94 | 104 | | B. 1. The Oklahoma Medical Marijuana Authority shall have |
---|
95 | 105 | | oversight and auditing re sponsibilities to ensure that all marijuana |
---|
96 | 106 | | being grown in this state is accounted for and shall implement an |
---|
97 | 107 | | inventory tracking system. Pursuant to these duties, the Authority |
---|
98 | 108 | | shall require that each medical marijuana business, medical |
---|
99 | 109 | | marijuana research facility, medical marijuana education fa cility |
---|
100 | 110 | | and medical marijuana waste disposal facility keep records for every |
---|
101 | 111 | | transaction with another medical marijuana business, patient or |
---|
102 | 112 | | caregiver. Inventory shall be tracked and updated after each |
---|
103 | 113 | | individual sale and reported to the Authority. |
---|
104 | 114 | | 2. The inventory tracking system licensees use shall allow for |
---|
105 | 115 | | integration of other seed-to-sale systems and, at a minimum, shall |
---|
106 | 116 | | include the following: |
---|
107 | 117 | | a. notification of when marijuana seeds and clones are |
---|
108 | 118 | | planted, |
---|
109 | 119 | | b. notification of when marijuana plants are harvested |
---|
110 | 120 | | and destroyed, |
---|
111 | 121 | | c. notification of when marijuana is transported, sold, |
---|
112 | 122 | | stolen, diverted or lost, |
---|
143 | 154 | | e. all samples sent to a testing laboratory, an unused |
---|
144 | 155 | | portion of a sample returned to a licensee, all |
---|
145 | 156 | | samples utilized by licensee for purposes of |
---|
146 | 157 | | negotiating a sale, and |
---|
147 | 158 | | f. all samples used for quality testing by a lice nsee. |
---|
148 | 159 | | 3. Each medical marijuana business, medical marijuana research |
---|
149 | 160 | | facility, medical marijuana education facility and medical marijuana |
---|
150 | 161 | | waste disposal facility shall use a seed-to-sale tracking system or |
---|
151 | 162 | | integrate its own seed-to-sale tracking system wi th the seed-to-sale |
---|
152 | 163 | | tracking system established by the Authority. |
---|
153 | 164 | | 4. These records shall include, but not be limited to, the |
---|
154 | 165 | | following: |

155 | 166 | | a. the name and license number of the medical marijuana |
---|
156 | 167 | | business that cultivated, manufactured or sold the |
---|
157 | 168 | | medical marijuana or medical marijuana product, |
---|
158 | 169 | | b. the address and phone number of the medical marijuana |
---|
159 | 170 | | business that cultivated, manufactured or sold the |
---|
160 | 171 | | medical marijuana or medical marijuana product, |
---|
161 | 172 | | c. the type of product received during the transaction, |
---|
162 | 173 | | d. the batch number of the marijuana plant used, |
---|
193 | 205 | | i. any additional information as ma y be reasonably |

194 | 206 | | required by the Executive Director of the Oklahoma |

195 | 207 | | Medical Marijuana Authority. |

196 | 208 | | 5. All inventory tracking records retained by a medical |

197 | 209 | | marijuana business, medical marijuana research facility, medical |

198 | 210 | | marijuana education facility or medical marijuana waste disposal |

199 | 211 | | facility containing medical marijuana patient or caregiver |
---|
200 | 212 | | information shall comply with all relevant state and federal laws |

201 | 213 | | including, but not limited to, the Health Insurance Portability and |
---|
202 | 214 | | Accountability Act of 1996 (HIPAA). |
---|
203 | 215 | | C. 1. Upon the effective date of this act, the Authority shall |
---|
204 | 216 | | have thirty (30) business days to issue a request for prop osals and |
---|
205 | 217 | | select through a competitive bidding process, pursuant to Section |
---|
206 | 218 | | 85.7 of Title 74 of the Oklahoma Statutes, a vendor that shall |
---|
207 | 219 | | provide a seed-to-sale inventory tracking system for medical |
---|
208 | 220 | | marijuana business licensees. The contract may be a multi-year |
---|
209 | 221 | | contract or renewable annually, in accordance with any applicable |
---|
210 | 222 | | guidelines or procedures required by the Authority. |
---|
211 | 223 | | 2. The Authority shall be responsible for all costs ass ociated |
---|
212 | 224 | | with the seed-to-sale tracking system chosen by the Authority. The |
---|
243 | 256 | | marijuana business licensees to submit data to the Authority |
---|
244 | 257 | | directly through an application program interface (API), data |
---|
245 | 258 | | interchange service tool, or by means of a process and technology |
---|
246 | 259 | | acceptable to the Authority. If the Authority selects a vendor |
---|
247 | 260 | | whose proprietary software requir es the utilization of barcodes, |
---|
248 | 261 | | radio-frequency identification tags (RFID), or quick response (QR) |
---|
249 | 262 | | codes to manage data entry , the Authority shall be responsible for |
---|
250 | 263 | | purchasing the equipment necessary for medical marijuana business |
---|
251 | 264 | | licensees to interface w ith the software of the seed-to-sale |
---|
252 | 265 | | inventory tracking system. |
---|
253 | 266 | | 3. Upon selecting a vendor and prior to implementation of the |
---|
254 | 267 | | seed-to-sale inventory tracking system, the Authority shall be |
---|
255 | 268 | | responsible for providing sufficient training and training materials |
---|
256 | 269 | | to medical marijuana business licensees. Any administrative costs |
---|
257 | 270 | | related to training and training materials shall be the sole |
---|
258 | 271 | | responsibility of the Authority. |
---|
259 | 272 | | SECTION 2. REPEALER 63 O.S. 2021, Section 427.13, as |
---|
260 | 273 | | amended by Section 7, Chapter 584, O.S.L. 2021, is hereby repealed. |

261 | 274 | | SECTION 3. It being immediately necessary for the preservation |
---|
262 | 275 | | of the public peace, health or safety, an emergency is hereby |
