of mainte nance, repair, and operation and to provide
109109 such reserves therefor as may be provided for in the resolution
110110 authorizing the issuance of such bonds or in the trust agreement
111111 securing the same shall be set as ide at such regular intervals as
112112 may be provided in such resolution or such trust agr eement in a
113113 sinking fund which is hereby pledged to, and charged with, the

140140 payment of (a) the interest upon suc h bonds as such interest shall
141141 fall due, (b) the principal o f such bonds as the same shall fall
142142 due, (c) the necessary charges of paying agents f or paying principal
143143 and interest, and (d) the redemption price or the purchase price of
144144 bonds retired by call o r purchase as therein provided, which are a
145145 charge against such fund. The use and disposition of monies to th e
146146 credit of such sinking fund shall be subject to the provisions of
147147 the resolution authorizing the issuance of such bonds or of such
148148 trust agreement. Except as may otherwise be provided in such
149149 resolution or such trust agreement, such sinking fund shall b e a
150150 fund for all such bonds without distinction or priority of one over
151151 another. The monies in the sinking fund, less such reserve as may
152152 be provided in such resolution or trust agreement, if not used
153153 within a reasonable time for the purchase of bonds for cancellation
154154 as above provided, sh all be applied to the redemption of bonds at
155155 the redemption price then applicable. Any person who leases, rents ,
156156 or acquires control of any gas station, garage, store, hot el, or
157157 restaurant must have been a resident of, o r been doing business in,
158158 Oklahoma for the past five (5) years. Notwithstanding anything else
159159 herein contained to the contrary, the Oklahoma Corporation
160160 Commission of the State of Oklahoma shall exercise the jurisdic tion
161161 now or hereafter vested in it to r egulate and control the operation
162162 of motor carriers of passengers and freight, using or desiring to
163163 use any turnpike project, in the manner and to the extent that it

190190 regulates or controls such carriers using the highw ays of the state.
191191 The Authority shall not discriminate against any group or class or
192192 individual member thereof in fixing the amount of toll, rents, or
193193 charge for the use of the turnpike project.
194194 B. The Oklahoma Turnpike Authority shall not charge tolls for
195195 the use of any turnpike by the follo wing:
196196 1. Law enforcement officers responsible for enforcing the
197197 traffic laws and the general laws of the state and federal
198198 governments on turnpikes who use the turnpike in the performance of
199199 official duties connected with such turnpike project; or
200200 2. Public school transportation equipment and auxiliary
201201 transportation equipment as defined by Section 9 -104 of Title 70 of
202202 the Oklahoma Statutes.
203203 C. The Oklahoma Turnpike Authority is authorized to promulgate
204204 any rules necessary to administer the purposes of t his section.
205205 SECTION 2. This act shall become effective November 1, 2023.
