1443 An Act relating to counties and county officers;
1544 amending 21 O.S. 2021, Section 650.6, which relates
1645 to assault and battery of court officers, witnesses,
1746 jurors, or process servers; expanding penalties to
1847 assault upon county commiss ioners, county clerks,
1948 county assessors, and county treasurers; expanding
2049 penalties to battery or assault and battery upon
2150 county commissioners , county clerks, county
2251 assessors, and county treasurers; and declaring an

3057 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3258 SECTION 1. AMENDATORY 21 O.S. 2021, Section 650.6, is
3359 amended to read as follow s:

3560 Section 650.6 A. Every person who commits any assault upon any
3661 county commissioner, county clerk, county assessor, county
3762 treasurer, or any officer of a state district or appellate co urt, or
3863 the Workers' Compensation Court, including but not limited t o
3964 judges, bailiffs, court reporters, court clerks or deputy court
4065 clerks, or upon any witnesses or juror, because of said person's
4166 service in such capacity or within six (6) months of said person's

4496 (1) year, by a fine not to exceed One Thousan d Dollars ($1,000.00),

4798 B. Every person who commits any battery or assault and battery
4899 upon any county commissioner, county clerk, county assessor, county
49100 treasurer, or officer of a state district or appellate court, or the
50101 Workers' Compensation Court, including but not limited to judges,
51102 bailiffs, court reporters, court clerks o r deputy court clerks, or
52103 upon any witnesses or juror, because of said person's service in
53104 such capacity or within six (6) months of said pers on's service in
54105 such capacity, shall be guilty of a felony punishable by
55106 imprisonment in the custody of the Depart ment of Corrections for not
56107 more than five (5) years, by a fine of not more than Five Thousand
57108 Dollars ($5,000.00), or by both such imprisonme nt and fine.

59109 C. Every person who knowingly commits any assault, battery or
60110 assault and battery upon a process ser ver licensed in this state
61111 while the person is in the performance of his or her duties shall,
62112 upon conviction, be guilty of a misdemeanor puni shable by
63113 imprisonment in the county jail for not more than one (1) year, by a
64114 fine not to exceed One Thousand Dol lars ($1,000.00), or by both such
65115 imprisonment and fine.

67116 SECTION 2. It being immediately necessary for the preservation
68117 of the public peace, health or safety, an emergency is hereby
