4040 An Act relating to motor vehicles; amending 47 O.S.
4141 2021, Sections 1-104 and 1-133.3 as amended by

4545 definitions; removing certain wattage r estrictions;

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
5555 SECTION 1. AMENDATORY 47 O.S. 2021, Secti on 1-104, is
5656 amended to read as follows:
5757 Section 1-104. A. A bicycle is a device upon which any person
5858 or persons may ride, propelled solely by human power through a belt,
5959 chain, or gears, and having two or more wheels, excluding mopeds.
6060 B. An electric-assisted bicycle is any bicycle with:
6161 1. Two or three wheels; and
6262 2. Fully operative pedals for human propulsion and equipped
6363 with an electric motor with a power output of not more than seven

9090 hundred fifty (750) watts that meets the requir ements of one of the
9191 following three classes:
9292 a. "Class 1 electric-assisted bicycle" shall mean an
9393 electric-assisted bicycle equipped with a motor that
9494 provides assistance only when the rider is pedalin g,
9595 and that ceases to provide assistance when the bicy cle
9696 reaches the speed of twenty (20) miles per hour,
9797 b. "Class 2 electric-assisted bicycle" shall mean an
9898 electric-assisted bicycle equipped with a motor that
9999 may be used exclusively to propel the bicyc le, and
100100 that is not capable of providing assistance wh en the
101101 bicycle reaches the speed of twenty (20) miles per
102102 hour, and
103103 c. "Class 3 electric-assisted bicycle" shall mean an
104104 electric-assisted bicycle equipped with a motor that
105105 provides assistance only whe n the rider is pedaling,
106106 and that ceases to provide as sistance when the bicycle
107107 reaches the speed of twenty -eight (28) miles per hour.
108108 An electric-assisted bicycle shall meet the manufacturing and
109109 equipment requirements adopted by the Consumer Product Safe ty
110110 Commission for bicycles and shall operate in such a manner that the
111111 electric motor disengages or ceases to function when the rider stops
112112 pedaling or the brakes are applied.
113113 C. A motorized bicycle is any bicycle having:

140140 1. Fully operative pedals for pr opulsion by human power;
141141 2. A power drive system that functions directly or
142142 automatically without clutching or shifting by the operator after
143143 the drive system is engaged; and
144144 3. A combustion engine with a piston or rotor displacement of
145145 eighty (80 cu cm) cubic centimeters (80 cc) or less, regardless of
146146 the number of chambers in the engine, which is capable of propelling
147147 the bicycle at a maximum design speed of not more than thirty -five
148148 (35) miles per hour on level ground.
149149 D. As used in this title, the te rm "bicycle" shall include
150150 tricycles, quadcycles, or similar h uman-powered devices, electric-
151151 assisted bicycles, and motorized bicycles unless otherwise
152152 specifically indicated.
153153 SECTION 2. AMENDATORY 47 O.S. 2021, Section 1 -133.3, as
154154 amended by Section 1, Cha pter 313, O.S.L. 2022 (47 O.S. Supp. 2022,
155155 Section 1-133.3), is amended to read as follows:
156156 Section 1-133.3 Motorized scooter.
157157 A. A "motorized scooter" is any vehicle having:
158158 1. Not more than three wheels in contact with the ground;
159159 2. Handlebars and a foot sup port or seat for the use of the
160160 operator; and
161161 3. A power source that is capable of propelling th e vehicle at
162162 a maximum design speed of not more than thirty-five (35) miles per
163163 hour on level ground, and:,

190190 a. if the power source is a combustion e ngine, has a
191191 piston or rotor displacement of fifty cubic
192192 centimeters (50 cc) or less regardless of the number
193193 of chambers in the power source, or
194194 b. if the power source is ele ctric, is programmed by the
195195 manufacturer not to exceed thirty-five (35) miles per
196196 hour on level ground.
197197 Regardless of power s ource, local governments may set maximum speed
198198 requirements by local ordinance.
199199 B. For purposes of this sect ion, an electric personal assistive
200200 mobility device, as d efined in Section 1-114A of this title,
201201 bicycle, electric-assisted bicycle, or motorized bicycle, as defined
202202 in Section 1-104 of this title, shall not be consi dered a motorized
203203 scooter.
204204 C. A motorized scooter shall not be required to be registered
205205 under the laws of this state.
206206 1. The operator of a motorized scooter shall be at least
207207 fourteen (14) years of age unless an older age is required by local
208208 ordinance.
209209 2. The operator of a motorized scooter shall not be required to
210210 possess a driver license unless required by l ocal ordinance.
211211 3. The operator of a motorized scooter sh all not be required to
212212 comply with the vehicle insurance or financial responsibility laws
213213 of this state unless required by local ordin ance, and shall observe

240240 all applicable traffic safety regulation s when driving on a public
241241 roadway as required by statute and local ordinances.
242242 D. Municipalities shall have authority to regulate the usage of
243243 motorized scooters on all public roadways, trails, sidewalks, and
244244 other public spaces, and to determine appropr iate locations for use.
245245 SECTION 3. This act shall become ef fective November 1, 2023.
