52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -737.8, is
54	54	amended to read as follows:
55	55	Section 1-737.8 For the purposes of the Oklahoma Unborn Child
56	56	Protection from Dismemberment Abortion Act:
57	57	1. "Abortion" means the use or prescription of any instrument,
58	58	medicine, drug, or any other substance or device:
59	59	a. to purposely kill the unborn child of a woman known to
60	60	be pregnant, or
61	61	b. to purposely terminate the pregnancy of a woman known
62	62	to be pregnant, with a purpose other tha n:

90	90	preserve the life and hea lth of the child born
91	91	alive, or
92	92	(2) to remove a dead unborn child , or
93	93	(3) pre-inducement due to a terminal fetus ;
94	94	2. "Attempt to perform an abortion " means to do or omit to do
95	95	anything that, under the circumstances as the actor believes them to
96	96	be, is an act or omission constitutin g a substantial step in a
97	97	course of conduct planned t o culminate in the actor performing an
98	98	abortion. Such substantial steps include, but are not limite d to:
99	99	a. agreeing with an individual to perform an abortion on
100	100	that individual or on some other person, whether or
101	101	not the term "abortion" is used in the agreement, and
102	102	whether or not the agreement is contingent on another
103	103	factor such as receipt of payment or a determination
104	104	of pregnancy, or
105	105	b. scheduling or planning a time to p erform an abortion
106	106	on an individual, whether or not the term "abortion"
107	107	is used, and whether or not the performance is
108	108	contingent on another factor such as receipt of
109	109	payment or a determination of pregnancy.
110	110	This definition shall not be construed to requir e that an abortion
111	111	procedure actually must be initiated for an attempt to occur;

138	138	3. "Dismemberment abortion " means, with the purpose of causing
139	139	the death of an unborn child, purpose ly to dismember a living unborn
140	140	child and extract him or her one piece at a time from the uterus
141	141	through use of clamps, grasping forceps, tongs, scissors or similar
142	142	instruments that, through the co nvergence of two rigid levers,
143	143	slice, crush, and/or grasp a portion of the unborn child 's body to
144	144	cut or rip it off. This definition does not include an abortion
145	145	which uses suction to dismember the body of the deve loping unborn
146	146	child by sucking fetal part s into a collection container;
147	147	4. "Physician" means a person licensed to practice medicine and
148	148	surgery or osteopathic medicine and s urgery, or otherwise legally
149	149	authorized to perform an abortion;
150	150	5. "Purposely" means the following: A person acts purpose ly
151	151	with respect to a material element of an offense when:
152	152	a. if the element involves the nature of his or her
153	153	conduct or a result the reof, it is his or her
154	154	conscious objective to engage in conduct of that
155	155	nature or to cause such a result, and
156	156	b. if the element involves the attendant circumstances,
157	157	he or she is aware of the existence of such
158	158	circumstances or he or she believes or hopes t hat they
159	159	exist;
160	160	6. "Serious health risk to the unborn child 's mother" means
161	161	that in reasonable medical judgment she has a condition that so

189	189	of her pregnancy to avert her death or to avert serious risk of
190	190	substantial and irreversible physical impairment of a major bodil y
191	191	function, not including psychological o r emotional conditions. No
192	192	such condition may be determine d to exist if it is based on a claim
193	193	or diagnosis that the woman will enga ge in conduct which she inten ds
194	194	to result in her death or in substantial and irrev ersible physical
195	195	impairment of a major bo dily function; and
196	196	7. "Terminal fetus" means a fetus who has a genetic abnormality
197	197	and the fetus has no medical chance of survival p ost-delivery; and
198	198	8. "Woman" means a female human being whether or not she has
199	199	reached the age of majority.
200	200	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -756.2, is
201	201	amended to read as follows:
202	202	Section 1-756.2 As used in this act:
203	203	1. "Abortion" means the use or prescription of any instrument,
204	204	medicine, drug or any other substance or device intent ionally to
205	205	terminate the pregnancy of a female known to be preg nant with an
206	206	intention other than to increase the probability of a live birth, to
207	207	preserve the life or health of the child after live birth, to remove
208	208	an ectopic pregnancy or, to remove a dead unborn child who died as
209	209	the result of a spontaneous miscarriag e, accidental trauma or a
210	210	criminal assault on the pregnant female or her unborn child, or pre-
211	211	inducement of a terminal fetus;

238	238	2. "Abortion-inducing drug" means a medicine, drug or any othe r
239	239	substance prescribed or dispensed with the intent of terminating the
240	240	pregnancy of a woman known to be pregnant, with knowledge that the
241	241	termination will with reasonable likelihood cause the death of the
242	242	unborn child. This includes the off-label use of drugs known to
243	243	have abortion-inducing properties, which are prescribed specifically
244	244	with the intent of causing an abortion, such as mifepristone
245	245	(Mifeprex), misoprostol (Cytotec) and methotrexate. This definition
246	246	does not apply to drugs that may be known t o cause an abortion, but
247	247	which are prescribed for other medical indications, such as
248	248	chemotherapeutic agents and diagnostic drugs. The use of such drugs
249	249	to induce abortion is also known as "medical", "medication", "RU–
250	250	486", "chemical", "Mifeprex regimen" or "drug-induced" abortion;
251	251	3. "Adverse Event", according to the Food and Drug
252	252	Administration, means any untoward medical occur rence associated
253	253	with the use of a drug in humans, whether or not considered drug -
254	254	related. It does not include an adverse event or suspected adverse
255	255	reaction that, had it occurred in a more severe form, might have
256	256	caused death;
257	257	4. "Associated physician" means a person licensed to practice
258	258	medicine in the state including medical doctors and doctors of
259	259	osteopathy, that has entered into an associated physician agreement;
260	260	5. "Complication" means any adverse physical or psychological
261	261	condition arising from th e performance of an abortion which

291	291	failure to actually t erminate the pregnancy, incomplete abortion
292	292	(retained tissue), pelvic inflammatory disease, endometritis, missed
293	293	ectopic pregnancy, cardiac arrest, respiratory arrest, rena l
294	294	failure, metabolic disorder, shock, emboli sm, coma, placenta previa
295	295	in subsequent pregnancies, preterm delivery in subsequent
296	296	pregnancies, free fluid in the abdomen, hemolytic reaction due to
297	297	the administration of ABO-incompatible blood or blood products ,
298	298	adverse reactions to anesthesia and other drugs, subsequent
299	299	development of breast cancer, psychological complications such as
300	300	depression, suicidal ideation, anxiety, sleeping disorders, death
301	301	and any other adverse event as defined by the Food and Drug
302	302	Administration criteria provided in the Medwat ch Reporting System;
303	303	6. "Gestational age" means the time that has elapsed since the
304	304	first day of the woman's last menstrual period, also known as "last
305	305	menstrual period" or "LMP";
306	306	7. "Hospital" means an institution providing medical and
307	307	surgical treatment and nursing care for sick or injured p eople, or
308	308	institutions defined under Section 1-701 of Title 63 of the Oklahoma
309	309	Statutes;

336	336	8. "Physician" means any person licen sed to practice medicine
337	337	in this state. The term includes medical doctors and doctors of
338	338	osteopathy;
339	339	9. "Pregnant" or "pregnancy" means that female reproductive
340	340	condition of having an unborn child in the mother 's uterus;
341	341	10. "Provide" or "provision" means, when used regarding
342	342	abortion-inducing drugs, any act of giving, selling, dispensing,
343	343	administering, transferring possession t o or otherwise providing or
344	344	prescribing an abortion-inducing drug;
345	345	11. "Qualified physician" means a physician licensed in thi s
346	346	state who has the ability to:
347	347	a. identify and document a viable intrauterine pregnancy,
348	348	b. assess the gestational age of pregna ncy and to inform
349	349	the patient of gestational age-specific risks,
350	350	c. diagnose ectopic pregnancy,
351	351	d. determine blood type and adm inister RhoGAM if a woman
352	352	is Rh negative,
353	353	e. assess for signs of domestic abuse, reproduc tive
354	354	control, human trafficking and other signals of
355	355	coerced abortion,
356	356	f. provide surgical intervention or has entered into a
357	357	contract with another qualified physician to provide
358	358	surgical intervention, and
359	359

386	386	employee or contractor who is pa rticipating in any
387	387	part of procedure including, but not limited to, pre-
388	388	procedure evaluation and care;
389	389	12. "Reasonable medical judgment" means a medical judgment that
390	390	would be made by a reasonably prudent physician knowledgeable about
391	391	the case and the tre atment possibilities with respect to the medical
392	392	conditions involved; and
393	393	13. "Terminal fetus" means a fetus who has a genetic
394	394	abnormality and the fetus has no medical chance of survival post -
395	395	delivery; and
396	396	14. "Unborn child" means an individual organism of the species
397	397	homo sapiens, beginning at fertilization, until the point of being
398	398	born-alive as defined in Title 1 U.S.C., Section 8(b).
399	399	SECTION 3. AMENDATORY 63 O.S. 20 21, Section 1-757.2, is
400	400	amended to read as follows:
401	401	Section 1-757.2 As used in this act:
402	402	1. "Abortion" means the act of using or prescribing any
403	403	instrument, medicine, drug or an y other substance, device or mea ns
404	404	with the intent to terminat e the pregnancy of a woman known to be
405	405	pregnant, with knowledge that the termination by those means will
406	406	with reasonable likelihood cause the death of the unborn child.
407	407	Such use, prescription o r means is not an abortion if do ne with the

441	441	d. treat a maternal disease or illness for which the
442	442	prescribed drug is indica ted, or
443	443	e. pre-induce due to a terminal fetus ;

548	548	b. any substances intended for use in th e diagnosis,
549	549	cure, mitigation, treatment or prevention of disease,
550	550	c. any substances other than food intended to affect t he
551	551	structure or any function of the body, or
552	552	d. any substances intended for use as a co mponent of a
553	553	medicine but not a device or a com ponent, part or
554	554	accessory of a device;
555	555	9. "Obstetrician/gynecologist ", also known as OB/GYN, means a
556	556	licensed physician w ho specializes in the care of w omen during
557	557	pregnancy and childbirth and in the diagnosi s and treatment of

585	585	women's health issues such as menopa use, hormone problem s,
586	586	contraception or birth control, and infertility;
587	587	10. "Physician" means any person fully licensed by and in good
588	588	standing with the State Board of Medical Lic ensure and Supervision
589	589	or the State Board of Osteopathic Examiners to practice medicine in
590	590	this state. The term includes medical doctors and doctors of
591	591	osteopathy;
592	592	11. "Pregnant" or "pregnancy" means that female reproductive
593	593	condition of having an unborn child in the mother's uterus;
594	594	12. "Provide" or "provision" means, when used regarding
595	595	abortion-inducing drugs, any act o f giving, selling, dispensing,
596	596	administering, transferring possession to or otherwise p roviding or
597	597	prescribing an abortion-inducing drug; and
598	598	13. "Terminal fetus" means a fetus who has a genetic
599	599	abnormality and the fetus has no medical chance of survival post -
600	600	delivery; and
601	601	14. "Unborn child" means an individual organism of the species
602	602	Homo sapiens, beginning at fertilization, until th e point of being
603	603	born-alive as defined in Title 1 U.S.C., Section 8(b).
604	604	SECTION 4. This act shall become effec tive November 1, 2023.
