55+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56+SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -103.6, as
57+amended by Section 1, Chapter 122, O.S.L. 2022 (70 O.S. Supp. 2022,
58+Section 11-103.6), is amended to read as follows:
59+Section 11-103.6 A. 1. The State Board of Education shall
60+adopt subject matter standards for instruction of students in the
61+public schools of this state that are necessary to ensure there is
62+attainment of desired levels of competencies i n a variety of areas
63+to include language, mathematics, scien ce, social studies,
64+communication, and health and physical education.

101-BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
102-SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -129.11, is
103-amended to read as follows:
104-Section 3-129.11 A. There is hereby established the School
105-District Empowerment Program which shall be administered by the
106-State Board of Education. The purpose of the pro gram is to empower
107-locally elected school board members to govern school districts and
108-make decisions based on the needs of their students and
109-circumstances.
110-B. 1. Subject to the provisions of this section, a school
111-district shall be allowed to submit a request to the State Board of
112-Education for an exemption from all statutory requirements and State
113-Board of Education rules from which charter s chools are exempt, as
114-provided for in the Oklahoma Charter Schools Act. Any request for
115-exemption shall include a plan which outlines the goals sought to be
116-achieved at a minimum, include including the educational and fiscal
117-benefits and the anticipated i mpacts or outcomes the plan will have
118-in the district.
119-2. Within ninety (90) days after receiving the request a nd
120-plan, the State Board shall approve or disapprove the request. If
121-the State Board does not approve the request, it shall provide to
122-the school district a written explanation of the basis for its
123-decision. The school district may resubmit an amended re quest at
124-any time after the denial. The request shall be approved by the
92+2. School districts shall develop and implement cu rriculum,
93+courses and instruction in order to ensure that students meet the
94+skills and competencies as set forth in this section and in the
95+subject matter standards adopted by the State Board of Education.
96+3. All students shall gain literacy at the elemen tary and
97+secondary levels. Students shall develop skills in reading,
98+writing, speaking, computing, and critical thinking. For purpose s
99+of this section, critical thinking means a manner of analytical
100+thinking which is logical and uses linear factual analy sis to reach
101+a conclusion. They shall learn about cultures and environment s -
102+their own and those of others with whom they share the e arth. All
103+students shall receive the instruction needed to lead healthy and
104+physically active lifestyles. Students, the refore, shall study
105+social studies, literature, languages, the arts, health ,
106+mathematics, and science. Such curricula shall provide fo r the
107+teaching of a hands-on career exploration program in cooperation
108+with technology center schools.
109+4. The subject matter standards shall be designed to teach the
110+competencies for which studen ts shall be tested as provided in
111+Section 1210.508 of this t itle and shall be designed to prepare all
112+students for active citizenship, employment, and/or successful
113+completion of postsecondary education without the need for remedial
114+coursework at the posts econdary level.

151-State Board before implementatio n by the school district. An
152-approved request and plan shall be for no longer than three (3)
153-years. Prior to the beginning of the third year, the sc hool
154-district may apply for renewal of the approved reque st and plan.
155-The school district shall be requir ed to submit an annual report and
156-the State Board shall annually assess the academic achievement and
157-fiscal status of the school district.
158-C. Nothing in this section shall prevent a school district
159-board of education from choosing to follow any or all sta te laws,
160-rules or regulations from whi ch a charter school is exempt. A
161-school district which has been granted approval by the State Board
162-for an exemption as set forth in subsection B of this section shall
163-have the option to adopt policies to implement an y requirement for
164-the school district that is consistent with any statutory
165-requirement or mandate or State Board rule, but a participating
166-school district shall comply with the following requirements:
167-1. Students who reside in the school district shall b e entitled
168-to attend school in the dis trict as set forth in Section 1-114 of
169-this title;
170-2. School districts shall comply with the requirements of th e
171-minimum salary schedule for teachers as set forth in Section 18-
172-114.12 18-114.14 of this title;
142+5. The subject matter standards shall be de signed with rigor as
143+defined in paragraph 3 of subsection G of this section.
144+6. The subject matter standards for English Language Arts shall
145+give Classic Literature and nonfiction literature equa l
146+consideration to other literature. In addition, emphasis shall be
147+given to the study of complete works of literature.
148+7. At a minimum, the subject matter standards for mathemati cs
149+shall require mastery of the standard algorithms in mathematics,
150+which is the most logical, efficient way of solving a problem that
151+consistently works, and for students to attain fluency in Euclidian
152+geometry.
153+8. The subject matter standards for hist ory, social studies,
154+and United States Government shall include the content o f the United
155+States naturalization test, with an emphasis on the specific content
156+of the test and the ideas and concepts it references. The United
157+States naturalization test shal l be made available in physical and
158+electronic online formats as an optional assessment tool for
159+teachers.
160+9. The subject matter standar ds for United States Government
161+shall include an emphasis on civics. For the purposes of this
162+section, "civics" means the study of the rights and duties of
163+Oklahoma and United States citizens and of how those governments
164+work.

199-3. Employees of school districts shall contin ue to participate
200-as members of the Teachers' Retirement System of Oklahoma as set
201-forth in Section 17-101 et seq. of this title;
202-4. School districts shall comply with the requirement to
203-provide a health insurance plan for school district employees as set
204-forth in Section 5-117.5 of this title and to establish or make
205-available to school district employees a cafete ria plan as set forth
206-in Section 26-104 of this title;
207-5. School districts sha ll require any person employed by the
208-school district to file wit h the district board a current Oklahoma
209-criminal history record check from the Oklahoma State Bureau of
210-Investigation as well as a national criminal history record check as
211-defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Each
212-district shall adopt a policy regarding criminal history record
213-checks as set forth in Section 5 -142 of this title;
214-6. School districts shall comply with the requirement
215-requirements to evaluate teachers and to train personnel designated
216-to conduct personnel evaluation s as set forth in Sections 6-101.10
217-and Section 6-101.11 of this title, the dismissal and due process
218-procedures for administrators as set forth in Sections 6 -101.13
219-through 6-101.15 of this title and the due pro cess procedures for
220-teachers as set forth in Sections 6-101.21 through 6-101.26 of this
221-title;
192+10. The subject matter stan dards for health and physical
193+education shall include but not be limited to the domains of
194+physical, emotional, social, and intellectual health. Health
195+literacy shall include the ability to obtai n, process, and
196+understand basic health information and serv ices needed to make
197+appropriate health decisions. Health shall also include the
198+importance of proper nutrition and exe rcise, mental health and
199+wellness, substance abuse, coping skills for underst anding and
200+managing trauma, establishing and maintaining pos itive
201+relationships, and responsible decision making. Physical literacy
202+shall include the ability to move with compete nce and confidence in
203+a wide variety of physical activities in multiple envir onments that
204+benefit the healthy development of the whole pe rson.
205+B. Subject to the provisions of subsection C of this section,
206+in order to graduate from a public high school acc redited by the
207+State Board of Education with a standard diploma, students sha ll
208+complete the following college preparatory/work ready cur riculum
209+units or sets of competencies at the secondary level:
210+1. Four units or sets of competencies of English to incl ude
211+Grammar, Composition, Literature, or any English course approved for
212+college admission requirements;
213+2. Three units or sets of compe tencies of mathematics, limited
214+to Algebra I, Algebra II, Geometry, Trigonometry, Math Analysis,
215+Calculus, Advanced Pla cement Statistics, or any mathematics course

248-7. School districts shall comply with the requirement to mak e
249-payroll deductions for either or both professional organization dues
250-and political contributions u pon the request of an employee as set
251-forth in Section 5-139 of this title;
252-8. School districts shall comply with the dismissal and due
253-process procedures for education support employees as set forth in
254-Sections 6-101.40 through 6-101.47 of this title;
255-9. School districts shall employ as teachers, counselors,
256-librarians, school nurses, superintendents, principals, supervisors
257-or any other instructional, sup ervisory or administrative employee
258-only those persons who are certified by the State Board of Educa tion
259-in accordance with the Oklahoma Teacher Preparation Act, except for
260-persons exempt from the certification requirements as otherwise
261-provided by law;
262-10. School districts shall provide for negotiations between
263-school employees and school districts as set forth in Sections 509.1
264-through 509.11 of this title;
265-11. School districts shall be required to offer and students
266-enrolled in the school district shal l be required to complete the
267-curriculum requirements as set forth in Section 11 -103.6 of this
268-title;
269-12. Students enrolled in the school distr ict shall be required
270-to demonstrate mastery of the state academic content standards as
271-set forth in Section 121 0.523 of this title; and
243+with content and/or rigor above Algebra I and approved for college
244+admission requirements;
245+3. Three units or sets of competencies of laboratory science
246+approved for college admission requirements including one unit or
247+set of competencies of life science meeting the standards for
248+Biology I; one unit or set of competencies of physical science
249+meeting the standards for Physical Science, Chemistry, or Physics;
250+and one unit or set of competencies from the domains of physical
251+science, life science, or earth and space science such that the
252+content and rigor is above Biology I or Physical Science;
253+4. Three units or sets of competencies of history and
254+citizenship skills including one unit of American History, 1/2 one-
255+half unit of Oklahoma History, 1/2 one-half unit of United States
256+Government, and one unit from the subjects of History, Government,
257+Geography, Economics, Civics, or non -Western culture and approved
258+for college admission requirements;
259+5. Two units or sets of competencies of t he same world or non -
260+English language or two units of compu ter technology approved for
261+college admission requirements, whether taught at a high school or a
262+technology center school including computer programming, hardware,
263+and business computer application s, such as word processing,
264+databases, spreadsheets, and gr aphics, excluding keyboarding or
265+typing courses;

298-13. Members of the school district board of education shall be
299-required to satisfy the instruction and continuing educ ation
300-requirements as set forth in Sections 5-110, 5-110.1 and 5-110.2 of
301-this title.
302-SECTION 2. AMENDATORY 70 O.S. 2021, Section 6 -101.3, is
303-amended to read as follows:
304-Section 6-101.3 As used in Section 6-101 et seq. of this ti tle:
305-1. "Administrator" means a duly certified person who devotes a
306-majority of time to service as a superinten dent, elementary
307-superintendent, principal, supervisor, vice principal or in any
308-other administrative or s upervisory capacity in the school dist rict;
309-2. "Dismissal" means the discontinuance of the teaching service
310-of an administrator or teacher during the term of a written
311-contract, as provided by law;
312-3. "Nonreemployment" means the nonrenewal of the contrac t of an
313-administrator or teacher upon expiration of the contract;
314-4. "Career teacher" means a teacher who:
315-a. is employed by a school district prior to the 2017-
316-2018 school year and has completed three (3) or more
317-consecutive complete school years as a te acher in one
318-school district under a w ritten continuing or
319-temporary teaching contract, or
320-b. is employed for the first time by a school district
321-under a written continuing or temporary teaching
293+6. One additional unit or set of competencies selected from
294+paragraphs 1 through 5 of this subsection or career and technology
295+education courses, c oncurrently enrolled courses, advanced placement
296+courses, or International Baccalaureate courses approved for college
297+admission requirements; and
298+7. One unit or set of competencies of fine arts, such as music,
299+art, or drama, or one unit or set of competen cies of speech.
300+C. In lieu of the requirements of subsecti on B of this section
301+which requires a college preparatory/wo rk ready curriculum, a
302+student may enroll in the core curriculum as provided in subsection
303+D of this section upon w ritten approval of the parent or legal
304+guardian of the stud ent. For students under the age of eighteen
305+(18) school districts shall require a parent or legal guardian of
306+the student to meet with a designee of the school prior to
307+enrollment in the core curr iculum. The State Department of
308+Education shall develop an d distribute to school districts a form
309+suitable for this pu rpose, which shall include information on the
310+benefits to students of completing the college preparatory/work
311+ready curriculum as provide d for in subsection B of this section.
312+D. For those studen ts subject to the requirements of subsection
313+C of this section, in order to graduate from a public high school
314+accredited by the State Board of Education with a standard diploma,
315+students shall complete the following core curriculum units or sets
316+of competencies at the secondary level:

348-contract during the 2017 -2018 school year and
349-thereafter:
350-(1) has completed three (3) consecutive c omplete
351-school years as a teacher in one school district
352-under a written continuing or temporary teaching
353-contract and has achieved a district evaluation
354-rating of "superior" as measured pursuant to the
355-TLE as set forth in Section 6-101.16 of this
356-title for at least two (2) of the three (3)
357-school years,
358-(2) has completed four (4) consecutive complete
359-school years as a teacher in one school district
360-under a written continuing or temporar y teaching
361-contract, has averaged a district evaluation
362-rating of at least "effective" as measured
363-pursuant to the TLE for the four-year period, and
364-has received district evaluation r atings of at
365-least "effective" for the last two (2) years of
366-the four-year period, or
367-(3) has completed four (4) or more consecutive
368-complete school years in one school district
369-under a written continuing or temporary teaching
370-contract and has not met the requirements of
371-subparagraph a or b of this paragraph, only if
344+1. Language Arts – 4 Four units or sets of competencies to
345+consist of 1 one unit or set of competencies of grammar and
346+composition, and 3 three units or sets of competencies which may
347+include, but are not limited to, the fol lowing courses:
348+a. American Literature,
349+b. English Literature,
350+c. World Literature,
351+d. Advanced English Courses, or
352+e. other English courses with content and/or rigor equal
353+to or above grammar and composition;
354+2. Mathematics – 3 Three units or sets of com petencies to
355+consist of 1 one unit or set of competencies of Algebra I or Algebra
356+I taught in a contextual methodology, and 2 two units or sets of
357+competencies which may include, but are not limited to, the
358+following courses:
359+a. Algebra II,
360+b. Geometry or Geometry taught in a contextual
361+methodology,
362+c. Trigonometry,
363+d. Math Analysis or Precalculus,
364+e. Calculus,
365+f. Statistics and/or Probability,
366+g. Computer Science or acceptance and successful
367+completion of one (1) year o f a full-time, three-hour

398-the principal of the school at which the te acher
399-is employed submits a petition t o the
400-superintendent of the school district requesting
401-that the teacher be granted career status, the
402-superintendent agrees with the petition, and the
403-school district board of education approves the
404-petition. The principal shall specify in the
405-petition the underlying facts supporting the
406-granting of career status to the teacher;
407-5. "Teacher hearing" means the hearing before a school district
408-board of education after a recommendation fo r dismissal or
409-nonreemployment of a teacher has been made but before an y final
410-action is taken on the recommendation, held for the purpose of
411-affording the teacher all rights guarante ed by the United States
412-Constitution and the Constitution of Oklahoma und er circumstances
413-and for enabling the board to determine whether to app rove or
414-disapprove the recommendation;
415-6. "Probationary teacher" means a teacher who:
416-a. is employed by a schoo l district prior to the 2017-
417-2018 school year and has completed fewer tha n three
418-(3) consecutive complete school years as a teacher in
419-one school district under a written teaching contract,
420-or
395+career and technology program leading to an industry
396+credential/certificate or college credit. The State
397+Board of Career and Technology Education shall
398+promulgate rules to define the provisions of this
399+section related to the acce pted industry-valued
400+credentials which are industry-endorsed or industry-
401+aligned. The list of accepted industry-valued
402+credentials shall be reviewed annually and updated at
403+least every three (3) years by the Board,
404+h. (1) contextual mathematics courses wh ich enhance
405+technology preparation, o r
406+(2) a science, technology, engineering, and m ath
407+(STEM) block course meeting the requirements for
408+course competencies listed in paragraph 2 of
409+subsection B of this section, whether taught at
410+a:
411+(a) comprehensive high school, or
412+(b) technology center scho ol when taken in the
413+tenth, eleventh, or twelft h grade, taught by
414+a certified teacher, and approved by the
415+State Board of Education and the independent
416+district board of education,
417+i. mathematics courses taught at a tec hnology center
418+school by a teacher ce rtified in the secondary subject

447-b. is employed for the first time by a school district
448-under a written teaching contract during the 2017 -2018
449-school year and thereafter and has not met the
450-requirements for career teacher as provided in
451-paragraph 4 of this section;
452-7. "Suspension" or "suspended" means the temporary
453-discontinuance of the services of an administrator or teacher, as
454-provided by law;
455-8. "Teacher" means a person defined as a teacher has the same
456-meaning as provided in Section 1-116 of this title; and
457-9. "District evaluation rating" means the rating issued based
458-on the components of the TLE Oklahoma Teacher and Leader
459-Effectiveness Evaluation System (TLE) as set forth in subsection B
460-of Section 6-101.16 of this title.
461-SECTION 3. AMENDATORY 70 O.S. 2021, Section 6-101.10, is
462-amended to read as follows:
463-Section 6-101.10 A. Each school district board of education
464-shall maintain and annually rev iew, following consultat ion with or
465-involvement of representat ives selected by local teachers, a written
466-policy of evaluation and corresponding professional development fo r
467-all teachers and administrators. In those school districts in which
468-there exists a professional negotiatio ns agreement made in
469-accordance with Section 509.1 et seq. of this title, the procedure
470-for evaluating members of the negotiations unit and any sta ndards of
446+area when taken in the tenth, eleventh, or twelfth
447+grade upon approval of the State Board of Education
448+and the independent district board of education, or
449+j. any other mathematics course with content and/or rigor
450+equal to or above Algebra I;
451+3. Science – 3 Three units or sets of competencies to consist
452+of 1 one unit or set of competencies of Biology I or Biology I
453+taught in a contextual methodology, and 2 two units or sets of
454+competencies in the areas of life, physical, or earth science or
455+technology which may include, but are not l imited to, the following
456+courses:
457+a. Chemistry I,
458+b. Physics,
459+c. Biology II,
460+d. Chemistry II,
461+e. Physical Science,
462+f. Earth Science,
463+g. Botany,
464+h. Zoology,
465+i. Physiology,
466+j. Astronomy,
467+k. Applied Biology/Chemistry,

497-performance and conduct proposed for adoption beyond those
498-established by the State Board of Educat ion shall be negotiable
499-items. Nothing in this section shall be construed to annul, modify
500-or to preclude the renewal or continuing of any existin g agreement
501-heretofore entered into between any school district and any
502-organizational representative of its employees. Every policy of
503-evaluation adopted by a board of education shall:
504-1. Be based upon a set of minimum criteria developed by the
505-State Board of Education, which shall be revised and based upon the
506-Oklahoma Teacher and Lead er Effectiveness Evaluat ion System (TLE)
507-developed by the Stat e Board of Education as provided in Section 6-
508-101.16 of this title. The revisions to each policy of evaluati on
509-shall be phased in according to the following schedule:
510-a. for the 2014-2015, 2015-2016 and 2016-2017 school
511-years, the evaluation rating of tea chers and
512-administrators shall be based on the qualitative
513-component of the TLE. For the 2016 -2017 school year,
514-the State Department of Education shall work with
515-school districts to develop ind ividualized programs of
516-professional development as described in subsection B
517-of this section. However, nothing in this
518-subparagraph shall preclude a school district with an
519-average daily attendance of more than thirty -five
520-thousand (35,000) from continui ng to use quantitative
497+n. qualified agricultural education courses,
498+o. (1) contextual science courses which enhance
499+technology preparation, or
500+(2) a science, technology, engineering, and math
501+(STEM) block course meeting the requirements for
502+course competencies listed in paragraph 3 of
503+subsection B of this section, whether taught at
504+a:
505+(a) comprehensive high school, or
506+(b) technology center school when taken in the
507+tenth, eleventh, or twel fth grade, taught by
508+a certified teacher, and approved by the
509+State Board of Educatio n and the independent
510+district board of education,
511+p. science courses taught at a technology center school
512+by a teacher certified in the secondary subject area
513+when taken in the tenth, eleventh, o r twelfth grade
514+upon approval of the State Board of Educatio n and the
515+independent district board of education, or
516+q. other science courses with content and/or rigor equal
517+to or above Biology I;
518+4. Social Studies – 3 Three units or sets of competencies to
519+consist of 1 one unit or set of competencies of United State s
520+History, 1/2 one-half to 1 one unit or set of competencies of United

548-own expense prior to the 2015-2016 school year into
549-its evaluation system of teachers and admi nistrators,
550-as defined by the district 's written policy,
551-b. for evaluations of teache rs and administrators
552-conducted during the 2017 -2018 school year, and each
553-school year thereafter, school districts shall
554-incorporate and put into operation the qualitativ e
555-component of the TLE as provided for in subsection B
556-of Section 6-101.16 of this title into the evaluations
557-used in all school sites within the d istrict. For the
558-2017-2018 school year, and each school year
559-thereafter, teachers and administrators shall r eceive
560-a district evaluation rating based on the components
561-of the TLE as set forth i n subsection B of Sectio n 6-
562-101.16 of this title. For the 201 7-2018 school year,
563-school districts shall incorporate the individualized
564-programs of professional developmen t as described in
565-subsection B of this section on a pilot program basis,
566-and
567-c. for evaluations of teachers a nd administrators
568-conducted during the 2018-2019 school year, and each
569-school year thereafter, school districts shall fully
570-incorporate and put int o operation the individualized
548+States Government, 1/2 one-half unit or set of competencies of
549+Oklahoma History, and 1/2 one-half to 1 one unit or set of
550+competencies which may include, but are not limited to, the
551+following courses:
552+a. World History,
553+b. Geography,
554+c. Economics,
555+d. Anthropology, or
556+e. other social studies courses with content and/or rigor
557+equal to or above United States History, United States
558+Government, and Oklahoma History;
559+5. Arts – 1 One unit or set of competencies which may include,
560+but is not limited to, courses in Visual Arts and General Music; and
561+6. Computer Education or World Language - 1 One unit or set of
562+competencies of computer t echnology, whether taught at a high school
563+or a technology center school including computer programming,
564+hardware, and business computer applications, such as word
565+processing, databases, spreadsheets, and graphics, excluding
566+keyboarding or typing courses, or 1 one unit or set of competencies
567+of world or non-English language.
568+E. The State Board of Education may develop ru les to determine
569+if courses on aviation are eligible for non -elective academic credit
570+toward meeting the graduation requirements set forth in subsections
571+B and D of this section.

598-subsection B of this sect ion;
599-2. Be prescribed in writing at t he time of adoption and at all
600-times when amendments to the policy are adopted. The original
601-policy and all amendments to the policy shall be promptly made
602-available to all persons subject to t he policy;
603-3. Provide that all evaluations be made in writing and that
604-evaluation documents and responses thereto be maintained in a
605-personnel file for each evaluated per son;
606-4. Provide that every probationary teacher receive formative
607-feedback from the evaluation process at le ast two times per school
608-year, once during the fall semester and once during the spring
609-semester;
610-5. Provide that every teacher be evaluated once every year,
611-except for career teachers receiving a district evaluation rating of
612-"superior" or "highly effective" under the TLE who may be evaluate d
613-once every three (3) years; and
614-6. Provide that, except for superintendents of independent and
615-elementary school districts and superintendents of area school
616-districts who shall be evaluated by the school district b oard of
617-education, all certified perso nnel shall be evaluated by a
618-principal, assistant principal, designee of the principal,
619-supervisor, content e xpert, department chair, peer committee or
599+F. 1. In addition to the curriculum requirements of either
600+subsection B or D of this section, in order to graduate from a
601+public high school accredited by the State Board of Education
602+students shall complete the r equirements for a personal financial
603+literacy passport as se t forth in the Passport to Financial Literacy
604+Act and any additional course requirements or recommended elective
605+courses as may be established by the State Board of Education and
606+the district school board. School districts shall strongly
607+encourage students to complete two units or sets of competencies of
608+world languages and two units or sets of competencies of physical
609+and health education.
610+2. No student shall receive credit for high scho ol graduation
611+more than once for completion of the same unit or set of
612+competencies to satisfy the curriculum requirements of this section.
613+3. A school district shall not be required to offer every
614+course listed in subsections B and D of this section but shall offer
615+sufficient courses to allow a student to meet the gradua tion
616+requirements during the secondary grade years of the student.
617+G. For purposes of this section:
618+1. "Contextual methodology " means academic content and skills
619+taught by utilizing real -world problems and projects in a way that
620+helps students understand the application of that knowledge;
621+2. "Qualified agricultural education courses " means courses
622+that have been determined by the State Board of Education to offer

647-district board of education.
648-B. 1. Every policy of professional development adopted by a
649-school district board of education shall provide for t he development
650-of a focused and individualized program of professional development
651-for the teacher or adminis trator that is consistent with the
652-qualitative component of the TLE. The policy of professional
653-development shall:
654-a. establish an annual professi onal growth goal for the
655-teacher or administrator that is developed by the
656-teacher or administrator in collab oration with the
657-evaluator,
658-b. be tailored to address a specific area or criteria
659-identified through the qualitative component of the
660-TLE,
661-c. allow the teacher or administrator to actively engage
662-with learning practices that are evi dence-based,
663-researched practices that are correlated with
664-increased student achievement, and
665-d. be supported by resources that are easily available
666-and supplied by the sc hool district and the State
667-Department of Education.
668-2. School districts shall monit or compliance with each
669-individualized program of professional development implemented
650+the sets of competencies for one or more science content areas and
651+which correspond to acade mic science courses. Qualified
652+agricultural education cou rses shall include, but are not limited
653+to, horticulture, plant and soil science, natural resources and
654+environmental science, and animal science. The courses shall be
655+taught by teachers certified in agricultural education and comply
656+with all rules of the Oklahoma Department of Career and Technology
657+Education;
658+3. "Rigor" means a level of difficulty that is thorough,
659+exhaustive and accurate and is appropriate for the grade level;
660+4. "Sets of competencies" means instruction in those skills and
661+competencies that are specified in the subject matter standards
662+adopted by the State Board of Education and other skills and
663+competencies adopted by the Board, without regard to specified
664+instructional time; an d
665+5. "Unit" means a Carnegie Unit as defined by the North Central
666+Association's Commission on Schools.
667+H. 1. The State Board of Education shall adopt a plan to
668+ensure that rigor is main tained in the content, teaching
669+methodology, level of expectations f or student achievement, and
670+application of learning in all the courses taught to meet the
671+graduation requirements as specified in this section.
672+2. The State Board of Education shall allow as much flexibility
673+at the district level as is possible without di minishing the rigor

697-pursuant to an individualized program of professional development
698-shall count toward the total numbe r of points a teacher or
699-administrator is required to complete as established by a school
700-district board of education pursuant to Section 6 -194 of this title.
701-The implementation of the individualized program of professional
702-development required by this su bsection shall not be co nstrued as
703-increasing the professional development points requirements.
704-3. Individualized programs of professional development required
705-by this subsection may include but are not limited to the following
706-learning practices:
707-a. presenter-led workshops,
708-b. individual or faculty studies of books , scholarly
709-articles and video productions,
710-c. peer observations,
711-d. committee studies to address student ach ievement
712-issues,
713-e. work related to a specific subject area or areas
714-associated with obtaining an advanced de gree or
715-professional certification,
716-f. action research projects designed to improve student
717-achievement, and
701+or undermining the intent of providing these courses. To accomplish
702+this purpose, the State Department of Education shall work with
703+school districts in reviewing and a pproving courses taught by
704+districts that are not specifically liste d in subsections B and D of
705+this section. Options may inc lude, but shall not be limited to,
706+courses taken by concurrent enrollment, advanced placement, or
707+correspondence, or courses beari ng different titles.
708+3. The State Board of Education shall approve an advanced
709+placement computer science course to meet the requirements of course
710+competencies listed in paragraph 2 of subsection B of this section
711+if the course is taken in a student 's senior year and the student is
712+concurrently enrolled in or has success fully completed Algebra II.
713+4. Technology center school d istricts may offer programs
714+designed in cooperation with institutions of higher education which
715+have an emphasis on a focused fiel d of career study upon approval of
716+the State Board of Education and the independent district board of
717+education. Students in the tenth grade may be allowed to attend
718+these programs for up to one -half (1/2) of a school day and credit
719+for the units or sets of competencies required in paragraphs 2, 3,
720+and 6 of subsection B o r D of this section shall be given if the
721+courses are taught by a teacher certified in the secondary subject
722+area; provided, credit for units or sets of competencies pursuant to
723+subsection B of this section shall be approved for college admission
724+requirements.

745-associated with the development or implementation of
746-curriculum standards.
747-C. All individuals designated by the school district board of
748-education to conduct the personnel evaluations shall be required to
749-participate in training conduct ed by the State Department of
750-Education or training provided by the school district u sing
751-guidelines and materials developed by the State Departmen t of
752-Education prior to conducting evaluations.
753-D. B. The State Department of Education shall develop and
754-conduct workshops pursuant to statewide criteria which train
755-individuals in conducting evaluations.
756-E. The State Board of Education shall monitor co mpliance with
757-the provisions of this section by school districts.
758-F. The State Board of Education shall stud y continued
759-implementation of the TLE to produce a system that promotes
760-reflection and professional growth fo r teachers and leaders.
761-G. Refusal by a school district to comply with the provisions
762-of this section shall be grounds for withholding State Aid f unds
763-until compliance occurs.
764-H. Data collected pursuant to this section shall not b e subject
765-to the Oklahoma Open Meeting Act or the Oklahoma Ope n Records Act.
766-SECTION 4. AMENDATORY 70 O.S. 2021, Section 6 -101.11, is
767-amended to read as follows:
752+5. If a student enrolls in a concurrent course, the school
753+district shall not be responsible for any costs incurred for that
754+course, unless the school district does not offer enough course
755+selection during the student's secondary grade years to allow the
756+student to receive the courses needed to meet the gra duation
757+requirements of this section. If the school district does not offer
758+the necessary course selection during the student 's secondary grade
759+years, it shall be responsible for the cost of reside nt tuition at
760+an institution in The Oklahoma State System of Higher Education,
761+fees, and books for the concurrent enrollment course, and providing
762+for transportation to and from the instit ution to the school site.
763+It is the intent of the Legislature that f or students enrolled
764+in a concurrent enrollment course whi ch is paid for by the school
765+district pursuant to this paragraph, the institution charge only the
766+supplementary and special servic e fees that are directly related to
767+the concurrent enrollment course and enrollment procedures for that
768+student. It is furthe r the intent of the Legislature that fees for
769+student activities and student service facilities including the
770+student health care and cultural and recreational service fees not
771+be charged to such st udents.
772+6. Credit for the units or sets of competencies r equired in
773+subsection B or D of this section shall be given when such units or
774+sets of competencies are taken prior to ninth grade if the teachers

794-Section 6-101.11 Whenever any evaluation is made of a teacher
795-or administrator, a true copy of the evaluation shall be presented
796-to the person evaluated, who shall acknowledge the written
797-evaluation by signing the original. Within two (2) w eeks after the
798-evaluation, the pers on evaluated may respond and said response shal l
799-be made part of the re cord. Except by order of a court of c ompetent
800-jurisdiction, evaluation documents and the responses thereto shall
801-be available only to the evaluated p erson, the board of education,
802-the administrative staff making the evaluation, the board and
803-administrative staff of any school to which such ev aluated person
804-applies for employment and such other persons as are specified by
805-the teacher in writing and shal l be subject to disclosure at any
806-hearing involving a teacher or administrator 's dismissal or
807-nonrenewal from employment. Data collected pursua nt to Section 6-
808-101.10 shall be available to authorized representatives of the State
809-Department of Education and its contracting designees who must be
810-contractually bound to the Department to ma intain confidentiality o f
811-all information received from the De partment when such evaluation
812-data is used by the Department for data collection/analysis purposes
813-under the Oklahoma Teacher and Leader Effectiven ess Evaluation
814-System, and such other persons a s are specified by the t eacher in
815-writing and shall be subject to disclosure at any hearing involving
816-a teacher or administrator's dismissal or nonrenewal from
817-employment.

804+7. The Except as provided in this paragraph, three units or
805+sets of competencies in mathematics required in subsection B or D of
806+this section shall be completed in the ninth through twelfth grade s.
807+If a student completes any required courses or sets of competencies
808+in mathematics prior to ninth grade, the student may take any other
809+mathematics those courses or sets of competencies shall count toward
810+the units necessary to fulfill the requirement to complete three
811+units or sets of competencies in grades nine through twelve after
812+the student has satisfied the requirements of mathematics as
813+required in subsection B or D of this se ction.
814+8. All units or sets of competencies required for graduation
815+may be taken in any sequence recommended by the school district.
816+I. As a condition of receiving accreditation from the State
817+Board of Education, all students in grades nine through twelv e shall
818+enroll in a minimum of six periods, or the equivalent in block
819+scheduling or other scheduling structure t hat allows for instruction
820+in sets of competencies, of rigorous academic and/or rigorous
821+vocational courses each day, which may include arts, v ocal and
822+instrumental music, speech classes, and physical education cla sses.
823+J. 1. Academic and vocational -technical courses designed to
824+offer sets of competencies integrated or embedded within the course
825+that provide for the teaching and learning of the appropriate skills

867-not limited to:

854+State Board of Education, ma y upon approval of the Board, in
855+consultation with the Oklahoma Department of Career and Technology
856+Education if the courses are offered at a t echnology center school
857+district, be counted for academic credit and to ward meeting the
858+graduation requirements o f this section.
859+2. Internet-based courses offered by a technology center school
860+that are taught by a certified teacher and provide for the tea ching
861+and learning of the appropriate skills and knowledge in the subje ct
862+matter standards may, upon approval of the State Board of Education
863+and the independent district board of education, be counted for
864+academic credit and toward meeting the graduation requirements of
865+this section.
866+3. Internet-based courses or vocational -technical courses
867+utilizing integrated or embedded skills for which no subject matter
868+standards have been adopted by the State Board of Education may be
869+approved by the Board, in consul tation with the Oklahoma Department
870+of Career and Technology Education if the courses are offered at a
871+technology center school district, if such courses incorporate
872+standards of nationally recognized professional organizations and
873+are taught by certified teachers.
874+4. Courses offered by a supplemental education organization
875+that is accredited by a national accrediti ng body and that are
876+taught by a certified teacher and provide for the teaching and

902-measurable characteristics of personnel and site manage ment
903-practices that are correlated to student perfo rmance success,
904-including, but not limited to:
905-a. organizational and school management, includ ing
906-retention and development of effective teachers and
907-dismissal of ineffective teachers,
908-b. instructional leadership,
909-c. professional growth and responsibility,
910-d. interpersonal skills,
911-e. leadership skills, and
912-f. stakeholder perceptions;
913-5. An individualized program of professional development for
914-all teachers and administrators as adopted by the school distri ct
915-board of education as set forth in subsection B of Section 6-101.10
916-of this title;
904+learning of the appropriate skills and knowledge in the sub ject
905+matter standards may, upon approval of the State Board of Educatio n
906+and the school district board of educati on, be counted for academic
907+credit and toward meeting the graduation requirements of this
908+section.
909+K. The State Board of Education shall provi de an option for
910+high school graduation based upon attainment of the de sired levels
911+of competencies as required i n tests pursuant to the provisions of
912+Section 1210.508 of this title. Such option shall be in lieu of the
913+amount of course credits earned.
914+L. The State Board of Education shall prescribe, adopt and
915+approve a promotion system based on the attainment by st udents of
916+specified levels of competencies in each area of the core
917+curriculum.
918+M. Children Students who have individualized education program s
919+pursuant to the Individuals with Disabilities Education Act (IDEA) ,
920+and who satisfy the graduation requirements through the
921+individualized education program for that student shall be awarded a
922+standard diploma.
923+N. Students who enter the ninth grade in o r prior to the 2007-
924+08 school year who are enrolled in an alternative e ducation program
925+and meet the requirements of their plans leading to high school
926+graduation developed pursuant to Section 1210.568 of this title
927+shall be awarded a standard diploma.

943-6. For districts choosing to use, at their own expense,
944-quantitative measures of teachers and leaders as part of the
945-district evaluation rating, such measures shall incl ude a minimum of
946-one reliable, research -based measure as approved by the State Boar d
947-of Education pursuant to subsection D E of this section; and
948-7. 6. For all district evaluations, student performance,
949-including performance on the statewide criterion -referenced tests if
950-available, shall be discussed with the teacher and may be one of the
951-considerations for th e teacher's district evaluation rating .
952-C. Career School districts may submit a request to the State
953-Board of Education to use an alternate evaluatio n system other than
954-the system selected by the Board pursuant to subsection A of this
955-section if the school district establishes the capacity to implement
956-a research-based performance review evaluation system which meets
957-the criteria of the TLE system.
958-D. All school district certified personnel shall be evaluated
959-annually, except career teachers receiving a district evaluation
960-rating of "superior" or "highly effective" under the TLE, who may be
961-evaluated once every three (3) years as designated by loca l board of
962-education policy.
963-D. E. By December 1, 2015, the Teacher and Leader Effectiveness
964-Commission shall recommend to the State Board of Education multiple

966-evaluation component for teachers . The State Board of Education
955+O. Any student who completes the curriculum requirements of the
956+International Baccalaureate Diploma Program shall be awarded a
957+standard diploma.
958+P. Any student who successfully completes an advanced
959+mathematics or science course offered pursuant to Section 1210.404
960+of this title shall be granted academic credit toward meeting the
961+graduation requirements pursuant to paragraph 2 or 3, as
962+appropriate, of subsection B or D of this section.
963+Q. For purposes of this section, the courses approved for
964+college admission requirements shall be courses which are approved
965+by the Oklahoma State Regents for Higher Education fo r admission to
966+an institution within The Oklahoma State System of Higher Education.
967+R. Students who have been denied a standard diploma by the
968+school district in which the student is or was enrolled for failing
969+to meet the requirements of this section may re-enroll in the school
970+district that denied the student a standard diploma following the
971+denial of a standard diploma. The student shall be provide d
972+remediation or intervention and the opportunity to complete the
973+curriculum units or sets of competencies required by this section to
974+obtain a standard diploma. Students who re -enroll in the school
975+district to meet the graduation requirements of this sec tion shall
976+be exempt from the hourly instructional requirements of Sect ion 1-
977+111 of this title and the six -period enrollment requirements of this
978+section.

995-E. F. A school district with an ave rage daily attendance of
996-more than thirty-five thousand (35,000) which has incorpor ated
997-quantitative components of t he TLE into its evaluation sys tem of
998-teachers and administrators prior to the 2015 -2016 school year may
999-continue using its evaluation system , as defined by the school
1000-district's written policies, notwithstanding the provisi ons of this
1001-section and regardles s of the State Board of Educat ion's adoption of
1002-quantitative components pursuant to this section.
1003-F. G. The State Department of Education s hall provide to the
1004-Oklahoma State Regents for Higher Education and the Oklahoma
1005-Commission for Educational Quality an d Accountability timely
1006-electronic data linked to teachers and leaders derived from the TLE
1007-for purposes of providing a basis for the deve lopment of
1008-accountability and quality improvements of the teacher preparation
1009-system. The data shall be provided in a manner and at such times as
1010-agreed upon between the Department, the State Regents and the
1011-Commission.
1012-G. H. For purposes of this section , "leader" means a principal,
1013-assistant principal or any other school administrator who is
1014-responsible for supervising classroom teachers.
1015-H. I. The State Department of Education may collect school
1016-district evaluation information only as is required for f ederal
1006+S. The State Department of Education shall collect and report
1007+data by school site and district on th e number of students who
1008+enroll in the core curriculum as provided in s ubsection D of this
1009+section.
1010+SECTION 2. This act shall become effective November 1, 2023.

1045-section confidential. Records created pursuant to this section
1046-which identify, in any way, a current or former public employee
1047-shall not be subject to disclosure under the Oklahoma Open Records
1048-Act. Nothing in this subsection sh all be construed to prohibit
1049-disclosure otherwise required by this section; provided, however,
1050-any provisions requiring disclosure of TLE records shall be
1051-construed narrowly and all individually identifying information
1052-shall be removed from such records to the fullest extent possible.
1053-SECTION 6. AMENDATORY 70 O.S. 2021, Section 6 -101.23, is
1054-amended to read as follows:
1055-Section 6-101.23 A. The dismissal, suspension and
1056-nonreemployment provisions of the Teacher Due Process Act of 19 90
1057-shall not apply to:
1058-1. Substitute teachers;
1059-2. Adult education teachers; and
1060-3. Teachers who are emp loyed on temporary contracts.
1061-B. The dismissal and suspension provisions of the Teacher Due
1062-Process Act of 1990 shall apply to teachers who are emplo yed on
1063-temporary contracts f or a complete school year and to teachers who
1064-are employed in positions fully funded by federal or private
1065-categorical grants, except that such teachers shall be employed only
1066-for the duration of the temporary contract or the gr ant.

1097-funded by federal or private categorical grants, except that such
1098-teachers shall be employed only for the duration of the temporary
1099-contract or the grant.
1100-D. Teachers other than those specifically excepted in
1101-subsection A of this section who are employed on contracts sh all be
1102-afforded all substantive and procedural rights set forth in the
1103-Teacher Due Process Act of 1990 including the dismissal, suspension,
1104-and nonreemployment provisions applicable to probationary or career
1105-teachers as defined in Section 6-101.3 of this title.
1106-E. D. On and after the effective date of this act July 1, 2000,
1107-any teacher who has worked a complete school year under a temporary
1108-contract in a school district shall be granted a year of service
1109-credit toward career sta tus in that district.
1110-F. E. No teacher shall be hired on a temporary contract by a
1111-school district for mo re than four semesters or on multiple
1112-temporary contracts by a school district that together are for more
1113-than four semesters, except for a:
1114-1. Teacher hired to replace a teache r who is on an approved
1115-leave of absence and who is expected to return to empl oyment with
1116-the school district; or

1145-G. F. No teacher shall be off ered a temporary contract wi th a

1147-position is offered by the administration of the school district
1148-which sets forth the terms and conditions of the temporary contract.
1149-In the event the school district fails to provide su ch written
1150-disclosure, the teacher shall be considered as employed on a
1151-continuing contract basis.
1152-H. G. On and after the effective date of this act July 1, 2000,
1153-no teacher who is employed on a co ntinuing contract basis by a
1154-school district shall be reem ployed on a temporary contract in that
1155-school district.
1156-SECTION 7. AMENDATORY 70 O.S. 2021 , Section 6-101.24, is
1157-amended to read as follows:
1158-Section 6-101.24 A. Upon full implementation of the Oklahoma
1159-Teacher and Leader Effecti veness Evaluation System (TLE) as set
1160-forth in Section 6-101.10 of this title, when a teacher receives a
1161-rating as measured pursuant to the TLE as set forth in Section 6-
1162-101.16 of this title that may lead to a recommendat ion for the
1163-dismissal or nonreemplo yment of the teacher or when an administrator
1164-identifies poor performance or conduct that the administrator
1165-believes may lead to a recommendation for the dismissal or
1166-nonreemployment of the teacher, the administrator shal l:

1193-1. Admonish the teacher, in wri ting, and make a reasonable
1194-effort to assist the tea cher in correcting the poor performance or
1195-conduct; and
1196-2. Establish a reasonable time for improvement, not to exceed
1197-two (2) months, taking into consideration the rati ng on the
1198-evaluation or the nature and gravity of the performance or conduct.
1199-B. If the teacher does not correct the poor performance or
1200-conduct cited in the admonition within the time specified, the
1201-administrator shall may make a recommendation to the su perintendent
1202-of the school district for the dismissal or nonreemployment of the
1203-teacher.
1204-C. Whenever a member of the board of education, superintenden t,
1205-or other administrator identifies poor performance or conduct that
1206-may lead to a recommendation for di smissal or nonreemployment of a
1207-teacher within the district, the administrator who has
1208-responsibility for evaluation of the teacher shall be informed, and
1209-that administrator shall comply with the procedures set forth in
1210-this section. If the administrator fails or refuses to admonish the
1211-teacher within ten (10) days after being so informed by th e board,
1212-superintendent, or other administrator, such board, superintendent
1213-or other administrator shall admonish the teacher pursuant to the
1214-provisions of this sect ion.
1215-D. Repeated negligence in per formance of duty, willful neglect
1216-of duty, incompetency, instructional ineffectiveness or

1248-SECTION 8. AMENDATORY 70 O.S. 2021, Section 6 -101.31, is
1249-amended to read as follows:
1250-Section 6-101.31 Upon full implementation of the Oklahoma
1251-Teacher and Leader Effectiveness Ev aluation System (TLE) as set
1252-forth in Section 6-101.10 of this title, the primary basis used in
1253-determining the retention or reassignment o f affected teachers and
1254-administrators when a school district implements a reduction -in-
1255-force plan shall be the ratin gs of the teachers and administrators
1256-as measured pursuant to the TLE as set forth in Section 6-101.16 of
1257-this title.
1258-SECTION 9. This act shall become effective July 1, 2023.
1259-SECTION 10. It being immediately necessary for t he preservation
1260-of the public peace, h ealth or safety, an emergency is hereby
1261-declared to exist, by reason whereof thi s act shall take effect a nd
1262-be in full force from and after its passage and approval.
