52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 25 O.S. 2021, Section 307, as
54	54	amended by Section 1, Chapter 182, O.S.L. 2022 (25 O.S. Supp. 2022,
55	55	Section 307), is amended to read as follows:
56	56	Section 307. A. No public body shall hold executive sessions
57	57	unless otherwise specifically provided in this section.
58	58	B. Executive sessions of public bodies w ill be permitted only
59	59	for the purpose of:
60	60	1. Discussing the employment, hirin g, appointment, promotion,
61	61	demotion, disciplini ng or resignation of any individual sa laried
62	62	public officer or employee;

90	90	representatives of employee g roups;
91	91	3. Discussing the purchase or appraisal of rea l property;
92	92	4. Confidential communications bet ween a public body and its
93	93	attorney concerning a pending investigation, claim, or action if the
94	94	public body, with the advice of its attorney, determines th at
95	95	disclosure will seriously impair the ability of the public body to
96	96	process the claim or conduct a pending investigation, litigation, or
97	97	proceeding in the public interest;
98	98	5. Permitting district boards of education to hear eviden ce and
99	99	discuss the expulsion or suspension of a student when requested by
100	100	the student involved or the student's parent, attorney or legal
101	101	guardian;
102	102	6. Discussing matters involving a specific handicapped child;
103	103	7. Discussing any matter where disclosure of information would
104	104	violate confidentiality requirements of state or federal la w;
105	105	8. Engaging in deliberations or rendering a final or
106	106	intermediate decision in an individual proceeding pursuant to
107	107	Article II of the Administrative Procedures Act;
108	108	9. Discussing matters involving s afety and security at state
109	109	penal institutions or corr ectional facilities used to house state
110	110	inmates;
111	111	10. Discussing contract negotiation s involving contracts
112	112	requiring approval of the State Board of Corrections, which shall be

140	140	body, and the immediate staff of the public body. No person who may
141	141	profit directly or indirectly by a proposed transaction which is
142	142	under consideration may be present or participate in the executive
143	143	session; or
144	144	11. Discussing the following:
145	145	a. the investigation of a plan or scheme to commit an act
146	146	of terrorism,
147	147	b. assessments of the vulnerability of government
148	148	facilities or public improvements to an act of
149	149	terrorism,
150	150	c. plans for deterrence or prevention of or pro tection
151	151	from an act of terrorism,
152	152	d. plans for response or remediation after an act of
153	153	terrorism,
154	154	e. information technology of the public b ody but only if
155	155	the discussion specifically identifies:
156	156	(1) design or functional schematics t hat demonstrate
157	157	the relationship or connections between devices
158	158	or systems,
159	159	(2) system configuration information,
160	160	(3) security monitoring and response equipment

198	198	12. Self-evaluation of the public body .
199	199	For the purposes of this subsection, the term "terrorism" means any
200	200	act encompassed by the definitions set forth in Section 1268.1 of
201	201	Title 21 of the Oklahoma Statutes.
202	202	C. Notwithstanding the provisions of subsection B of this
203	203	section, the following public bodies may hold ex ecutive sessions:
204	204	1. The State Banking Board, as provided for under Section 306.1
205	205	of Title 6 of the Oklahoma Statutes;
206	206	2. The Oklahoma Industrial Finance Authority, as provided for
207	207	in Section 854 of Title 74 of the Oklahoma Statutes;
208	208	3. The Oklahoma Dev elopment Finance Authority, as provided for
209	209	in Section 5062.6 of Title 74 of the Oklahoma Statutes;

247	247	62 of the Oklahoma Statutes;
248	248	8. The Child Death Review Board for purposes of receiving and
249	249	conferring on matters pertaining to materials declared confidential
250	250	by law;
251	251	9. The Domestic Violence Fatality Review Boa rd as provided in
252	252	Section 1601 of Title 22 of the Oklahoma Statutes;
253	253	10. The Opioid Overdose Fatality Review Board, a s provided in
254	254	Section 2-1001 of Title 63 of the Oklahoma Statutes;
255	255	11. All nonprofit foundations, boards, bureaus, commissions,
256	256	agencies, trusteeships, authorities, councils, committees, public
257	257	trusts, task forces or study groups supported in whole or par t by
258	258	public funds or entrusted with the expenditure of public funds for
259	259	purposes of conferring on matters pertaining to economic developme nt

291	291	12. The Oklahoma Indigent Defense System B oard for purposes of
292	292	discussing negotiating s trategies in connection with making possible
293	293	counteroffers to offers to contract to provide l egal representation
294	294	to indigent criminal defendants and indigent juveniles in cases for
295	295	which the System must provide representation pursuant to the
296	296	provisions of the Indigent Defense Act;
297	297	13. The Quality Investment Committee for p urposes of discussing
298	298	applications and confidential materials pursuant to the terms of the
299	299	Oklahoma Quality Investment Act;
300	300	14. The Oklahoma Municipal Power Authority established pursuant
301	301	to Section 24-101 et seq. of Title 11 of the Oklahoma Statutes and
302	302	in its role as an electr ic utility regulated by the federal
303	303	government, for purposes of discussing security plans and procedures
304	304	including, but not limited to, cybersecurity matters; and
305	305	15. The Oklahoma Tax Commission for purposes of discussing
306	306	confidential taxpayer matters as provided in Section 205 of Title 68
307	307	of the Oklahoma Statutes, and in compliance with subsection E of
308	308	this section.

335	335	D. Except as otherwise specified in this subsection, an
336	336	executive session for the purpose of discussing the purchase or
337	337	appraisal of real pr operty shall be limited to members of the public
338	338	body, the attorney f or the public body and the immediate staff of
339	339	the public body. No landowner, real estate salesperson, broker,
340	340	developer or any other person who may profit directl y or indirectly
341	341	by a proposed transaction concerning real property which is under
342	342	consideration may be present or participate in the executive
343	343	session, unless they are operating under an existing agreement to
344	344	represent the public body.
345	345	E. No public body m ay go into an executive session unless the
346	346	following procedures are strictly complied with:
347	347	1. The proposed executive session is noted on the agenda as
348	348	provided in Section 311 of this title;
349	349	2. The executive session is authorized by a majority vote of a
350	350	quorum of the members pr esent and the vote is a recorded vote; and
351	351	3. Except for matters con sidered in executive sessions of the
352	352	State Banking Board and the Oklahoma Tax Commission, and which are
353	353	required by state or federal law to be confidential, any vo te or
354	354	action on any item of business considered in an executive session
355	355	shall be taken in public meeting with t he vote of each member
356	356	publicly cast and recorded.
357	357	F. A willful violation of the provisions of this section shall:

388	388	SECTION 2. This act shall become effective November 1, 2023.
