4047 An Act relating to medical marijuana; amending 63

6069 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6170 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.13, as
6271 amended by Section 14, Chapter 251, O.S.L. 2022 (63 O.S. Supp. 2022,
6372 Section 427.13), is amended to read as follows:
64-Section 427.13 A. All medical marijuana and medical marijuana
65-products shall be purchased solely from a state-licensed medical
66-marijuana business, and shall not be purchased from any out-of-state
67-providers.

100+Section 427.13 A. All medical marijuana and medical marijuana
101+products shall be purchased solely from a state-licensed medical
102+marijuana business, and shall not be purchased from any out-of-state
103+providers.
94104 B. 1. The Oklahoma Medical Marijuana Authority shall have
95105 oversight and auditing re sponsibilities to ensure that all marijuana
96106 being grown in this state is accounted for and shall implement an
97107 inventory tracking system. Pursuant to these duties, the Authority
98108 shall require that each medical marijuana business, medical
99109 marijuana research facility, medical marijuana education fa cility
100110 and medical marijuana waste disposal facility keep records for every
101111 transaction with another medical marijuana business, patient or
102112 caregiver. Inventory shall be tracked and updated after each
103113 individual sale and reported to the Authority.
104114 2. The inventory tracking system licensees use shall allow for
105115 integration of other seed-to-sale systems and, at a minimum, shall
106116 include the following:
107117 a. notification of when marijuana seeds and clones are
108118 planted,
109119 b. notification of when marijuana plants are harvested
110120 and destroyed,
111121 c. notification of when marijuana is transported, sold,
112122 stolen, diverted or lost,
113-d. a complete inventory of all marijuana, seeds, plant
114-tissue, clones, plants, usable marijuana or trim,
115-leaves and other plant matter, batches of ex tract, and
116-marijuana concentrates,

150+d. a complete inventory of all marijuana, seeds, plant
151+tissue, clones, plants, usable marijuana or trim,
152+leaves and other plant matter, batches of ex tract, and
153+marijuana concentrates,
143154 e. all samples sent to a testing laboratory, an unused
144155 portion of a sample returned to a licensee, all
145156 samples utilized by licensee for purposes of
146157 negotiating a sale, and
147158 f. all samples used for quality testing by a lice nsee.
148159 3. Each medical marijuana business, medical marijuana research
149160 facility, medical marijuana education facility and medical marijuana
150161 waste disposal facility shall use a seed-to-sale tracking system or
151162 integrate its own seed-to-sale tracking system wi th the seed-to-sale
152163 tracking system established by the Authority.
153164 4. These records shall include, but not be limited to, the
154165 following:
155166 a. the name and license number of the medical marijuana
156167 business that cultivated, manufactured or sold the
157168 medical marijuana or medical marijuana product,
158169 b. the address and phone number of the medical marijuana
159170 business that cultivated, manufactured or sold the
160171 medical marijuana or medical marijuana product,
161172 c. the type of product received during the transaction,
162173 d. the batch number of the marijuana plant used,
163-e. the date of the transaction,
164-f. the total spent in dollars,
165-g. all point-of-sale records,
166-h. marijuana excise tax records, and

201+e. the date of the transaction,
202+f. the total spent in dollars,
203+g. all point-of-sale records,
204+h. marijuana excise tax records, and
193205 i. any additional information as ma y be reasonably
194206 required by the Executive Director of the Oklahoma
195207 Medical Marijuana Authority.
196208 5. All inventory tracking records retained by a medical
197209 marijuana business, medical marijuana research facility, medical
198210 marijuana education facility or medical marijuana waste disposal
199211 facility containing medical marijuana patient or caregiver
200212 information shall comply with all relevant state and federal laws
201213 including, but not limited to, the Health Insurance Portability and
202214 Accountability Act of 1996 (HIPAA).
203215 C. 1. Upon the effective date of this act, the Authority shall
204216 have thirty (30) business days to issue a request for prop osals and
205217 select through a competitive bidding process, pursuant to Section
206218 85.7 of Title 74 of the Oklahoma Statutes, a vendor that shall
207219 provide a seed-to-sale inventory tracking system for medical
208220 marijuana business licensees. The contract may be a multi-year
209221 contract or renewable annually, in accordance with any applicable
210222 guidelines or procedures required by the Authority.
211223 2. The Authority shall be responsible for all costs ass ociated
212224 with the seed-to-sale tracking system chosen by the Authority. The
213-seed-to-sale inventory tracking s ystem shall feature a software
214-infrastructure that provides maximum flexibility for the exchange of
215-data between the Authority and m edical marijuana business licensees.
216-The seed-to-sale inventory tracking system shall allow the medical

252+seed-to-sale inventory tracking s ystem shall feature a software
253+infrastructure that provides maximum flexibility for the exchange of
254+data between the Authority and m edical marijuana business licensees.
255+The seed-to-sale inventory tracking system shal l allow the medical
243256 marijuana business licensees to submit data to the Authority
244257 directly through an application program interface (API), data
245258 interchange service tool, or by means of a process and technology
246259 acceptable to the Authority. If the Authority selects a vendor
247260 whose proprietary software requir es the utilization of barcodes,
248261 radio-frequency identification tags (RFID), or quick response (QR)
249262 codes to manage data entry , the Authority shall be responsible for
250263 purchasing the equipment necessary for medical marijuana business
251264 licensees to interface w ith the software of the seed-to-sale
252265 inventory tracking system.
253266 3. Upon selecting a vendor and prior to implementation of the
254267 seed-to-sale inventory tracking system, the Authority shall be
255268 responsible for providing sufficient training and training materials
256269 to medical marijuana business licensees. Any administrative costs
257270 related to training and training materials shall be the sole
258271 responsibility of the Authority.
259272 SECTION 2. REPEALER 63 O.S. 2021, Section 427.13, as
260273 amended by Section 7, Chapter 584, O.S.L. 2021, is hereby repealed.
261274 SECTION 3. It being immediately necessary for the preservation
262275 of the public peace, health or safety, an emergency is hereby
263-declared to exist, by reason whereof this act shall take effe ct and
264-be in full force from and after its passage and approval.
