2753 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2954 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3311.11, is
3055 amended to read as follows:

3256 Section 3311.11 A. Any person or peace officer who desires to
3357 attend a basic law enforcement academy conducted by the C ouncil on
3458 Law Enforcement Education and Training (CLEET) shall, within ninety
3559 (90) days of hire and prior to CLEET admission, be required to score
3660 a minimum of seventy percent (70%) on a reading and writing
3761 comprehension examination approved by CLEET to as sure the applicant
3862 can read and write on a level necessary to perform the requirements
3963 of the CLEET academy. Any person or any peace officer who desires
4064 to attend a CLEET-approved reserve basic law enforcement academy

4898 B. Beginning November 1, 2009, any person or peace officer who
4999 desires to attend the basic law enforcement academy conducted by
50100 CLEET shall, prior to admission, be required to provide proof of a
51101 score of a minimum of seventy percen t (70%) on a physical agility
52102 test approved by CLEET to assure the applicant is in sufficient
53103 physical condition to avoid unnecessary injury during the basic law
54104 enforcement academy training.

56105 C. 1. Beginning November 1, 2009, any person or peace officer,
57106 upon employment by a law enforcement agency and prior to attending a
58107 basic law enforcement academy conducted by CLEET, shall execute a
59108 promissory note for academy training expenses payable to CLEET
60109 whereby the person or peace offi cer promises to repay the note by
61110 remaining within the law enforcement profession in the State of
62111 Oklahoma in a position approved by rules and regulations of CLEET
63112 for four (4) years following graduation from the basic law
64113 enforcement academy.

66114 2. A law enforcement agency previously approved by CLEET to

68143 peace officer to execute a promissory note for academy training
69144 expenses payable to the law enforcement agency conducting the
70145 training, whereby the person or peace officer promises to repay the
71146 note by remaining with the law enforcement agency in a position
72147 approved by the law enforcement agency for a period of time agreed
73148 upon and under terms and cond itions agreeable to both parties, not
74149 to extend longer than four (4) years following graduation from the
75150 basic law enforcement academy.

77151 D. The amounts due pursuant to subsection C of this section
78152 shall be reduced at a rate of Three Dollars ($3.00) per calendar day
79153 beginning the first day af ter graduation from the basic law
80154 enforcement academy and continuing until the end of one thousand
81155 four hundred sixty (1,460) days. If for any reason a peace officer
82156 leaves the employment of a law enforcement agency and does not
83157 reemploy with an approved law enforcement agency within ninety (90)
84158 days of the date of becoming inactive the obligation shall be
85159 considered due. Upon default of the note, if no agreement for
86160 payment or payment schedule has been agreed upon, the certification
87161 of the peace officer shall be suspended. For purposes of repayment,
88162 periods of time where a peace officer is inactive shall not be
89163 included in the one-thousand-four-hundred-sixty-day employment
90164 period.

92165 E. The amount of a promissory note for academy training
93-expenses that is canceled under the provisions of this section sh all
94-not be considered income for the purposes of Oklahoma State Income
95-Tax.

194+shall not be considered income for the purposes of Oklahoma State
195+Income Tax.
97196 F. The Director of CLEET may waive any o r all promissory note
98197 obligations for academy training expenses in instances where in the
99198 sole opinion of the Director, a waiver is in the best interests of
100199 law enforcement.

102200 G. Violation of the provisions of subsection D of this section
103201 or the terms of the promissory note for academy training expenses
104202 entered into pursuant to paragraph 1 of subsection C of this section
105203 shall give rise to a cause of action and suit may be commenced by
106204 CLEET for and on behalf of the State of Oklahoma for restitution of
107205 any and all sums plus interest at th e statutory rate, costs and
108206 reasonable attorney fees. All promisso ry notes for academy tra ining
109207 expenses, interest and fees collected pursuant to paragraph 1 of
110208 subsection C of this section shall be deposited into the Peace
111209 Officer Revolving Fund provided for in Section 3311.7 of Title 70 of
112210 the Oklahoma Statutes this title. The provisions of this section
113211 subsection shall not apply to persons who volunteer or are drafted
114212 into active military service subsequent to receiving CLEET training
115213 at state expense.
