6464 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6565 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -204.2, is

9696 Education Leadership Oklahoma program.
9797 B. The purposes of the Educatio n Leadership Oklahoma program
9898 are to:
9999 1. Provide teachers throughout the state information about
100100 National Board certification and the Education Leadership Oklahoma
101101 program services;
102102 2. Provide technical assistance and National -Board-certified
103103 mentors to all teachers seeking National Board certification upon
104104 request;
105105 3. Reward teachers who are seeking National Board certification
106106 by awarding them a portion of the application processing charge and
107107 assessment fee and scholarship a s provided in subsection D of this
108108 section; and
109109 4. Reward teachers who are renewing their National Board
110110 certification by awarding them a portion of the renewal application
111111 fee as provided in subsection E of thi s section; and
112112 5. Provide recognition to Na tional-Board-certified teachers.
113113 C. To fulfill the objectives of the Education Leade rship
114114 Oklahoma Act, the Oklahoma Commission for Teacher Preparation OEQA
115115 shall:
116116 1. Inform teachers of the Education Leadership Oklahoma program
117117 and services it provides to teachers seeking National Board
118118 certification, emphasizing recruiting efforts toward teachers at

145145 high-poverty schools, schools identified as in need of improvement
146146 and in counties with the lowest percentage of teachers who have
147147 achieved National Board certification; and
148148 2. Ensure that all teachers seeking National Board
149149 certification receive adequate information regarding the level of
150150 commitment required to acquire National Board ce rtification.
151151 D. The Commission OEQA shall select not more than one hundred
152152 (100) applicants to participate in th e program each fiscal year for
153153 whom the Commission OEQA shall pay one-half (1/2) of the application
154154 processing charge and assessment fee for Na tional Board
155155 certification. The total amount paid by t he Commission OEQA shall
156156 not exceed One Thousand Three Hun dred Dollars ($1,300.00) per
157157 applicant. In addition the Commission OEQA shall also provide to
158158 the selected applicants a scholarship in the amo unt of Five Hundred
159159 Dollars ($500.00) to cover other expenses associa ted with obtaining
160160 National Board certification.
161161 E. The OEQA shall select not more than three hundred (300)
162162 applicants to participate in the renewal program each fiscal year
163163 for whom the OEQA shall pay a portion of t he fee for National Board
164164 certification renewal. The total amount paid by the OEQA shall not
165165 exceed Seven Hundred Fifty Dollars ($750.00) per applicant.
166166 F. The Commission OEQA shall promulgate rules establishing a
167167 process for accepting applications for t he Education Leadership
168168 Oklahoma program and for providing to applicants selected for the

195195 program up-front payment of the application processing charge and
196196 assessment fee and scholarship. If a selected applicant who
197197 receives the up-front payment does not complete National Board
198198 certification within three (3) years, the applicant shall repay the
199199 Commission OEQA the full amount paid by the Commission OEQA pursuant
200200 to subsection D of this section. All selected applicants who do not
201201 receive an up-front payment and successfully complete National Board
202202 certification shall be reimbursed by the Commission OEQA for the
203203 application processing charge and assessment fee. The total amount
204204 of reimbursement paid by the Commission OEQA shall not exceed One
205205 Thousand Three Hundred Dollars ($1,300.00) per applicant.
206206 F. G. It is the intent of the Legislature that the Oklahoma
207207 Commission for Teacher Preparation contract with Southeastern
208208 Oklahoma State University to OEQA establish Education Leade rship
209209 Oklahoma program trainin g in higher education teacher preparation
210210 programs in the state to assist teachers in meeting the requirements
211211 to obtain National Board certification.
212212 G. H. All teachers seeking National Board certification shall
213213 be eligible to participate in Education Le adership Oklahoma program
214214 training to assist them in meeting the requirements of the National
215215 Board certification pro cess, free of charge.
216216 H. I. Subject to district board of education policy or
217217 collective bargaining agreement , additional professional leav e days
218218 may be granted to teachers seeking N ational Board certification for

245245 National Board certification portfolio dev elopment. During the two
246246 (2) days of the additional professional days granted to teachers for
247247 National Board certification portfolio devel opment, a substitute
248248 teacher shall be provi ded by the school district at no cost to the
249249 teacher.
250250 I. J. 1. The State Board of Education OEQA shall provide to
251251 teachers who attained attain National Board certification prior to
252252 June 30, 2013, a bonus in the amount of Five Thousand Dollars
253253 ($5,000.00) annually over a ten-year or five-year period, to be paid
254254 no later than January 31 each year. The Board shall provide a bonus
255255 to any teacher who attains National Board certification after June
256256 30, 2013, if the teacher was selected for the Education Leader ship
257257 Oklahoma program before June 30, 2013, or the teacher has submitted
258258 an application for National Board certification to the National
259259 Board for Professional Teaching Standards befo re June 30, 2013
260260 depending on the duration of the certification .
261261 2. The teachers eligible to receive the annual bonus as
262262 provided for in para graph 1 of this subsection shall receive the
263263 annual bonus for the ten-year duration of their National Board
264264 certification and so long as they ar e teaching in the classroom
265265 full-time in an Oklahoma public school. No school or school
266266 district shall be liabl e for payment of bonuses pursuant to this
267267 section.

294294 3. The bonus shall not be included in the calculation of the
295295 teacher's salary for purposes o f meeting the district or statutory
296296 Minimum Salary Schedule, including instances where the salary
297297 schedule of the district exceeds the statutory Minimum Salary
298298 Schedule, or for purposes of compensating Oklahoma Teachers '
299299 Retirement System contributions or benefits.
300300 4. Teachers eligible to receive the annual bonus as provided
301301 for in paragraph 1 of this subsection sh all not be eligible to
302302 receive the additional salary increment for National Board
303303 certification as set forth in th e minimum salary schedule in S ection
304304 3 of this act.
305305 5. Teachers who atta in National Board certification after June
306306 30, 2013, shall be eligibl e to receive the additional salary
307307 increments for National Board certification as set forth in the
308308 minimum salary schedule in Section 3 of this act.
309309 6. The State Board of Education shall promulgate rules for a
310310 process by which a National -Board-certified teacher will verify
311311 that:
312312 a. the National Board certification has not lapsed,
313313 b. the teacher is still a full-time teacher employed in a
314314 public school, and
315315 c. for teachers eligible for the bonus, the teacher has
316316 not exceeded the limit of annual bonus payment s as
317317 provided for in paragraph 1 of this subsection.

344344 J. K. It is the intent of the Legislature that the Oklahoma
345345 State Regents for Higher Educa tion incorporate the National Board
346346 certification portfolio development into all programs in education
347347 leading to a master's level degree.
348348 SECTION 2. AMENDATORY 70 O.S. 2021, Section 6 -204.3, is
349349 amended to read as follows:
350350 Section 6-204.3 There is hereby created in the St ate Treasury a
351351 revolving fund for the Oklahoma Commission for Teacher Preparation
352352 Office of Educational Quality and Accountability (OEQA) to be
353353 designated the "Education Leadership Ok lahoma Revolving Fund ". The
354354 fund shall be a continuing fund, not subject to fiscal year
355355 limitations, and shall consist of all monies appropri ated or
356356 transferred to the fund by the Legislature. All monies accru ing to
357357 the credit of the fund are hereby appr opriated and may be budgeted
358358 and expended by the Oklahoma Commission for Teacher Preparation OEQA
359359 to provide assistance and scholarships for c andidates seeking
360360 National Board certification and renewal and to provide annual
361361 bonuses to qualified teachers pursuant to the requirements of
362362 Section 6-204.2 of this title. Expenditures from the fund shall be
363363 made upon warrants issued by the State Treasu rer against claims
364364 filed as prescribed by law with the Director of th e Office of
365365 Management and Enterprise Service s for approval and payment.

510510 B. 1. When determining the Minimum Salary Schedule, "fringe
511511 benefits" shall mean all or part of retirement benefits, excluding
512512 the contributions made pursuant to subsection A of Section 17 -108.1
513513 of this title and the flexible benefit allowance pursuant to Section
514514 26-105 of this title from the flexible benefit allowance funds
515515 disbursed by the State Board of Education and the State Board of
516516 Career and Technology Education pursuant to Section 26 -104 of this

544544 2. If a school district intends to provide retirement benefits
545545 to a teacher such that the teacher 's salary would be less than the
546546 amounts set forth in the minimum salary schedule Minimum Salary
547547 Schedule specified in subsection A of this section, the district
548548 shall be required to provide written no tification to the teacher
549549 prior to his or her employment or, if alre ady employed by the
550550 district, no later than thirty (30) days prior to the date the
551551 district elects to provide retirement benefits such that the
552552 teacher's salary would be less than the minimum salary schedule
553553 Minimum Salary Schedule.
554554 C. Any of the degrees referred to in this section shall be from
555555 a college recognized by the Stat e Board of Education. The Bo ard
556556 shall accept teaching experience from out -of-state school districts
557557 that are accredited by the state board of e ducation or appropriate
558558 state accrediting agency for the districts. The Board shall acce pt
559559 teaching experience from out-of-country schools that are accredited
560560 or otherwise endorsed by the appropriate national or regional
561561 accrediting or endorsement authori ty. Out-of-country certification
562562 documentation in a language other than English shall be analyzed by
563563 an educational credential evaluation se rvice in accordance with
564564 industry standards and guidelines and approved by the State
565565 Department of Education. The person seeking to have credit granted
566566 for out-of-country teaching experience shall be res ponsible for all
567567 costs of the analysis by a credenti al evaluation service. The Board

594594 shall accept teaching experience from primary and s econdary schools
595595 that are operated by the United States Department o f Defense or are
596596 affiliated with the United States Department of State.
597597 D. For the purpose of state sa lary increments and retirement,
598598 no teacher shall be granted credit for more than five (5) years of
599599 active duty in the military service or out -of-state or out-of-
600600 country teaching experience as a certified teacher or its
601601 equivalent. Nothing in this section shall prohibit boards of
602602 education from crediting more years of experience on distric t salary
603603 schedules than those allowed for state purposes.
604604 E. The State Board of Education shall recognize, for purpose s
605605 of certification and salary increments, all the ye ars of experience
606606 of a:
607607 1. Certified teacher who teaches in the educational program of
608608 the Department of Correctio ns, beginning with fiscal year 1981;
609609 2. Vocational rehabilitation counselor under the De partment of
610610 Human Services if the counselor was empl oyed as a certified teacher
611611 by the State Department of Education when the Division of Vocational
612612 Rehabilitation was transferred from the State Board of C areer and
613613 Technology Education or the State Board o f Education to the Okla homa
614614 Public Welfare Commissio n on July 1, 1968;
615615 3. Vocational rehabilitation counselor which were completed
616616 while employed by the Department of Human Services if such counselor

643643 was certified as a teacher or was eligible for certific ation as a
644644 teacher in Oklahoma;
645645 4. Certified teache r which were completed while employed by the
646646 Child Study Center located at University Hospital, if the teacher
647647 was certified as a teacher in Oklahoma; an d
648648 5. Certified school psychologist or psychometris t which were
649649 completed while employed as a doctoral intern, psychological
650650 assistant, or psychologist with any agency of the State of Okla homa
651651 if the experience primari ly involved work with persons of schoo l- or
652652 preschool-age and if the person was, at the t ime the experience was
653653 acquired, certified as, or el igible for certification as, a school
654654 psychologist or psychometrist.
655655 F. The provisions of this section shall not a pply to teachers
656656 who have entered into postretirement employment with a public school
657657 in Oklahoma and are still receiving a monthly retiremen t benefit.
658658 G. If a person employed as certified personnel, as defined in
659659 Section 26-103 of this title, by a school district during the 2017 -
660660 2018 school year was receiving a salary above the step level
661661 indicated by the State Mi nimum Salary Schedule for the 2017-2018
662662 school year, the person shall receive a salary increase amount equal
663663 to the amount indicated in subsecti on A of this section for the step
664664 level indicated for the person, provided they remain em ployed by the
665665 same district, unless the hours or the duties of the c ertified
666666 personnel are reduced proportionately.
