2653 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2854 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1-4-703, is
2955 amended to read as follows:

3156 Section 1-4-703. A. After a petition has be en filed, the court
3257 may order the child to be examined and evaluated by a physician or
3358 other appropriate professional to aid the court in making the proper
3459 disposition concerning the child. The court may order a behavioral
3560 health evaluation of a child as provided by the Inpati ent Mental
3661 Health and Substance Abuse Treatment of Minors Act.

3862 B. After adjudication and at the re quest of a judge in any
3963 juvenile proceeding, the Department of Human Services shall
4064 investigate the home conditions and environment of the child and the

4192 financial ability, occupation and ea rning capacity of the parent,
4293 legal guardian or custodian of the ch ild. Upon request by the court
4394 of another state, the Department may conduct a similar
4495 investigation.

4696 C. Within sixty (60) days of the start of each placeme nt of a
4797 child in a qualified res idential treatment program as defined in
4898 Section 1-1-105 of this title, the court shall set a hearing to:

5099 1. Consider the assessment, dete rmination, and documentation
51100 made by the qualified individua l conducting the asse ssment and
52101 submitted as part of the Department's written report;
53-
54102 2. Determine whether the needs of the child can be met through
55103 placement in a foster family home or, if not, determine whether
56104 placement of the child in a qualified resi dential treatment pro gram
57105 provides the most effective and appropriate level of care for the
58106 child in the least restrictiv e environment;
59-
60107 3. Determine whether the child's current placement is
61108 consistent with the short-term and long-term goals for the child, as
62109 specified in the permanency plan for the child; and
63-
64110 4. Approve or disapprove the placement.

66111 SECTION 2. This act shall become effective October 1, 2023.
