40	40	An Act relating to elections; amending 26 O.S. 2021,
41	41	Section 8-115, which relates to tabulation and
42	42	certification of votes; providing for continuous
43	43	tabulation; providing exception; and providing a n

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 26 O.S. 2021, Section 8 -115, is
52	52	amended to read as fol lows:
53	53	Section 8-115. The counting of ballots shall continue without
54	54	pause until all votes have been tabulated. If extreme and
55	55	unforeseen circumstanc es occur that require suspension of the vote
56	56	count, election officials shall notify the public of the susp ension
57	57	and the exact time that the vote count will resume. When all the
58	58	ballots have been counted, the county election board shall tabulate
59	59	the votes and shall certify the results. In the case of county
60	60	office, said certification shall be used to issue appropriate lists
61	61	and certificates. In the case of state or district offic e, copies
62	62	of said certification shall be transmitted immediately to the State

89	89	Election Board, whose duty it shall be to retabulate all pertinent
90	90	county returns and issue appro priate lists and certificates.
91	91	In the event of a tie involving candidates, the el ection board
92	92	authorized by law to issue the certified list or certificate of
93	93	election shall, at the meeting called to conduct the recount or to
94	94	issue the certified list or cer tificate of election, in the presence
95	95	of the candidates involved, if they or any of them desire to be
96	96	present, select the nominee or electee by lot substantially as
97	97	prescribed in paragraphs 3 and 4 of Section 8 -105 of this title.
98	98	SECTION 2. This act shall become effective November 1, 2023.
