4040 An Act relating to schools; amending 70 O.S. 2021,

4646 penalty for certain noncompliance; providing for

4949 education; providing an effective date ; and declaring

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. AMENDATORY 70 O.S. 2021, Section 11-105.1, is
5858 amended to read as follows:
5959 Section 11-105.1 A. All curriculum and materials including
6060 supplementary materials which will be used to teach or will be use d
6161 for or in connection with a sex education class or program which is
6262 designed for the exclusive purpose of discussing sexual behavior or
6363 attitudes, or any test, survey , or questionnaire whose primary
6464 purpose is to elicit responses on sexual behavior or at titudes shall

9595 1. Such The curriculum, materials, classes, programs, tests,
9696 surveys, or questionnaires shall include i nformation about consent
9797 and shall have as one of its primary purposes the teaching of or
9898 informing students about the practice of abstinence. For the
9999 purposes of this section,
100100 a. "abstinence" shall mean no pre-marital sexual contact,
101101 sexual intimacy, or sexual activity of any kind,
102102 including restraint from any intimate touches or
103103 genital contact, and
104104 b. "consent" shall have the same meaning as that provided
105105 by Section 113 of Title 21 of the Oklahoma Statutes.
106106 2. The superintendent or a designee of the sc hool district
107107 shall provide prior written notification to the parents or guardians
108108 of the students involved of their right to inspect the curriculum
109109 and material and of their obligation to notify the school in writing
110110 if they do not want their child to par ticipate in the class,
111111 program, test, survey , or questionnaire. Each local board of
112112 education shall determine the means of providing written
113113 notification to the parents and g uardian which will ens ure effective
114114 notice in an efficient and appropriate manner . No student shall be
115115 required to participate in a sex education class or program which

142142 discusses sexual behavior or attitudes if unless a parent or
143143 guardian of the student objects agrees in writing to such
144144 participation. If the type of program referred to in this section
145145 is a part of or is taught during a credit course, a student may be
146146 required to enroll in the course but shall not be required to
147147 receive instruction in or p articipate in the program if unless a
148148 parent or guardian objects agrees in writing.
149149 B. The superintendent or a designee of a school district in
150150 which sex education is taught or a program is offered which is
151151 designed for the exclusive purpose of discussing sexual behavior or
152152 attitudes shall approve all cu rriculum and materials which wi ll be
153153 used for such education and any test, survey , or questionnaire whose
154154 primary purpose is to elicit responses on sexual behavior or
155155 attitudes used in the school prior to t heir use in the classroom or
156156 school. The teacher i nvolved in the class, program, testing, or
157157 survey shall submit the curriculum, materials, tests , or surveys to
158158 the superintendent or a designee for approval prior to their use in
159159 the classroom or school.
160160 C. This section shall not apply to those students enroll ed in
161161 classes, programs, testings, or surveys offered through an
162162 alternative education program.
163163 D. Upon a finding of noncompliance with the provisions of
164164 subsection A of this section by the State Boa rd of Education, the
165165 noncompliant school district or public charter school shall receive

192192 a five percent (5%) decrease in state funding for the school
193193 district or public charter school for the fiscal year following the
194194 year of noncompliance.
195195 E. The State Board of Education may promulgate rules in
196196 accordance with the provisions of this section.
197197 SECTION 2. REPEALER 70 O.S. 2021, Section 11-103.3, is
198198 hereby repealed.
199199 SECTION 3. This act shall become effective July 1, 2023.
200200 SECTION 4. It being immediately necessary for the preservati on
201201 of the public peace, health or safety, an emergency is hereby
202202 declared to exist, by reason whereof thi s act shall take effect and
203203 be in full force from and after its passage and approval.
