51 | 54 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

52 | 55 | | SECTION 1. NEW LAW A new section of law to be codified |

53 | 56 | | in the Oklahoma Statutes as Section 5-117.7 of Title 70, unless |

54 | 57 | | there is created a duplication in numbering, reads as follows: |

55 | 58 | | A. An Education Employee Assistance Program shall be created |
---|
56 | 59 | | within the Department of Mental Health and Substance Abuse Services. |
---|
57 | 60 | | The program may provi de assistance to public school districts in the |
---|
58 | 61 | | management of employees whose personal problems may have a negative |
---|
59 | 62 | | impact on job performance. The program may also provide for |
---|
87 | 91 | | assistance to school district employees and their family members |
---|
88 | 92 | | seeking corrective help with medical or mental health problems, |
---|
89 | 93 | | including alcohol or drug abuse and emotional, marital, familial, |
---|
90 | 94 | | financial, or other personal problems. Participation in the |
---|
91 | 95 | | Education Employee Assistance Program shall be voluntary. |
---|
92 | 96 | | B. The Department of Mental Health and Substance Abuse Services |
---|
93 | 97 | | may contract with entities to carry out the purposes and functions |
---|
94 | 98 | | of the Education Employee Assistance Program and shall establish |
---|
95 | 99 | | standards and criteri a for entities to be eligible to contract with |
---|
96 | 100 | | the Department. |
---|
97 | 101 | | C. The Board of Mental Health and Substance Abuse Services |
---|
98 | 102 | | shall: |

99 | 103 | | 1. Promulgate rules necessary for the administration o f the |
---|
100 | 104 | | Education Employee Assistance Pr ogram and the maintenan ce and |
---|
101 | 105 | | release of participant records; and |
---|
102 | 106 | | 2. Establish evaluation methods to assess the effectiveness of |
---|
103 | 107 | | the Education Employee Assistance Program. |
---|
104 | 108 | | D. Nothing in this section shall nullify a school district's |
---|
105 | 109 | | existing employee ass istance program or prohibit a school district |
---|
106 | 110 | | from establishing its own employee assistance program; provided, |
---|
107 | 111 | | however, programs established by school districts shall be subject |
---|
108 | 112 | | to compliance with rules promulgate d by the Board to ensure |
---|
109 | 113 | | equitable treatment of employees. |

137 | 142 | | Employee Assistance Program or an employee assistance program |

138 | 143 | | established by a school district shall be maintained separate ly from |

139 | 144 | | regular personnel records and shall not b ecome part of an employee's |

140 | 145 | | personnel file. Records related to an individual's participation in |
---|
141 | 146 | | an employee assistance program shall be confidential and neither the |
---|
142 | 147 | | records nor the testimony of an Education Employee Assistance |
---|
143 | 148 | | Program professional shall be subject to subpoena unless a |
---|
144 | 149 | | participant poses a threat to deliberately harm others or engage in |
---|
145 | 150 | | self-harm. This determination shall be made by an Education |
---|
146 | 151 | | Employee Assistance Program professional. A participant in an |
---|
147 | 152 | | employee assistance program shall have a right to access his or her |
---|
148 | 153 | | own employee assistance program records. |
---|
149 | 154 | | F. Nothing in this section or the rules promulgated pursuant to |
---|
150 | 155 | | this section shall be construed to conflict with a school district's |
---|
151 | 156 | | responsibility and authority to maintain discipline or to take |
---|
152 | 157 | | disciplinary measures against employees if appropriate. |
---|
153 | 158 | | Participation or nonparticipation in any employee assistance program |
---|
154 | 159 | | shall not excuse an employee from discipline or otherwise affect the |
---|
155 | 160 | | terms and conditions of the employee's employment status with a |
---|
156 | 161 | | school district. |
---|
157 | 162 | | SECTION 2. This act shall become effective July 1, 2023. |
---|
158 | 163 | | SECTION 3. It being immediately necessary for the preservation |
---|
159 | 164 | | of the public peace, health or safety, an emergency is hereby |
