5656 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5757 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5 -106, is
5858 amended to read as follows:
5959 Section 5-106. A. The governing board of each school district
6060 in Oklahoma is hereby designated and shall hereafter be known as the
6161 board of education of such d istrict. Except as otherwise provided
6262 in this section, the sup erintendent of schools appointed and
6363 employed by the board shall be the executive officer of the board
6464 and shall perform duties as the board directs. A superintendent of
6565 schools appointed and employed by the board shall possess, at a

9292 minimum, a baccalaureate degree. The board may establish additional
9393 requirements and qualifications for superintendent candidates as it
9494 deems necessary to fulfill the duties of e mployment.
9595 B. The board may contra ct with a superintendent for a term as
9696 mutually agreed upon but not to exceed thre e (3) years beyond the
9797 fiscal year in which the contract is approved by the board and
9898 accepted by the superintendent. The contract shall i nclude all
9999 other terms and conditio ns as agreed upon in writing by the board
100100 and the superintendent.
101101 C. The boards of two or more school districts may contract with
102102 one superintendent to serve as superintendent of the school
103103 districts as provided in Secti on 4 5-106A of this act title.
104104 D. No board of a school district having average daily
105105 membership (ADM) of fewer than five hundred (500) pupils shall be
106106 prohibited from allowing a superintendent to serve simultaneously as
107107 a principal.
108108 E. The chief executive officer of the board of education of a
109109 district in which a public developmental research school is
110110 established shall be the dire ctor of the school appointed as
111111 provided in Section 1210.577 of this title.
112112 SECTION 2. AMENDATORY 70 O.S. 2021, Section 6-189, is
113113 amended to read as follows:
114114 Section 6-189. A. The certification system required by the
115115 Oklahoma Teacher Preparation Act as part of the new teacher

142142 preparation system shall be competency -based. The competencies for
143143 certification shall be integrated with compe tencies specified in
144144 Section 6-185 of this title. By July 1, 1996, the State Board of
145145 Education shall adopt general competencies for certification, and by
146146 January 1, 1997, the Board shall have adopted full competencies a nd
147147 implemented the certification sy stem as required in this act. No
148148 higher education courses or credit hours may be specified by the
149149 State Board of Education in rules for certification. Nothing in the
150150 certification rules adopted by the Board shall prohib it the Oklahoma
151151 State Regents for Higher Education from adopting policies and
152152 procedures it deems appropriate for coursework, grade point average,
153153 or credit hours for teacher preparation at institutions in The
154154 Oklahoma State System of Higher Education.
155155 B. The certification requirements for a school principal not
156156 alternatively certified under subsection D of this section shall
157157 include not less than:
158158 1. Completion of a standard master 's degree;
159159 2. Completion of a program in education administration approve d
160160 by the Oklahoma Commission for Te acher Preparation with an emphasis
161161 on curriculum, instruction and building -level leadership skills.
162162 The requirement in this paragraph shall not apply to any person who
163163 has completed a master 's degree program in education that included
164164 competencies that ar e substantially equal to those listed in this
165165 paragraph and if the degree was completed prior to July 1, 2005;

192192 3. Any other professional education and requirements as may be
193193 fixed by the State Board of Education;
194194 4. A passing score on the subject area co mpetency examination
195195 required in Section 6 -187 of this title; and
196196 5. A minimum of two (2) years of successful teaching experience
197197 in public or private schools accredited by the State Board of
198198 Education or by the proper a ccrediting authority of another sta te of
199199 the United States.
200200 C. The certification requirements for a superintendent of
201201 schools not alternatively certified under subsection D of this
202202 section shall include not less than:
203203 1. Certification as a school princip al or completion of the
204204 certification requirements for a school principal as set forth in
205205 subsection B of this section;
206206 2. Completion of a program in education administration approved
207207 by the Oklahoma Commission for Teacher Preparation with an emphasis
208208 on district-level leadership skills, a nd which shall include the
209209 following competencies:
210210 a. instructional leadership,
211211 b. organizational leadership, including education
212212 finance, education law, and risk management,
213213 c. collaborative and community leadership, and
214214 d. ethical leadership.

241241 The requirement in this paragraph shall not apply to any person
242242 who has completed an Oklahoma Commission for Teacher Preparation
243243 approved Master's Degree in Education Administration or has
244244 completed a program in education that inclu ded competencies that are
245245 substantially equal to those listed in this paragraph, and if the
246246 degree or program was completed between the effective date of this
247247 act and July 1, 2005;
248248 3. Any other professional education and requirements as may be
249249 fixed by the State Board of Education;
250250 4. A passing score on the subject area competency examination
251251 required in Section 6 -187 of this title; and
252252 5. A minimum of two (2) years of administrative experience in
253253 public or private schools accredited by the State Board o f Education
254254 or by the proper accre diting authority of another state of the
255255 United States, at a minimum, completion of a baccalaureate degree .
256256 D. 1. The standards for alternative certification for
257257 superintendents of schools and principals shall include:
258258 a. the completion of a standard mas ter's degree,
259259 b. two (2) years of relevant work experien ce in a
260260 supervisory or administrative capacity,
261261 c. a passing score on the subject area competency
262262 examination required in Section 6 -187 of this title,

290290 d. filing with the director of teacher educat ion at an
291291 Oklahoma accredited institution of higher educ ation a
292292 plan for completing an alternative administrative
293293 preparation program within three (3) years. Relevant
294294 work experience and coursework may be considered and
295295 applied to complete the plan.
296296 2. An alternative certificate for superintendent of schools and
297297 principals shall not exceed three (3) years and shall not be
298298 renewable.
299299 3. Upon successful completion of an alternative administrative
300300 preparation program by a p articipant, the State Board of Edu cation
301301 shall issue a standard certificate for superintendent or principal,
302302 as applicable, to the applicant.
303303 4. Any person participating in an alternative certification
304304 program for superintendent of schools and principals on the
305305 effective date of this act shall be subject to the program
306306 requirements in effect p rior to the effective date of this act.
307307 E. The certification requirements for a superintendent of a
308308 technology center school district shall include not less than a
309309 standard master's degree, any other professional education
310310 requirements as may be fixed by the State Board of Education, and a
311311 minimum of four (4) years teaching, supervisory or administrative
312312 experience, which may include teaching of full -time adult students,
313313 in a technology center school district. A person meeting the

340340 requirements set forth i n subsection C of this section shall be
341341 eligible for a certificate for superintendent of a technology center
342342 school district.
343343 F. The State Board of Education and the State Board of Career
344344 and Technology Education shall promulgate rules for a certification
345345 system option specifically for teachers and instructors in the
346346 technology center school districts. The teacher preparation system
347347 shall be competency-based. The competencies for certification shall
348348 be integrated with competencies of this title, as well as reflect
349349 industry-based skills, standards and certifications.
350350 G. Certificates issued by the State Board of Education may be
351351 revoked by the State Board of Education for willful violation of any
352352 rule of the Board or of any federal or state law or other pr oper
353353 cause but only after sufficient hearing has been given before the
354354 Board.
355355 H. Teaching in a Head Start program or programs shall be used
356356 for renewal of a standard teaching certificate.
357357 SECTION 3. This act shall become effective July 1, 2023.
358358 SECTION 4. It being immediately necessary for the preservation
359359 of the public peace, health or safety, an emergency is hereby
360360 declared to exist, by reason whereof thi s act shall take effect a nd
361361 be in full force from and after its passage and approval.
