4040 An Act relating to schools; requiring school district

4343 to comply with requirement; providing for written
4444 warning notice for failure to comply; directing
4545 warning notice be posted on district website;

4747 comply for four consecutive years ; mandating
4848 permanent compensation increase; defining terms;
4949 providing for codification; providing an effective

5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. NEW LAW A new section of law to be codified
5858 in the Oklahoma Statutes as Section 5-128.3 of Title 70, unless
5959 there is created a duplication in numbering, reads as follows:
6060 A. Beginning with the 202 3-2024 school year, the board of
6161 education of each school distri ct in the state shall spend no less
6262 than sixty percent (60%) of its annual budget on instructional
6363 expenditures.
6464 B. If a school district spends less th an sixty percent (60%) of
6565 its annual budget on instructional expenditures, it shall increase

9292 its instructional expenditures by no less than two percent (2%) each
9393 year until the amount spent on instructional expenditures reaches
9494 sixty percent (60%) of its a nnual budget.
9595 C. If a school district spends less than sixty percent (60%) of
9696 its annual budget on in structional expenditures and does not
9797 increase its spending as provided in subsection B of this section,
9898 the school district shall receive a written warnin g notice from the
9999 State Department of Education. The notice shall also be posted on
100100 the website of the school district.
101101 D. If a school district spends less than sixty percent (60%) of
102102 its annual budget on instructional expenditures and does not
103103 increase its spending as provided in subsection B of this section
104104 for four (4) consecutive years after receiv ing the notice provided
105105 in subsection C of this section, the school district shall increase
106106 compensation for all teachers in the school district by two percen t
107107 (2%) for each year in that period in which the school district did
108108 not increase instructional expenditures by a minimum of two percent
109109 (2%). The pay increase required pursuant to this subsection shall
110110 be permanent.
111111 E. As used in this section:
112112 1. "Annual budget" means a plan of financial operations using
113113 revenues contributed from local, state , and federal sources but
114114 shall not include revenue received from bond sales, the sale of

141141 property or equipment, school fundraisers , or nonprofit organization
142142 contributions or grants; and
143143 2. "Instructional expenditures " means instruction and
144144 instruction-related expenditures as defined by the National Center
145145 for Education Statistics, a federal entity within the United States
146146 Department of Education.
147147 SECTION 2. This act shall become effective July 1, 2023.
148148 SECTION 3. It being immediately necessary for the preservation
149149 of the public peace, health or safety, an emergency is hereby
150150 declared to exist, by reason whereof thi s act shall take effect and
151151 be in full force from and after its passage and approval.
