44	44	providing an exception ; mandating Senate confirmation
45	45	for certain appointments ; deleting provision that
46	46	members serve at the p leasure of the Governor ;
47	47	prohibiting removal of members except for cause;
48	48	directing vacancies to be filled by the appointing
49	49	authority; providing for initial appointments within
50	50	specified time; specifying term limits for initial
51	51	appointments; and providing an effective date .

58	58	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
59	59	SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -101, is
60	60	amended to read as follows:
61	61	Section 3-101. A. The State Board of Education shall consist
62	62	of seven (7) fifteen (15) members. The State Superinten dent of
63	63	Public Instruction shall be a member and the chairperson of the
64	64	Board. The remaining six fourteen (14) members shall be appointed
65	65	by the Governor by and with the advice and consent of the Senate.
66	66	Except as otherwise provided for in subsection B o f this section,

93	93	upon assuming office each Governor shall appoint one member from
94	94	each congressional district and one member from the state at large.
95	95	as follows:
96	96	1. Six (6) members appointed by the G overnor. No more than
97	97	three (3) of the members appointed by the Governor shall be
98	98	registered members of the same political party. At least one member
99	99	appointed by the Governor shall represent private schools, at least
100	100	one member shall represent home schools , and at least one member
101	101	shall represent charter schools;
102	102	2. Three (3) members who all have school-aged children in the
103	103	home, one appointed by the Speaker of the Oklahoma House of
104	104	Representatives, one appointed by the President Pro Tempore of the
105	105	Oklahoma State Senate, and one appointed by the other members of the
106	106	Board;
107	107	3. Five (5) members who are certi fied teachers, two selected by
108	108	the largest teacher assoc iation in the state, one which shall
109	109	represent urban school districts with an enrollment of ten thousand
110	110	(10,000) or more students, and one which shall represent rural
111	111	school districts located outside of the O klahoma City and Tulsa
112	112	Metropolitan Statistical Areas, one selected by the second-largest
113	113	teacher association in the state, one selecte d by the largest
114	114	retired teacher association in the state, and one appointed by the
115	115	Oklahoma State Regents for Higher Education to represent the
116	116	colleges of education at higher education inst itutions in the state.

143	143	Each appointment shall be made to take eff ect on April 2. The term
144	144	of each appointed member shall be four (4) five (5) years, except
145	145	for members appointed by the Speaker and President Pro Tempore, who
146	146	shall serve for two-year terms. All appointments other than the
147	147	members appointed by the Speaker and President Pro Tempor e shall be
148	148	subject to confirmation by t he Senate at the next session of th e
149	149	Legislature. Appointed members shall serve until a successor is
150	150	appointed. Appointed members shall serve at the pleasure of the
151	151	Governor only be removed by their appointing auth ority for cause.
152	152	Upon the occurrence of a vac ancy the same shall be filled by the
153	153	Governor appointing authority , subject to confirmation by the Senate
154	154	at the next session of the Legislature. The appointment to fill a
155	155	vacancy shall be made for the unexpired term.
156	156	B. On the effective date of this act November 1, 2023, all
157	157	appointed positions of the current State Board of Education shall be
158	158	deemed vacant and the terms of persons serving on the Board shall be
159	159	deemed terminated. The Governor appointing authorities shall make
160	160	initial appointments pursuant to the provisions of this subsection
161	161	within thirty (30) days of the effective date of this act, with one
162	162	member appointed from each congressional district and one member
163	163	appointed from the state at large . The All initial appointments
164	164	other than the members appointed by the Speaker and President Pro
165	165	Tempore shall be subject to confirmation by t he Senate at the next
166	166	session of the Legislature. The initial terms for members appoin ted

203	203	5. One (1) member appointed by the Governor shall serve an
204	204	initial term of five (5) years;
205	205	6. One (1) member appointed by other members of the Board shall
206	206	serve an initial term of five (5) years;
207	207	7. One (1) member appointed by the largest teacher association
208	208	in the state shall serve an initial term of one (1) year;
209	209	8. One (1) member appointed by the largest teacher association
210	210	in the state shall serve an initial term of five (5) years;
211	211	9. One (1) member appointed by the second-largest teacher
212	212	association in the state shall serve an initial term of two (2)
213	213	years;
214	214	10. One (1) member appointed by the largest retired teacher
215	215	association in the state shall serve an initial term of three (3)

243	243	11. One (1) member appointed by the Oklahoma State Regents for
244	244	Higher Education shall serve an initial term of four (4) years.
245	245	Thereafter Following completion of their initial te rm, members
246	246	shall be appointed as provided for in subsection A of this section.
247	247	C. No person shall be eligible to be appointed to serve on the
248	248	State Board unless the person has been awarded a high school diploma
249	249	or certificate of high school equivalency. Any member appointed to
250	250	the State Board shall complete the workshop requirements of a new
251	251	school board member pursuant to Section 5-110 of this title within
252	252	thirteen (13) months fo llowing or preceding the appointment of the
253	253	member. Notwithstanding any pr ovision of law to the contrary, the
254	254	State Department of Education shall not charge any member of the
255	255	State Board of Education a fee for any workshop provided by the
256	256	Department for board members pursuant to Section 5 -110 of this title
257	257	and shall not pay a fe e to any organization or institution of higher
258	258	education on behalf of a member of the State Board of E ducation, or
259	259	reimburse any member of the Board for a fee paid to any organizati on
260	260	or institution of higher education, for attendance at a workshop or
261	261	courses to satisfy the requirements of Section 5-110 of this title.
262	262	D. Members of the Board shall receive necessary traveling
263	263	expenses while in the performance of their duties in accordance with
264	264	the State Travel Reimbursement Act.
