98 | 98 | | abortion. Such substantial steps include, but are not limite d to: |
---|
99 | 99 | | a. agreeing with an individual to perform an abortion on |
---|
100 | 100 | | that individual or on some other person, whether or |
---|
101 | 101 | | not the term "abortion" is used in the agreement, and |
---|
102 | 102 | | whether or not the agreement is contingent on another |
---|
103 | 103 | | factor such as receipt of payment or a determination |
---|
104 | 104 | | of pregnancy, or |
---|
105 | 105 | | b. scheduling or planning a time to p erform an abortion |
---|
106 | 106 | | on an individual, whether or not the term "abortion" |
---|
107 | 107 | | is used, and whether or not the performance is |
---|
108 | 108 | | contingent on another factor such as receipt of |
---|
109 | 109 | | payment or a determination of pregnancy. |
---|
110 | 110 | | This definition shall not be construed to requir e that an abortion |

144 | 144 | | cut or rip it off. This definition does not include an abortion |
---|
145 | 145 | | which uses suction to dismember the body of the deve loping unborn |
---|
146 | 146 | | child by sucking fetal part s into a collection container; |
---|
147 | 147 | | 4. "Physician" means a person licensed to practice medicine and |
---|
148 | 148 | | surgery or osteopathic medicine and s urgery, or otherwise legally |
---|
149 | 149 | | authorized to perform an abortion; |
---|
150 | 150 | | 5. "Purposely" means the following: A person acts purpose ly |
---|
151 | 151 | | with respect to a material element of an offense when: |
---|
152 | 152 | | a. if the element involves the nature of his or her |
---|
153 | 153 | | conduct or a result the reof, it is his or her |
---|
154 | 154 | | conscious objective to engage in conduct of that |
---|
155 | 155 | | nature or to cause such a result, and |
---|
156 | 156 | | b. if the element involves the attendant circumstances, |
---|
157 | 157 | | he or she is aware of the existence of such |
---|
158 | 158 | | circumstances or he or she believes or hopes t hat they |
---|

160 | 160 | | 6. "Serious health risk to the unborn child 's mother" means |

198 | 198 | | 8. "Woman" means a female human being whether or not she has |
---|
199 | 199 | | reached the age of majority. |

241 | 241 | | termination will with reasonable likelihood cause the death of the |

242 | 242 | | unborn child. This includes the off-label use of drugs known to |
---|
243 | 243 | | have abortion-inducing properties, which are prescribed specifically |
---|
244 | 244 | | with the intent of causing an abortion, such as mifepristone |
---|
245 | 245 | | (Mifeprex), misoprostol (Cytotec) and methotrexate. This definition |
---|
246 | 246 | | does not apply to drugs that may be known t o cause an abortion, but |
---|
247 | 247 | | which are prescribed for other medical indications, such as |
---|
248 | 248 | | chemotherapeutic agents and diagnostic drugs. The use of such drugs |
---|
249 | 249 | | to induce abortion is also known as "medical", "medication", "RU– |
---|
250 | 250 | | 486", "chemical", "Mifeprex regimen" or "drug-induced" abortion; |
---|
251 | 251 | | 3. "Adverse Event", according to the Food and Drug |
---|
252 | 252 | | Administration, means any untoward medical occur rence associated |
---|
253 | 253 | | with the use of a drug in humans, whether or not considered drug - |
---|
254 | 254 | | related. It does not include an adverse event or suspected adverse |
---|
255 | 255 | | reaction that, had it occurred in a more severe form, might have |
---|
256 | 256 | | caused death; |
---|
257 | 257 | | 4. "Associated physician" means a person licensed to practice |
---|
258 | 258 | | medicine in the state including medical doctors and doctors of |
---|
259 | 259 | | osteopathy, that has entered into an associated physician agreement; |
---|
260 | 260 | | 5. "Complication" means any adverse physical or psychological |
---|
261 | 261 | | condition arising from th e performance of an abortion which |
---|

297 | 297 | | the administration of ABO-incompatible blood or blood products , |

298 | 298 | | adverse reactions to anesthesia and other drugs, subsequent |
---|
299 | 299 | | development of breast cancer, psychological complications such as |
---|
300 | 300 | | depression, suicidal ideation, anxiety, sleeping disorders, death |
---|
301 | 301 | | and any other adverse event as defined by the Food and Drug |
---|
302 | 302 | | Administration criteria provided in the Medwat ch Reporting System; |
---|
303 | 303 | | 6. "Gestational age" means the time that has elapsed since the |
---|
304 | 304 | | first day of the woman's last menstrual period, also known as "last |
---|
305 | 305 | | menstrual period" or "LMP"; |
---|
306 | 306 | | 7. "Hospital" means an institution providing medical and |
---|
307 | 307 | | surgical treatment and nursing care for sick or injured p eople, or |
---|
308 | 308 | | institutions defined under Section 1-701 of Title 63 of the Oklahoma |
---|

348 | 348 | | b. assess the gestational age of pregna ncy and to inform |
---|
349 | 349 | | the patient of gestational age-specific risks, |
---|
350 | 350 | | c. diagnose ectopic pregnancy, |
---|
351 | 351 | | d. determine blood type and adm inister RhoGAM if a woman |
---|
352 | 352 | | is Rh negative, |
---|
353 | 353 | | e. assess for signs of domestic abuse, reproduc tive |
---|
354 | 354 | | control, human trafficking and other signals of |
---|
355 | 355 | | coerced abortion, |
---|
356 | 356 | | f. provide surgical intervention or has entered into a |
---|
357 | 357 | | contract with another qualified physician to provide |
---|

595 | 595 | | abortion-inducing drugs, any act o f giving, selling, dispensing, |

598 | 598 | | 13. "Terminal fetus" means a fetus who has a genetic |

599 | 599 | | abnormality and the fetus has no medical chance of survival post - |
---|

601 | 601 | | 14. "Unborn child" means an individual organism of the species |

602 | 602 | | Homo sapiens, beginning at fertilization, until th e point of being |
