50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
52	52	amended to read as follows:
53	53	Section 11-105.1 A. All curriculum and materials including
54	54	supplementary materials which will be used to teach or will be used
55	55	for or in connection with Public schools shall not provide a sex
56	56	education class or, program which is designed for the exclusive
57	57	purpose of discussing sexual behavior or attitudes, or any , test,
58	58	survey, or questionnaire whose primary purpose is to elicit
59	59	responses on sexual behavior or attitudes shall be available through
60	60	the superintendent or a designee of the school district for
61	61	inspection by parents and guardians of the student who will be
62	62	involved with the class, program or test, survey or questionnaire.

89	89	Such curriculum, materials, classes, programs, tests, surveys or
90	90	questionnaires shall inc lude information about consent and shall
91	91	have as one of its primary purposes the teaching of or informing
92	92	students about the practice of abstinence. For the purposes of this
93	93	section, "consent" shall have the same meaning as that provided by
94	94	Section 113 of Title 21 of the Oklahoma Statutes. The
95	95	superintendent or a designee of the school district shall provide
96	96	prior written notification to the parents or guardians of the
97	97	students involved of their right to inspect the curriculum and
98	98	material and of their ob ligation to notify the school in writing if
99	99	they do not want their child to participate in the class, program,
100	100	test, survey or questionnaire. Each local board of education shall
101	101	determine the means of providing written notification to the parents
102	102	and guardian which will ensure effective notice in an efficient and
103	103	appropriate manner. No student shall be required to participate in
104	104	a sex education class or program which discusses sexual behavior or
105	105	attitudes if a parent or guardian of the student objects in writing
106	106	to such participation. If the type of program referred to in this
107	107	section is a part of or is taught during a credit course, a student
108	108	may be required to enroll in the course but shall not be required to
109	109	receive instruction in or participate in the program if a parent or
110	110	guardian objects in writing.
111	111	B. The superintendent or a designee of a school district in
112	112	which sex education is taught or a program is offered which is

139	139	designed for the exclusive purpose of discussing sexual behavior or
140	140	attitudes shall approve all curriculum and materials which will be
141	141	used for such education and any test, survey or questionnaire whose
142	142	primary purpose is to elicit responses on sexual behavior or
143	143	attitudes used in the school prior to their use in the classroom or
144	144	school. The teacher involved in the class, program, testing or
145	145	survey shall submit the curriculum, materials, tests or surveys to
146	146	the superintendent or a designee for approval prior to their use in
147	147	the classroom or school. This section shall not apply to th ose
148	148	students enrolled in classes, programs, testings or surveys offered
149	149	through an alternative education program .
150	150	SECTION 2. This act shall become effective November 1, 2023.
