5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 70 O.S. 2021, Section 11 -105.1, is
5252 amended to read as follows:
5353 Section 11-105.1 A. All curriculum and materials including
5454 supplementary materials which will be used to teach or will be used
5555 for or in connection with Public schools shall not provide a sex
5656 education class or, program which is designed for the exclusive
5757 purpose of discussing sexual behavior or attitudes, or any , test,
5858 survey, or questionnaire whose primary purpose is to elicit
5959 responses on sexual behavior or attitudes shall be available through
6060 the superintendent or a designee of the school district for
6161 inspection by parents and guardians of the student who will be
6262 involved with the class, program or test, survey or questionnaire.

8989 Such curriculum, materials, classes, programs, tests, surveys or
9090 questionnaires shall inc lude information about consent and shall
9191 have as one of its primary purposes the teaching of or informing
9292 students about the practice of abstinence. For the purposes of this
9393 section, "consent" shall have the same meaning as that provided by
9494 Section 113 of Title 21 of the Oklahoma Statutes. The
9595 superintendent or a designee of the school district shall provide
9696 prior written notification to the parents or guardians of the
9797 students involved of their right to inspect the curriculum and
9898 material and of their ob ligation to notify the school in writing if
9999 they do not want their child to participate in the class, program,
100100 test, survey or questionnaire. Each local board of education shall
101101 determine the means of providing written notification to the parents
102102 and guardian which will ensure effective notice in an efficient and
103103 appropriate manner. No student shall be required to participate in
104104 a sex education class or program which discusses sexual behavior or
105105 attitudes if a parent or guardian of the student objects in writing
106106 to such participation. If the type of program referred to in this
107107 section is a part of or is taught during a credit course, a student
108108 may be required to enroll in the course but shall not be required to
109109 receive instruction in or participate in the program if a parent or
110110 guardian objects in writing.
111111 B. The superintendent or a designee of a school district in
112112 which sex education is taught or a program is offered which is

139139 designed for the exclusive purpose of discussing sexual behavior or
140140 attitudes shall approve all curriculum and materials which will be
141141 used for such education and any test, survey or questionnaire whose
142142 primary purpose is to elicit responses on sexual behavior or
143143 attitudes used in the school prior to their use in the classroom or
144144 school. The teacher involved in the class, program, testing or
145145 survey shall submit the curriculum, materials, tests or surveys to
146146 the superintendent or a designee for approval prior to their use in
147147 the classroom or school. This section shall not apply to th ose
148148 students enrolled in classes, programs, testings or surveys offered
149149 through an alternative education program .
150150 SECTION 2. This act shall become effective November 1, 2023.
