1414 An Act relating to the Information Technology
1515 Consolidation and Coordination Act; amending 62 O.S.
1616 2021, Section 35.7, which relates to exemptions and
1717 extensions; providing exemption for cert ain state
1818 agencies if certain condition is met; and providing

2424 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
2525 SECTION 1. AMENDATORY 62 O.S. 2021, Section 35.7, is
2626 amended to read as follows:
2727 Section 35.7 A. A state agency may apply to the Chief
2828 Information Officer for an exemption from any provisions of the
2929 Information Technology Consolidation a nd Coordination Act or for an
3030 extension of any deadline specifi ed in the Information Technology
3131 Consolidation and Coordination Act, if it determines that compliance
3232 with the provisions of the Information Technology Con solidation and
3333 Coordination Act would:
3434 1. Cause it to be in viol ation of federal law or regulatio ns or
3535 in violation of any provision of the Oklahoma Constitution or
3636 Statutes; Req. No. 6582 Page 2
3737 2. Result in a loss of federal funds to th e state; or
3838 3. Create an impediment to the performance of a unique agency
3939 function that is not duplic ated by another state agency and is
4040 required by the Oklahoma Statute s or Constitution or by federal law.
4141 B. Any state agency applying for an exemption or extension
4242 pursuant to this section shall provide written documentation of the
4343 circumstances to the Ch ief Information Officer. After r eviewing the
4444 documentation, the Chi ef Information Officer shall grant or den y the
4545 application. If the state agency dispu tes the decision of the Chief
4646 Information Officer, the Director of the Office of Management and
4747 Enterprise Services shall make the fina l determination as to whether
4848 the exemption or extension will be granted.
4949 C. The following agencies shall be exempt from the application
5050 provisions of subsections A and B of this section and the provisions
5151 of the Information Technology Consolidation and C oordination Act;
5252 provided, that the agency can demonstrate to the Chief Info rmation
5353 Officer that cost savings can be achieved:
5454 1. The Alcoholic Beverage Laws Enforcement Commission ;
5555 2. The Department of Corrections ;
5656 3. The Oklahoma State Bureau of Inves tigation;
5757 4. The Council on Law En forcement Education and Training;
5858 5. The Board of Medicolegal Investigations;
5959 6. The Oklahoma State Bureau of Narcotics and Dangerous Drugs

6161 7. The Department of Public Safety ;
6262 8. The Office of the Attorney G eneral;
6363 9. The District Attorneys Council;
6464 10. The Oklahoma Indigent Defen se System; and
6565 11. The Pardon and Parole Board .
6666 SECTION 2. This act shall become effective November 1, 2023.
