58	58	BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA:
59	59	SECTION 1. NEW LAW A new section of law to be codified
60	60	in the Oklahoma Statutes as Section 2608 of Title 63, unless there
61	61	is created a duplication in numbering, reads as follows:
62	62	As used in this act:
63	63	1. "Child" means an individual who is younger than eighteen
64	64	(18) years of age;
65	65	2. "Health care provider " means a person other than a physician
66	66	who is licensed, certified, or otherwise aut horized by this state's

94	94	prescription drug in the ordinary course of bu siness or practice of
95	95	a profession; and
96	96	3. "Physician" means a person licensed to practi ce medicine in
97	97	this state.
98	98	SECTION 2. NEW LAW A new section of law to be codifi ed
99	99	in the Oklahoma Statutes as Section 2608.1 of Title 63, unless there
100	100	is created a duplication in numbering, reads as follows:
101	101	A. Prohibited provision of gender transitioning or g ender
102	102	reassignment procedures and treatments to certain children. For the
103	103	purpose of transitioning a child's biological sex as determined by
104	104	the sex organs, chromosomes, and endogenous profiles of t he child or
105	105	affirming the child's perception of the child 's sex if that
106	106	perception is inconsistent with the child 's biological sex, a
107	107	physician or health care provider may not:
108	108	1. Perform a surgery that sterilizes that child, including:
109	109	a. castration,
110	110	b. hysterectomy,
111	111	c. metoidioplasty,
112	112	d. oophorectomy,
113	113	e. orchiectomy,
114	114	f. penectomy,
115	115	g. phalloplasty,
116	116	h. vaginoplasty, and

144	144	2. Perform a mastectomy;
145	145	3. Prescribe, administer, or supply any of the following
146	146	medications that induce transient or permanent infertility:
147	147	a. puberty-blocking medication to stop or delay normal
148	148	puberty,
149	149	b. supraphysiologic doses of t estosterone to females ,
150	150	c. supraphysiologic doses of estrogen to males ; or
151	151	4. Remove any otherwise healthy or non-diseased body part or
152	152	tissue.
153	153	SECTION 3. NEW LAW A new section of law to be codified
154	154	in the Oklahoma Statutes as Se ction 2608.2 of Title 63, unless there
155	155	is created a duplication in numbering, reads as follows:
156	156	A. Section 2 of this act does not apply to the provisions by a
157	157	physician or health care provider, with the consent of the child's
158	158	parent or legal guardian , of appropriate and medi cally necessary
159	159	gender transitioning or gender reassignment procedures or treatments
160	160	to a child who:
161	161	1. Is born with a medically verifiable genetic disorder of sex
162	162	development, including:
163	163	a. 46,XX chromosomes with virilization ,
164	164	b. 46,XY chromosomes with undervirilization, or
165	165	c. both ovarian and testicular tissue; or

194	194	SECTION 4. NEW LAW A new section of law to be codified
195	195	in the Oklahoma Statutes as Section 2608.3 of Title 63, unless there
196	196	is created a duplication in numbering, reads as follows:
197	197	The Oklahoma Board of Medical Licensure and Supervision or
198	198	another state regulatory a gency with jurisdiction over a health care
199	199	provider subject to Section 2608.1 of this act shall revoke the
200	200	license, certification, or authorization of a physician or health
201	201	care provider who the board or agency determines has violated that
202	202	section.
203	203	SECTION 5. NEW LAW A new section of law to be codified
204	204	in the Oklahoma Statutes as Section 2608.4 of Title 63, unless there
205	205	is created a duplication in numbering, reads as f ollows:
206	206	A professional liability insurance policy issued to a physician
207	207	or health care provider may not include cov erage for damages
208	208	assessed against the physician or health ca re provider who provides
209	209	to a child gender transitioning or ge nder reassignment procedures or
210	210	treatments that are prohibited by Section 2 of this act.
211	211	SECTION 6. NEW LAW A new section of law to be codified
212	212	in the Oklahoma Statutes as Section 2608.5 of Title 63, unless there
213	213	is created a duplication in num bering, reads as follows :
214	214	A court may revoke the license, certification , or authorization
215	215	of any person holding a state -issued professional license upon a

242	242	finding, by the court, that a person knowingly engaged in conduct
243	243	that aided or abetted the performa nce or inducement of the gender
244	244	transition or gender reassignment procedure in violation of this
245	245	act.
246	246	SECTION 7. NEW LAW A new section of law to be codified
247	247	in the Oklahoma Statutes as Section 2608.6 of Title 63, unless there
248	248	is created a duplication in num bering, reads as follows:
249	249	A. Notwithstanding any other law, the re quirements of this act
250	250	shall be enforced exclusively through a private civil action .
251	251	B. Any person, other than the state, its political
252	252	subdivisions, and any office r or employee of a state or local
253	253	governmental entity in this state, may bring a civil act ion against
254	254	any person or entity who:
255	255	1. Performs or induces the gender transitioning or gender
256	256	reassignment procedure in violation of this act; or
257	257	2. Knowingly engages in conduct that a ids or abets the
258	258	performance or inducement of the gender transitionin g or gender
259	259	reassignment procedure in violation of this act .
260	260	C. If a claimant prevails in an action brought under this
261	261	section, the court shall award:
262	262	1. Injunctive relief sufficient to p revent the defendant from
263	263	violating this act or engaging in acts that aid or abet violation of
264	264	this act;

291	291	2. Statutory damages in an amount of not less than Five Hundred
292	292	Thousand Dollars ($500,000.00) for each gender transitioning or
293	293	gender reassignment pr ocedure that the defendant performed or
294	294	induced in violation of this act, and for each gender tra nsitioning
295	295	or gender reassignment procedure performed or induced in violation
296	296	of this act that the defendant aided or abetted.
297	297	3. Nominal and compensatory damages if the claimant has
298	298	suffered harm from the defendan t's conduct including, but not
299	299	limited to, loss of consortium and emotional distress; and
300	300	4. Court costs and attorney fees.
301	301	D. Notwithstanding any other law, a person may bring an a ction
302	302	for a violation of this act no later than twenty (2 0) years after
303	303	the day the cause of action accrues.
304	304	E. A person under eighteen (18) years of age may bring an
305	305	action throughout his or her minority through a parent or next
306	306	friend, and may bring an action in their own name upon reaching
307	307	majority at any time from that point until twenty -five (25) years
308	308	after reaching the age of majority.
309	309	SECTION 8. This act shall become effective November 1, 2023.
