4040 An Act relating to schools; amending 70 O.S. 2021,
4141 Section 3-101, which relates to the State Board of
4242 Education; modifying members hip of the Board;
4343 requiring five-year terms for certain Board members;
4444 providing an exception ; mandating Senate confirmation
4545 for certain appointments ; deleting provision that
4646 members serve at the p leasure of the Governor ;
4747 prohibiting removal of members except for cause;
4848 directing vacancies to be filled by the appointing
4949 authority; providing for initial appointments within
5050 specified time; specifying term limits for initial
5151 appointments; and providing an effective date .

5858 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5959 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -101, is
6060 amended to read as follows:
6161 Section 3-101. A. The State Board of Education shall consist
6262 of seven (7) fifteen (15) members. The State Superinten dent of
6363 Public Instruction shall be a member and the chairperson of the
6464 Board. The remaining six fourteen (14) members shall be appointed
6565 by the Governor by and with the advice and consent of the Senate.

9393 upon assuming office each Governor shall appoint one member from
9494 each congressional district and one member from the state at large.
9595 as follows:
9696 1. Six (6) members appointed by the G overnor. No more than
9797 three (3) of the members appointed by the Governor shall be
9898 registered members of the same political party. At least one member
9999 appointed by the Governor shall represent private schools, at least
100100 one member shall represent home schools , and at least one member
101101 shall represent charter schools;
102102 2. Three (3) members who all have school-aged children in the
103103 home, one appointed by the Speaker of the Oklahoma House of
104104 Representatives, one appointed by the President Pro Tempore of the
105105 Oklahoma State Senate, and one appointed by the other members of the
106106 Board;
107107 3. Five (5) members who are certi fied teachers, two selected by
108108 the largest teacher assoc iation in the state, one which shall
109109 represent urban school districts with an enrollment of ten thousand
110110 (10,000) or more students, and one which shall represent rural
111111 school districts located outside of the O klahoma City and Tulsa
112112 Metropolitan Statistical Areas, one selected by the second-largest
113113 teacher association in the state, one selecte d by the largest
114114 retired teacher association in the state, and one appointed by the
115115 Oklahoma State Regents for Higher Education to represent the
116116 colleges of education at higher education inst itutions in the state.

143143 Each appointment shall be made to take eff ect on April 2. The term
144144 of each appointed member shall be four (4) five (5) years, except
145145 for members appointed by the Speaker and President Pro Tempore, who
146146 shall serve for two-year terms. All appointments other than the
147147 members appointed by the Speaker and President Pro Tempor e shall be
148148 subject to confirmation by t he Senate at the next session of th e
149149 Legislature. Appointed members shall serve until a successor is
150150 appointed. Appointed members shall serve at the pleasure of the
151151 Governor only be removed by their appointing auth ority for cause.
152152 Upon the occurrence of a vac ancy the same shall be filled by the
153153 Governor appointing authority , subject to confirmation by the Senate
154154 at the next session of the Legislature. The appointment to fill a
155155 vacancy shall be made for the unexpired term.
156156 B. On the effective date of this act November 1, 2023, all
157157 appointed positions of the current State Board of Education shall be
158158 deemed vacant and the terms of persons serving on the Board shall be
159159 deemed terminated. The Governor appointing authorities shall make
160160 initial appointments pursuant to the provisions of this subsection
161161 within thirty (30) days of the effective date of this act, with one
162162 member appointed from each congressional district and one member
163163 appointed from the state at large . The All initial appointments
164164 other than the members appointed by the Speaker and President Pro
165165 Tempore shall be subject to confirmation by t he Senate at the next
166166 session of the Legislature. The initial terms for members appoin ted

193193 pursuant to this subsection shall terminate on April 2 , 2015 be as
194194 follows:
195195 1. Two (2) members appointed by the Governor shall serve an
196196 initial term of one (1) year ;
197197 2. One (1) member appointed by the Governor shall serve an
198198 initial term of two (2) years;
199199 3. One (1) member appointed by the Governor shall s erve an
200200 initial term of three (3) years;
201201 4. One (1) member appointed by the Governor shall serve an
202202 initial term of four (4) years;
203203 5. One (1) member appointed by the Governor shall serve an
204204 initial term of five (5) years;
205205 6. One (1) member appointed by other members of the Board shall
206206 serve an initial term of five (5) years;
207207 7. One (1) member appointed by the largest teacher association
208208 in the state shall serve an initial term of one (1) year;
209209 8. One (1) member appointed by the largest teacher association
210210 in the state shall serve an initial term of five (5) years;
211211 9. One (1) member appointed by the second-largest teacher
212212 association in the state shall serve an initial term of two (2)
213213 years;
214214 10. One (1) member appointed by the largest retired teacher
215215 association in the state shall serve an initial term of three (3)

243243 11. One (1) member appointed by the Oklahoma State Regents for
244244 Higher Education shall serve an initial term of four (4) years.
245245 Thereafter Following completion of their initial te rm, members
246246 shall be appointed as provided for in subsection A of this section.
247247 C. No person shall be eligible to be appointed to serve on the
248248 State Board unless the person has been awarded a high school diploma
249249 or certificate of high school equivalency. Any member appointed to
250250 the State Board shall complete the workshop requirements of a new
251251 school board member pursuant to Section 5-110 of this title within
252252 thirteen (13) months fo llowing or preceding the appointment of the
253253 member. Notwithstanding any pr ovision of law to the contrary, the
254254 State Department of Education shall not charge any member of the
255255 State Board of Education a fee for any workshop provided by the
256256 Department for board members pursuant to Section 5 -110 of this title
257257 and shall not pay a fe e to any organization or institution of higher
258258 education on behalf of a member of the State Board of E ducation, or
259259 reimburse any member of the Board for a fee paid to any organizati on
260260 or institution of higher education, for attendance at a workshop or
261261 courses to satisfy the requirements of Section 5-110 of this title.
262262 D. Members of the Board shall receive necessary traveling
263263 expenses while in the performance of their duties in accordance with
264264 the State Travel Reimbursement Act.
