5151 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5252 SECTION 1. AMENDATORY 70 O.S. 2021 , Section 5-119, is
5353 amended to read as follows:
5454 Section 5-119. A. Except for districts that elect a chair of
5555 the board pursuant to Section 1 5-107B of this act title, the board
5656 of education of each school district shall el ect from its membership
5757 at the first regular, special, or emergency meeting held sixty (60)
5858 days following the annual school election and certification of
5959 election of new members , a president and vice president, each of
6060 whom shall serve for a term of one (1) year and until a successor is
6161 elected and qualified. The board shall also elect a clerk and, in
6262 its discretion, a deput y clerk, either of whom may be one of the

8989 members of the board, and each of whom shall hold office during the
9090 pleasure of the board and each of whom shall receive such
9191 compensation for services as the board may allow. If the board
9292 elects a board clerk who is not one of the members o f the board, the
9393 board clerk may also be employed as the encumbrance clerk and minute
9494 clerk. Provided, no superintendent, principal, treasurer or
9595 assistant treasurer, instructor, or teacher employed by such board
9696 shall be elected or serve as clerk or depu ty clerk of the board nor
9797 as encumbrance clerk or minute clerk except that a treasurer or
9898 assistant treasurer may serve as a minute clerk. No board membe r
9999 shall serve as encumbrance clerk or minute clerk. The deputy clerk
100100 may perform any of the duties an d exercise any of the powers of the
101101 clerk with the same force and effect as if the same we re done or
102102 performed by the clerk. Before entering upon the dis charge of the
103103 duties of the deputy clerk, the deputy clerk shall give a bo nd in a
104104 sum of not less than One Thousand Dollars ($1,000.00) with good and
105105 sufficient sureties to be approved by the board conditioned for the
106106 faithful performance of the duties of the deputy clerk.
107107 B. The board of education shall employ an encumbrance c lerk and
108108 minute clerk, both functions of which may be performed by the same
109109 employee. The encumbrance clerk shall kee p the books and documents
110110 of the school district and perform suc h other duties as the board of
111111 education or its committees may require. T he minute clerk shall
112112 keep an accurate journal of the proceedings of the board of

139139 education and perform such other dut ies as the board of education or
140140 its committees may require. Th e board of education may designate a
141141 deputy minute clerk. The deputy minu te clerk may perform any of the
142142 duties and exercise any of the powers of the minute clerk with the
143143 same force and effect as if the same were done or performed by the
144144 minute clerk. Before entering upon the discharge of the duties of
145145 the deputy minute clerk , the deputy minute clerk sh all give a bond
146146 in a sum of not less than One Thousand Dollars ($1,000.00) with good
147147 and sufficient sureties to be approved by the board conditioned for
148148 the faithful performance of the duties of the deputy minute clerk.
149149 Before entering upon the discharge of their duties, the encumbrance
150150 clerk and minute clerk shall each give a bond in a sum of not less
151151 than One Thousand Dollars ($1,000.00) with good and su fficient
152152 sureties to be approved by the board conditioned for the faithful
153153 performance of their duties . If both functions are performed by the
154154 same person only one bond in a sum of not less t han One Thousand
155155 Dollars ($1,000.00) shall be required.
156156 SECTION 2. This act shall become effective November 1, 2023.
