16	45		to assault and battery of court officers, witnesses,
17	46		jurors, or process servers; expanding penalties to
18	47		assault upon county commiss ioners, county clerks,
19	48		county assessors, and county treasurers; expanding
20	49		penalties to battery or assault and battery upon
21	50		county commissioners , county clerks, county
22	51		assessors, and county treasurers; and declaring an
23	52		emergency.

30	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32	58		SECTION 1. AMENDATORY 21 O.S. 2021, Section 650.6, is
33	59		amended to read as follow s:

35	60		Section 650.6 A. Every person who commits any assault upon any
36	61		county commissioner, county clerk, county assessor, county
37	62		treasurer, or any officer of a state district or appellate co urt, or
38	63		the Workers' Compensation Court, including but not limited t o
39	64		judges, bailiffs, court reporters, court clerks or deputy court
40	65		clerks, or upon any witnesses or juror, because of said person's
41	66		service in such capacity or within six (6) months of said person's

42	94		service in such capacity, shal l be guilty of a misdemeanor
43	95		punishable by imprisonment in the county jail for not more than one
44	96		(1) year, by a fine not to exceed One Thousan d Dollars ($1,000.00),
45	97		or by both such imprisonment and fine.

47	98		B. Every person who commits any battery or assault and battery
48	99		upon any county commissioner, county clerk, county assessor, county
49	100		treasurer, or officer of a state district or appellate court, or the
50	101		Workers' Compensation Court, including but not limited to judges,
51	102		bailiffs, court reporters, court clerks o r deputy court clerks, or
52	103		upon any witnesses or juror, because of said person's service in
53	104		such capacity or within six (6) months of said pers on's service in
54	105		such capacity, shall be guilty of a felony punishable by
55	106		imprisonment in the custody of the Depart ment of Corrections for not
56	107		more than five (5) years, by a fine of not more than Five Thousand
57	108		Dollars ($5,000.00), or by both such imprisonme nt and fine.

59	109		C. Every person who knowingly commits any assault, battery or
60	110		assault and battery upon a process ser ver licensed in this state
61	111		while the person is in the performance of his or her duties shall,
62	112		upon conviction, be guilty of a misdemeanor puni shable by
63	113		imprisonment in the county jail for not more than one (1) year, by a
64	114		fine not to exceed One Thousand Dol lars ($1,000.00), or by both such
65	115		imprisonment and fine.

67	116		SECTION 2. It being immediately necessary for the preservation
68	117		of the public peace, health or safety, an emergency is hereby
