15	44		Section 1-4-703, which relates to investigation of
16	45		home conditions; requiring a court hearing;
17	46		instructing the court to assess report and make
18	47		certain determinations; and providing an effec tive

26	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

28	54		SECTION 1. AMENDATORY 10A O.S. 2021, Section 1-4-703, is
29	55		amended to read as follows:
30		-
31	56		Section 1-4-703. A. After a petition has be en filed, the court
32	57		may order the child to be examined and evaluated by a physician or
33	58		other appropriate professional to aid the court in making the proper
34	59		disposition concerning the child. The court may order a behavioral
35	60		health evaluation of a child as provided by the Inpati ent Mental
36	61		Health and Substance Abuse Treatment of Minors Act.

38	62		B. After adjudication and at the re quest of a judge in any
39	63		juvenile proceeding, the Department of Human Services shall
40	64		investigate the home conditions and environment of the child and the

41	92		financial ability, occupation and ea rning capacity of the parent,
42	93		legal guardian or custodian of the ch ild. Upon request by the court
43	94		of another state, the Department may conduct a similar
44	95		investigation.

46	96		C. Within sixty (60) days of the start of each placeme nt of a
47	97		child in a qualified res idential treatment program as defined in
48	98		Section 1-1-105 of this title, the court shall set a hearing to:
49		-
50	99		1. Consider the assessment, dete rmination, and documentation
51	100		made by the qualified individua l conducting the asse ssment and
52	101		submitted as part of the Department's written report;
53		-
54	102		2. Determine whether the needs of the child can be met through
55	103		placement in a foster family home or, if not, determine whether
56	104		placement of the child in a qualified resi dential treatment pro gram
57	105		provides the most effective and appropriate level of care for the
58	106		child in the least restrictiv e environment;

60	107		3. Determine whether the child's current placement is
61	108		consistent with the short-term and long-term goals for the child, as
62	109		specified in the permanency plan for the child; and

64	110		4. Approve or disapprove the placement.

66	111		SECTION 2. This act shall become effective October 1, 2023.
