58	58	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
59	59	SECTION 1. NEW LAW A new section of law to be codified
60	60	in the Oklahoma Statutes as Section 8-201 of Title 70, unless there
61	61	is created a duplication in numbering, reads as follows:
62	62	A. As used in this section:
63	63	1. "Resident district" means the public school district in
64	64	which a student resides as defined in Section 1 -113 of Title 70 of
65	65	the Oklahoma Statutes;

92	92	2. "School athletic association " shall have the same meaning as
93	93	defined in Section 27-102 of Title 70 of the O klahoma Statutes; and
94	94	3. "Students who are educated by other means " means students
95	95	who are educated pursuant to the other means of education exception
96	96	provided for in subsectio n A of Section 10-105 of Title 70 of the
97	97	Oklahoma Statutes.
98	98	B. Beginning with the 2023 -2024 school year, each school
99	99	district board of education shall adopt a policy allowing students
100	100	who are educated by other means to participate in extracurricu lar
101	101	activities offered by the student's resident district. The policy
102	102	shall be published in the school distric t student handbook and
103	103	posted on the school distri ct website.
104	104	C. In order to participate in extracurricu lar activities
105	105	pursuant to this section, students who are educated by other means
106	106	shall:
107	107	1. Register an intention to participate with the board of
108	108	education of the resident distric t by the July 1 immediately
109	109	preceding the school year in whic h participation is intended;
110	110	2. Pay any participation or acti vity fee in an amount equal to
111	111	any fee charged to a resident district participant;
112	112	3. Adhere to the same standards of behavior, responsi bility,
113	113	performance, and code of conduct as other partici pants of the
114	114	resident district;

141	141	4. Adhere to any rules and po licies of a school athletic
142	142	association which provides the coordination, supervision , and
143	143	regulation of the extracurricular activities and contests of
144	144	schools;
145	145	5. Adhere to any physical exams o r drug testing provisions
146	146	required by the board of education o f the resident district or the
147	147	school athletic association which provides the coordination,
148	148	supervision, and regulation of the extracurricular activities and
149	149	contests of schools; and
150	150	6. Adhere to the same academic standards as other partic ipants
151	151	of the resident district pursuant to the provi sions of subsection D
152	152	of this section.
153	153	D. During the time period a student who is educated by other
154	154	means participates in extracurricular activities pursuan t to the
155	155	provisions of this section, the student shall meet academic
156	156	standards by a method o f evaluation agreed upon by the parent or
157	157	legal guardian of the student and the superin tendent of the resident
158	158	district. The method of evaluati on may include a review of the
159	159	student's work by a certified t eacher employed by th e resident
160	160	district, the student's performance on a nationally recognized
161	161	standardized test, or evaluation of grades earned through
162	162	correspondence courses.
163	163	SECTION 2. AMENDATORY 70 O.S. 2021, Section 27 -103, is
164	164	amended to read as follows:

191	191	Section 27-103. A public school or school district shall not be
192	192	a member of any school athletic association unless that association
193	193	has adopted a written policy th at requires the following:
194	194	1. All records of the a ssociation to be made accessible
195	195	consistent with the provisions of t he Oklahoma Open Records Act;
196	196	2. All meetings of the association to be open and conducted in
197	197	a manner consistent with the provisions of the Oklahoma Open Meeting
198	198	Act, including specifical ly the notice and agenda, voting and
199	199	executive session requirements; and
200	200	3. An annual financial audit and a compliance audit of all
201	201	funds of the association in accordance with the auditing standards
202	202	set forth in the Oklahoma Public School Audit Law. In a ddition, the
203	203	association shall have performance audits conducted of the
204	204	operations of the association. A performance audit shall be
205	205	conducted no later than December 31, 2014, and by December 31 every
206	206	five (5) years thereafter ; and
207	207	4. A student who is educated pursuant to the other mean s
208	208	exception provided for in subsection A of Section 10-105 of this
209	209	title may participate in interscho lastic activities or contests
210	210	offered by the student's resident district as defined in Section 1 -
211	211	113 of this title. Student participation shall be subject to the
212	212	provisions of Section 1 of this act.
213	213	SECTION 3. This act shall become effective July 1, 2023.
