51	51	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	52	SECTION 1. AMENDATORY 70 O.S. 2021 , Section 5-119, is
53	53	amended to read as follows:
54	54	Section 5-119. A. Except for districts that elect a chair of
55	55	the board pursuant to Section 1 5-107B of this act title, the board
56	56	of education of each school district shall el ect from its membership
57	57	at the first regular, special, or emergency meeting held sixty (60)
58	58	days following the annual school election and certification of
59	59	election of new members , a president and vice president, each of
60	60	whom shall serve for a term of one (1) year and until a successor is
61	61	elected and qualified. The board shall also elect a clerk and, in
62	62	its discretion, a deput y clerk, either of whom may be one of the

89	89	members of the board, and each of whom shall hold office during the
90	90	pleasure of the board and each of whom shall receive such
91	91	compensation for services as the board may allow. If the board
92	92	elects a board clerk who is not one of the members o f the board, the
93	93	board clerk may also be employed as the encumbrance clerk and minute
94	94	clerk. Provided, no superintendent, principal, treasurer or
95	95	assistant treasurer, instructor, or teacher employed by such board
96	96	shall be elected or serve as clerk or depu ty clerk of the board nor
97	97	as encumbrance clerk or minute clerk except that a treasurer or
98	98	assistant treasurer may serve as a minute clerk. No board membe r
99	99	shall serve as encumbrance clerk or minute clerk. The deputy clerk
100	100	may perform any of the duties an d exercise any of the powers of the
101	101	clerk with the same force and effect as if the same we re done or
102	102	performed by the clerk. Before entering upon the dis charge of the
103	103	duties of the deputy clerk, the deputy clerk shall give a bo nd in a
104	104	sum of not less than One Thousand Dollars ($1,000.00) with good and
105	105	sufficient sureties to be approved by the board conditioned for the
106	106	faithful performance of the duties of the deputy clerk.
107	107	B. The board of education shall employ an encumbrance c lerk and
108	108	minute clerk, both functions of which may be performed by the same
109	109	employee. The encumbrance clerk shall kee p the books and documents
110	110	of the school district and perform suc h other duties as the board of
111	111	education or its committees may require. T he minute clerk shall
112	112	keep an accurate journal of the proceedings of the board of

139	139	education and perform such other dut ies as the board of education or
140	140	its committees may require. Th e board of education may designate a
141	141	deputy minute clerk. The deputy minu te clerk may perform any of the
142	142	duties and exercise any of the powers of the minute clerk with the
143	143	same force and effect as if the same were done or performed by the
144	144	minute clerk. Before entering upon the discharge of the duties of
145	145	the deputy minute clerk , the deputy minute clerk sh all give a bond
146	146	in a sum of not less than One Thousand Dollars ($1,000.00) with good
147	147	and sufficient sureties to be approved by the board conditioned for
148	148	the faithful performance of the duties of the deputy minute clerk.
149	149	Before entering upon the discharge of their duties, the encumbrance
150	150	clerk and minute clerk shall each give a bond in a sum of not less
151	151	than One Thousand Dollars ($1,000.00) with good and su fficient
152	152	sureties to be approved by the board conditioned for the faithful
153	153	performance of their duties . If both functions are performed by the
154	154	same person only one bond in a sum of not less t han One Thousand
155	155	Dollars ($1,000.00) shall be required.
156	156	SECTION 2. This act shall become effective November 1, 2023.
