54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
55	55	SECTION 1. AMENDATORY 47 O.S. 2021, Secti on 1-104, is
56	56	amended to read as follows:
57	57	Section 1-104. A. A bicycle is a device upon which any person
58	58	or persons may ride, propelled solely by human power through a belt,
59	59	chain, or gears, and having two or more wheels, excluding mopeds.
60	60	B. An electric-assisted bicycle is any bicycle with:
61	61	1. Two or three wheels; and
62	62	2. Fully operative pedals for human propulsion and equipped
63	63	with an electric motor with a power output of not more than seven

90	90	hundred fifty (750) watts that meets the requir ements of one of the
91	91	following three classes:
92	92	a. "Class 1 electric-assisted bicycle" shall mean an
93	93	electric-assisted bicycle equipped with a motor that
94	94	provides assistance only when the rider is pedalin g,
95	95	and that ceases to provide assistance when the bicy cle
96	96	reaches the speed of twenty (20) miles per hour,
97	97	b. "Class 2 electric-assisted bicycle" shall mean an
98	98	electric-assisted bicycle equipped with a motor that
99	99	may be used exclusively to propel the bicyc le, and
100	100	that is not capable of providing assistance wh en the
101	101	bicycle reaches the speed of twenty (20) miles per
102	102	hour, and
103	103	c. "Class 3 electric-assisted bicycle" shall mean an
104	104	electric-assisted bicycle equipped with a motor that
105	105	provides assistance only whe n the rider is pedaling,
106	106	and that ceases to provide as sistance when the bicycle
107	107	reaches the speed of twenty -eight (28) miles per hour.
108	108	An electric-assisted bicycle shall meet the manufacturing and
109	109	equipment requirements adopted by the Consumer Product Safe ty
110	110	Commission for bicycles and shall operate in such a manner that the
111	111	electric motor disengages or ceases to function when the rider stops
112	112	pedaling or the brakes are applied.
113	113	C. A motorized bicycle is any bicycle having:

140	140	1. Fully operative pedals for pr opulsion by human power;
141	141	2. A power drive system that functions directly or
142	142	automatically without clutching or shifting by the operator after
143	143	the drive system is engaged; and
144	144	3. A combustion engine with a piston or rotor displacement of
145	145	eighty (80 cu cm) cubic centimeters (80 cc) or less, regardless of
146	146	the number of chambers in the engine, which is capable of propelling
147	147	the bicycle at a maximum design speed of not more than thirty -five
148	148	(35) miles per hour on level ground.
149	149	D. As used in this title, the te rm "bicycle" shall include
150	150	tricycles, quadcycles, or similar h uman-powered devices, electric-
151	151	assisted bicycles, and motorized bicycles unless otherwise
152	152	specifically indicated.
153	153	SECTION 2. AMENDATORY 47 O.S. 2021, Section 1 -133.3, as
154	154	amended by Section 1, Cha pter 313, O.S.L. 2022 (47 O.S. Supp. 2022,
155	155	Section 1-133.3), is amended to read as follows:
156	156	Section 1-133.3 Motorized scooter.
157	157	A. A "motorized scooter" is any vehicle having:
158	158	1. Not more than three wheels in contact with the ground;
159	159	2. Handlebars and a foot sup port or seat for the use of the
160	160	operator; and
161	161	3. A power source that is capable of propelling th e vehicle at
162	162	a maximum design speed of not more than thirty-five (35) miles per
163	163	hour on level ground, and:,

190	190	a. if the power source is a combustion e ngine, has a
191	191	piston or rotor displacement of fifty cubic
192	192	centimeters (50 cc) or less regardless of the number
193	193	of chambers in the power source, or
194	194	b. if the power source is ele ctric, is programmed by the
195	195	manufacturer not to exceed thirty-five (35) miles per
196	196	hour on level ground.
197	197	Regardless of power s ource, local governments may set maximum speed
198	198	requirements by local ordinance.
199	199	B. For purposes of this sect ion, an electric personal assistive
200	200	mobility device, as d efined in Section 1-114A of this title,
201	201	bicycle, electric-assisted bicycle, or motorized bicycle, as defined
202	202	in Section 1-104 of this title, shall not be consi dered a motorized
203	203	scooter.
204	204	C. A motorized scooter shall not be required to be registered
205	205	under the laws of this state.
206	206	1. The operator of a motorized scooter shall be at least
207	207	fourteen (14) years of age unless an older age is required by local
208	208	ordinance.
209	209	2. The operator of a motorized scooter shall not be required to
210	210	possess a driver license unless required by l ocal ordinance.
211	211	3. The operator of a motorized scooter sh all not be required to
212	212	comply with the vehicle insurance or financial responsibility laws
213	213	of this state unless required by local ordin ance, and shall observe

241	241	roadway as required by statute and local ordinances.
242	242	D. Municipalities shall have authority to regulate the usage of
243	243	motorized scooters on all public roadways, trails, sidewalks, and
244	244	other public spaces, and to determine appropr iate locations for use.
245	245	SECTION 3. This act shall become ef fective November 1, 2023.
