4040 An Act relating to schools; defining terms; requiring

4444 providing eligibility criteria for participation;
4545 requiring compliance with academic standards;
4646 providing for agreed-upon method for evaluation of
4747 compliance; amending 70 O.S. 2021, Section 27 -103,
4848 which relates to the Oklahoma Extracurricu lar
4949 Activities Accountability Act; requiring policy to

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. NEW LAW A new section of law to be codified
6060 in the Oklahoma Statutes as Section 8-201 of Title 70, unless there
6161 is created a duplication in numbering, reads as follows:
6262 A. As used in this section:
6363 1. "Resident district" means the public school district in
6464 which a student resides as defined in Section 1 -113 of Title 70 of
6565 the Oklahoma Statutes;

9292 2. "School athletic association " shall have the same meaning as
9393 defined in Section 27-102 of Title 70 of the O klahoma Statutes; and
9494 3. "Students who are educated by other means " means students
9595 who are educated pursuant to the other means of education exception
9696 provided for in subsectio n A of Section 10-105 of Title 70 of the
9797 Oklahoma Statutes.
9898 B. Beginning with the 2023 -2024 school year, each school
9999 district board of education shall adopt a policy allowing students
100100 who are educated by other means to participate in extracurricu lar
101101 activities offered by the student's resident district. The policy
102102 shall be published in the school distric t student handbook and
103103 posted on the school distri ct website.
104104 C. In order to participate in extracurricu lar activities
105105 pursuant to this section, students who are educated by other means
106106 shall:
107107 1. Register an intention to participate with the board of
108108 education of the resident distric t by the July 1 immediately
109109 preceding the school year in whic h participation is intended;
110110 2. Pay any participation or acti vity fee in an amount equal to
111111 any fee charged to a resident district participant;
112112 3. Adhere to the same standards of behavior, responsi bility,
113113 performance, and code of conduct as other partici pants of the
114114 resident district;

141141 4. Adhere to any rules and po licies of a school athletic
142142 association which provides the coordination, supervision , and
143143 regulation of the extracurricular activities and contests of
144144 schools;
145145 5. Adhere to any physical exams o r drug testing provisions
146146 required by the board of education o f the resident district or the
147147 school athletic association which provides the coordination,
148148 supervision, and regulation of the extracurricular activities and
149149 contests of schools; and
150150 6. Adhere to the same academic standards as other partic ipants
151151 of the resident district pursuant to the provi sions of subsection D
152152 of this section.
153153 D. During the time period a student who is educated by other
154154 means participates in extracurricular activities pursuan t to the
155155 provisions of this section, the student shall meet academic
156156 standards by a method o f evaluation agreed upon by the parent or
157157 legal guardian of the student and the superin tendent of the resident
158158 district. The method of evaluati on may include a review of the
159159 student's work by a certified t eacher employed by th e resident
160160 district, the student's performance on a nationally recognized
161161 standardized test, or evaluation of grades earned through
162162 correspondence courses.
163163 SECTION 2. AMENDATORY 70 O.S. 2021, Section 27 -103, is

191191 Section 27-103. A public school or school district shall not be
192192 a member of any school athletic association unless that association
193193 has adopted a written policy th at requires the following:
194194 1. All records of the a ssociation to be made accessible
195195 consistent with the provisions of t he Oklahoma Open Records Act;
196196 2. All meetings of the association to be open and conducted in
197197 a manner consistent with the provisions of the Oklahoma Open Meeting
198198 Act, including specifical ly the notice and agenda, voting and
199199 executive session requirements; and
200200 3. An annual financial audit and a compliance audit of all
201201 funds of the association in accordance with the auditing standards
202202 set forth in the Oklahoma Public School Audit Law. In a ddition, the
203203 association shall have performance audits conducted of the
204204 operations of the association. A performance audit shall be
205205 conducted no later than December 31, 2014, and by December 31 every
206206 five (5) years thereafter ; and
207207 4. A student who is educated pursuant to the other mean s
208208 exception provided for in subsection A of Section 10-105 of this
209209 title may participate in interscho lastic activities or contests
210210 offered by the student's resident district as defined in Section 1 -
211211 113 of this title. Student participation shall be subject to the
212212 provisions of Section 1 of this act.
213213 SECTION 3. This act shall become effective July 1, 2023.

240240 SECTION 4. It being immediately necessary for the preservation
241241 of the public peace, healt h or safety, an emergency is he reby
242242 declared to exist, by reason wh ereof this act shall take effect and
243243 be in full force from and after its passage and approval.
