5858 BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. NEW LAW A new section of law to be codified
6060 in the Oklahoma Statutes as Section 2608 of Title 63, unless there
6161 is created a duplication in numbering, reads as follows:
6262 As used in this act:
6363 1. "Child" means an individual who is younger than eighteen
6464 (18) years of age;
6565 2. "Health care provider " means a person other than a physician
6666 who is licensed, certified, or otherwise aut horized by this state's

9393 laws to provide or render health care or to d ispense or proscribe a
9494 prescription drug in the ordinary course of bu siness or practice of
9595 a profession; and
9696 3. "Physician" means a person licensed to practi ce medicine in
9797 this state.
9898 SECTION 2. NEW LAW A new section of law to be codifi ed
9999 in the Oklahoma Statutes as Section 2608.1 of Title 63, unless there
100100 is created a duplication in numbering, reads as follows:
101101 A. Prohibited provision of gender transitioning or g ender
102102 reassignment procedures and treatments to certain children. For the
103103 purpose of transitioning a child's biological sex as determined by
104104 the sex organs, chromosomes, and endogenous profiles of t he child or
105105 affirming the child's perception of the child 's sex if that
106106 perception is inconsistent with the child 's biological sex, a
107107 physician or health care provider may not:
108108 1. Perform a surgery that sterilizes that child, including:
109109 a. castration,
110110 b. hysterectomy,
111111 c. metoidioplasty,
112112 d. oophorectomy,
113113 e. orchiectomy,
114114 f. penectomy,
115115 g. phalloplasty,
116116 h. vaginoplasty, and

144144 2. Perform a mastectomy;
145145 3. Prescribe, administer, or supply any of the following
146146 medications that induce transient or permanent infertility:
147147 a. puberty-blocking medication to stop or delay normal
148148 puberty,
149149 b. supraphysiologic doses of t estosterone to females ,
150150 c. supraphysiologic doses of estrogen to males ; or
151151 4. Remove any otherwise healthy or non-diseased body part or
152152 tissue.
153153 SECTION 3. NEW LAW A new section of law to be codified
154154 in the Oklahoma Statutes as Se ction 2608.2 of Title 63, unless there
155155 is created a duplication in numbering, reads as follows:
156156 A. Section 2 of this act does not apply to the provisions by a
157157 physician or health care provider, with the consent of the child's
158158 parent or legal guardian , of appropriate and medi cally necessary
159159 gender transitioning or gender reassignment procedures or treatments
160160 to a child who:
161161 1. Is born with a medically verifiable genetic disorder of sex
162162 development, including:
163163 a. 46,XX chromosomes with virilization ,
164164 b. 46,XY chromosomes with undervirilization, or
165165 c. both ovarian and testicular tissue; or

192192 2. Does not have the normal sex chromosome structure for male
193193 or female as determined by a phys ician through genetic testing.
194194 SECTION 4. NEW LAW A new section of law to be codified
195195 in the Oklahoma Statutes as Section 2608.3 of Title 63, unless there
196196 is created a duplication in numbering, reads as follows:
197197 The Oklahoma Board of Medical Licensure and Supervision or
198198 another state regulatory a gency with jurisdiction over a health care
199199 provider subject to Section 2608.1 of this act shall revoke the
200200 license, certification, or authorization of a physician or health
201201 care provider who the board or agency determines has violated that
202202 section.
203203 SECTION 5. NEW LAW A new section of law to be codified
204204 in the Oklahoma Statutes as Section 2608.4 of Title 63, unless there
205205 is created a duplication in numbering, reads as f ollows:
206206 A professional liability insurance policy issued to a physician
207207 or health care provider may not include cov erage for damages
208208 assessed against the physician or health ca re provider who provides
209209 to a child gender transitioning or ge nder reassignment procedures or
210210 treatments that are prohibited by Section 2 of this act.
211211 SECTION 6. NEW LAW A new section of law to be codified
212212 in the Oklahoma Statutes as Section 2608.5 of Title 63, unless there
213213 is created a duplication in num bering, reads as follows :
214214 A court may revoke the license, certification , or authorization
215215 of any person holding a state -issued professional license upon a

242242 finding, by the court, that a person knowingly engaged in conduct
243243 that aided or abetted the performa nce or inducement of the gender
244244 transition or gender reassignment procedure in violation of this
245245 act.
246246 SECTION 7. NEW LAW A new section of law to be codified
247247 in the Oklahoma Statutes as Section 2608.6 of Title 63, unless there
248248 is created a duplication in num bering, reads as follows:
249249 A. Notwithstanding any other law, the re quirements of this act
250250 shall be enforced exclusively through a private civil action .
251251 B. Any person, other than the state, its political
252252 subdivisions, and any office r or employee of a state or local
253253 governmental entity in this state, may bring a civil act ion against
254254 any person or entity who:
255255 1. Performs or induces the gender transitioning or gender
256256 reassignment procedure in violation of this act; or
257257 2. Knowingly engages in conduct that a ids or abets the
258258 performance or inducement of the gender transitionin g or gender
259259 reassignment procedure in violation of this act .
260260 C. If a claimant prevails in an action brought under this
261261 section, the court shall award:
262262 1. Injunctive relief sufficient to p revent the defendant from
263263 violating this act or engaging in acts that aid or abet violation of
264264 this act;

291291 2. Statutory damages in an amount of not less than Five Hundred
292292 Thousand Dollars ($500,000.00) for each gender transitioning or
293293 gender reassignment pr ocedure that the defendant performed or
294294 induced in violation of this act, and for each gender tra nsitioning
295295 or gender reassignment procedure performed or induced in violation
296296 of this act that the defendant aided or abetted.
297297 3. Nominal and compensatory damages if the claimant has
298298 suffered harm from the defendan t's conduct including, but not
299299 limited to, loss of consortium and emotional distress; and
300300 4. Court costs and attorney fees.
301301 D. Notwithstanding any other law, a person may bring an a ction
302302 for a violation of this act no later than twenty (2 0) years after
303303 the day the cause of action accrues.
304304 E. A person under eighteen (18) years of age may bring an
305305 action throughout his or her minority through a parent or next
306306 friend, and may bring an action in their own name upon reaching
307307 majority at any time from that point until twenty -five (25) years
308308 after reaching the age of majority.
309309 SECTION 8. This act shall become effective November 1, 2023.
