52 | 102 | | test approved by CLEET to assure the applicant is in sufficient |

53 | 103 | | physical condition to avoid unnecessary injury during the basic law |

56 | 105 | | C. 1. Beginning November 1, 2009, any person or peace officer, |
---|
57 | 106 | | upon employment by a law enforcement agency and prior to attending a |
---|
58 | 107 | | basic law enforcement academy conducted by CLEET, shall execute a |
---|
59 | 108 | | promissory note for academy training expenses payable to CLEET |
---|
60 | 109 | | whereby the person or peace offi cer promises to repay the note by |
---|
61 | 110 | | remaining within the law enforcement profession in the State of |
---|
62 | 111 | | Oklahoma in a position approved by rules and regulations of CLEET |
---|
63 | 112 | | for four (4) years following graduation from the basic law |
---|
64 | 113 | | enforcement academy. |
---|
68 | 143 | | peace officer to execute a promissory note for academy training |
---|
69 | 144 | | expenses payable to the law enforcement agency conducting the |
---|
70 | 145 | | training, whereby the person or peace officer promises to repay the |
---|
71 | 146 | | note by remaining with the law enforcement agency in a position |
---|
72 | 147 | | approved by the law enforcement agency for a period of time agreed |
---|
73 | 148 | | upon and under terms and cond itions agreeable to both parties, not |
---|
74 | 149 | | to extend longer than four (4) years following graduation from the |
---|
75 | 150 | | basic law enforcement academy. |
---|
77 | 151 | | D. The amounts due pursuant to subsection C of this section |
---|
78 | 152 | | shall be reduced at a rate of Three Dollars ($3.00) per calendar day |
---|
79 | 153 | | beginning the first day af ter graduation from the basic law |
---|
80 | 154 | | enforcement academy and continuing until the end of one thousand |
---|
81 | 155 | | four hundred sixty (1,460) days. If for any reason a peace officer |
---|
82 | 156 | | leaves the employment of a law enforcement agency and does not |
---|
83 | 157 | | reemploy with an approved law enforcement agency within ninety (90) |
---|
84 | 158 | | days of the date of becoming inactive the obligation shall be |
---|
85 | 159 | | considered due. Upon default of the note, if no agreement for |
---|
86 | 160 | | payment or payment schedule has been agreed upon, the certification |
---|
87 | 161 | | of the peace officer shall be suspended. For purposes of repayment, |
---|
88 | 162 | | periods of time where a peace officer is inactive shall not be |
---|
89 | 163 | | included in the one-thousand-four-hundred-sixty-day employment |
---|
90 | 164 | | period. |
---|
102 | 200 | | G. Violation of the provisions of subsection D of this section |
---|
103 | 201 | | or the terms of the promissory note for academy training expenses |
---|
104 | 202 | | entered into pursuant to paragraph 1 of subsection C of this section |

105 | 203 | | shall give rise to a cause of action and suit may be commenced by |
---|
106 | 204 | | CLEET for and on behalf of the State of Oklahoma for restitution of |
---|
107 | 205 | | any and all sums plus interest at th e statutory rate, costs and |
---|
108 | 206 | | reasonable attorney fees. All promisso ry notes for academy tra ining |
---|
109 | 207 | | expenses, interest and fees collected pursuant to paragraph 1 of |
---|
110 | 208 | | subsection C of this section shall be deposited into the Peace |
---|
111 | 209 | | Officer Revolving Fund provided for in Section 3311.7 of Title 70 of |
---|
112 | 210 | | the Oklahoma Statutes this title. The provisions of this section |
---|
113 | 211 | | subsection shall not apply to persons who volunteer or are drafted |
---|
114 | 212 | | into active military service subsequent to receiving CLEET training |
---|
115 | 213 | | at state expense. |
