5252 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5353 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -737.8, is
5454 amended to read as follows:
5555 Section 1-737.8 For the purposes of the Oklahoma Unborn Child
5656 Protection from Dismemberment Abortion Act:
5757 1. "Abortion" means the use or prescription of any instrument,
5858 medicine, drug, or any other substance or device:
5959 a. to purposely kill the unborn child of a woman known to
6060 be pregnant, or
6161 b. to purposely terminate the pregnancy of a woman known
6262 to be pregnant, with a purpose other tha n:

8989 (1) after viability to produce a live birth and
9090 preserve the life and hea lth of the child born
9191 alive, or
9292 (2) to remove a dead unborn child , or
9393 (3) pre-inducement due to a terminal fetus ;
9494 2. "Attempt to perform an abortion " means to do or omit to do
9595 anything that, under the circumstances as the actor believes them to
9696 be, is an act or omission constitutin g a substantial step in a
9797 course of conduct planned t o culminate in the actor performing an
9898 abortion. Such substantial steps include, but are not limite d to:
9999 a. agreeing with an individual to perform an abortion on
100100 that individual or on some other person, whether or
101101 not the term "abortion" is used in the agreement, and
102102 whether or not the agreement is contingent on another
103103 factor such as receipt of payment or a determination
104104 of pregnancy, or
105105 b. scheduling or planning a time to p erform an abortion
106106 on an individual, whether or not the term "abortion"
107107 is used, and whether or not the performance is
108108 contingent on another factor such as receipt of
109109 payment or a determination of pregnancy.
110110 This definition shall not be construed to requir e that an abortion
111111 procedure actually must be initiated for an attempt to occur;

138138 3. "Dismemberment abortion " means, with the purpose of causing
139139 the death of an unborn child, purpose ly to dismember a living unborn
140140 child and extract him or her one piece at a time from the uterus
141141 through use of clamps, grasping forceps, tongs, scissors or similar
142142 instruments that, through the co nvergence of two rigid levers,
143143 slice, crush, and/or grasp a portion of the unborn child 's body to
144144 cut or rip it off. This definition does not include an abortion
145145 which uses suction to dismember the body of the deve loping unborn
146146 child by sucking fetal part s into a collection container;
147147 4. "Physician" means a person licensed to practice medicine and
148148 surgery or osteopathic medicine and s urgery, or otherwise legally
149149 authorized to perform an abortion;
150150 5. "Purposely" means the following: A person acts purpose ly
151151 with respect to a material element of an offense when:
152152 a. if the element involves the nature of his or her
153153 conduct or a result the reof, it is his or her
154154 conscious objective to engage in conduct of that
155155 nature or to cause such a result, and
156156 b. if the element involves the attendant circumstances,
157157 he or she is aware of the existence of such
158158 circumstances or he or she believes or hopes t hat they
159159 exist;
160160 6. "Serious health risk to the unborn child 's mother" means
161161 that in reasonable medical judgment she has a condition that so

188188 complicates her medical condition that it necessitates the abortion
189189 of her pregnancy to avert her death or to avert serious risk of
190190 substantial and irreversible physical impairment of a major bodil y
191191 function, not including psychological o r emotional conditions. No
192192 such condition may be determine d to exist if it is based on a claim
193193 or diagnosis that the woman will enga ge in conduct which she inten ds
194194 to result in her death or in substantial and irrev ersible physical
195195 impairment of a major bo dily function; and
196196 7. "Terminal fetus" means a fetus who has a genetic abnormality
197197 and the fetus has no medical chance of survival p ost-delivery; and
198198 8. "Woman" means a female human being whether or not she has
199199 reached the age of majority.
200200 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -756.2, is
201201 amended to read as follows:
202202 Section 1-756.2 As used in this act:
203203 1. "Abortion" means the use or prescription of any instrument,
204204 medicine, drug or any other substance or device intent ionally to
205205 terminate the pregnancy of a female known to be preg nant with an
206206 intention other than to increase the probability of a live birth, to
207207 preserve the life or health of the child after live birth, to remove
208208 an ectopic pregnancy or, to remove a dead unborn child who died as
209209 the result of a spontaneous miscarriag e, accidental trauma or a
210210 criminal assault on the pregnant female or her unborn child, or pre-
211211 inducement of a terminal fetus;

238238 2. "Abortion-inducing drug" means a medicine, drug or any othe r
239239 substance prescribed or dispensed with the intent of terminating the
240240 pregnancy of a woman known to be pregnant, with knowledge that the
241241 termination will with reasonable likelihood cause the death of the
242242 unborn child. This includes the off-label use of drugs known to
243243 have abortion-inducing properties, which are prescribed specifically
244244 with the intent of causing an abortion, such as mifepristone
245245 (Mifeprex), misoprostol (Cytotec) and methotrexate. This definition
246246 does not apply to drugs that may be known t o cause an abortion, but
247247 which are prescribed for other medical indications, such as
248248 chemotherapeutic agents and diagnostic drugs. The use of such drugs
249249 to induce abortion is also known as "medical", "medication", "RU–
250250 486", "chemical", "Mifeprex regimen" or "drug-induced" abortion;
251251 3. "Adverse Event", according to the Food and Drug
252252 Administration, means any untoward medical occur rence associated
253253 with the use of a drug in humans, whether or not considered drug -
254254 related. It does not include an adverse event or suspected adverse
255255 reaction that, had it occurred in a more severe form, might have
256256 caused death;
257257 4. "Associated physician" means a person licensed to practice
258258 medicine in the state including medical doctors and doctors of
259259 osteopathy, that has entered into an associated physician agreement;
260260 5. "Complication" means any adverse physical or psychological
261261 condition arising from th e performance of an abortion which

289289 perforation, infection, heavy or uncontrolled bleeding, hemorrhage,
290290 blood clots resulting in pulmonary embolism or dee p vein thrombosis,
291291 failure to actually t erminate the pregnancy, incomplete abortion
292292 (retained tissue), pelvic inflammatory disease, endometritis, missed
293293 ectopic pregnancy, cardiac arrest, respiratory arrest, rena l
294294 failure, metabolic disorder, shock, emboli sm, coma, placenta previa
295295 in subsequent pregnancies, preterm delivery in subsequent
296296 pregnancies, free fluid in the abdomen, hemolytic reaction due to
297297 the administration of ABO-incompatible blood or blood products ,
298298 adverse reactions to anesthesia and other drugs, subsequent
299299 development of breast cancer, psychological complications such as
300300 depression, suicidal ideation, anxiety, sleeping disorders, death
301301 and any other adverse event as defined by the Food and Drug
302302 Administration criteria provided in the Medwat ch Reporting System;
303303 6. "Gestational age" means the time that has elapsed since the
304304 first day of the woman's last menstrual period, also known as "last
305305 menstrual period" or "LMP";
306306 7. "Hospital" means an institution providing medical and
307307 surgical treatment and nursing care for sick or injured p eople, or
308308 institutions defined under Section 1-701 of Title 63 of the Oklahoma
309309 Statutes;

336336 8. "Physician" means any person licen sed to practice medicine
337337 in this state. The term includes medical doctors and doctors of
338338 osteopathy;
339339 9. "Pregnant" or "pregnancy" means that female reproductive
340340 condition of having an unborn child in the mother 's uterus;
341341 10. "Provide" or "provision" means, when used regarding
342342 abortion-inducing drugs, any act of giving, selling, dispensing,
343343 administering, transferring possession t o or otherwise providing or
344344 prescribing an abortion-inducing drug;
345345 11. "Qualified physician" means a physician licensed in thi s
346346 state who has the ability to:
347347 a. identify and document a viable intrauterine pregnancy,
348348 b. assess the gestational age of pregna ncy and to inform
349349 the patient of gestational age-specific risks,
350350 c. diagnose ectopic pregnancy,
351351 d. determine blood type and adm inister RhoGAM if a woman
352352 is Rh negative,
353353 e. assess for signs of domestic abuse, reproduc tive
354354 control, human trafficking and other signals of
355355 coerced abortion,
356356 f. provide surgical intervention or has entered into a
357357 contract with another qualified physician to provide
358358 surgical intervention, and

385385 g. supervise and bear legal responsibility for any agent,
386386 employee or contractor who is pa rticipating in any
387387 part of procedure including, but not limited to, pre-
388388 procedure evaluation and care;
389389 12. "Reasonable medical judgment" means a medical judgment that
390390 would be made by a reasonably prudent physician knowledgeable about
391391 the case and the tre atment possibilities with respect to the medical
392392 conditions involved; and
393393 13. "Terminal fetus" means a fetus who has a genetic
394394 abnormality and the fetus has no medical chance of survival post -
395395 delivery; and
396396 14. "Unborn child" means an individual organism of the species
397397 homo sapiens, beginning at fertilization, until the point of being
398398 born-alive as defined in Title 1 U.S.C., Section 8(b).
399399 SECTION 3. AMENDATORY 63 O.S. 20 21, Section 1-757.2, is
400400 amended to read as follows:
401401 Section 1-757.2 As used in this act:
402402 1. "Abortion" means the act of using or prescribing any
403403 instrument, medicine, drug or an y other substance, device or mea ns
404404 with the intent to terminat e the pregnancy of a woman known to be
405405 pregnant, with knowledge that the termination by those means will
406406 with reasonable likelihood cause the death of the unborn child.
407407 Such use, prescription o r means is not an abortion if do ne with the
408408 intent to:

435435 a. save the life or preserve the health of the unborn
436436 child,
437437 b. remove a dead unborn child caused by spontaneou s
438438 abortion, accidental trauma or a criminal assault on
439439 the pregnant woman or her unborn child,
440440 c. remove an ectopic pregna ncy, or
441441 d. treat a maternal disease or illness for which the
442442 prescribed drug is indica ted, or
443443 e. pre-induce due to a terminal fetus ;
444444 2. "Abortion-inducing drug" means a medicine, drug or any other
445445 substance prescribed or dispensed with the intent of terminatin g the
446446 pregnancy of a woman known to b e pregnant, with knowledge tha t the
447447 termination will with reasonable likelihood cause the death of the
448448 unborn child. This includes th e off-label use of drugs known to
449449 have abortion-inducing properties, which are prescr ibed specifically
450450 with the intent of causing an abortion, such as m ifepristone
451451 (Mifeprex), misoprostol (Cytotec) and methot rexate. This definition
452452 does not apply to drugs that may be known to cause an abortion, but
453453 which are prescribed for other medical i ndications, such as
454454 chemotherapeutic agents and diagnostic drugs. The use of such drugs
455455 to induce abortion is also known a s "medical", "medication", "RU–

535535 Administration criteria provided i n the Medwatch Reporting Syste m;
536536 6. "Gestational age" means the time that has elapsed since the

543543 8. "Manufacturers and distributors" means individuals or
544544 entities that create, produce, supply, transport or sell drugs,
545545 which include:
546546 a. any substances recognized by an official pharmacopoeia
547547 or formulary,
548548 b. any substances intended for use in th e diagnosis,
549549 cure, mitigation, treatment or prevention of disease,
550550 c. any substances other than food intended to affect t he
551551 structure or any function of the body, or
552552 d. any substances intended for use as a co mponent of a
553553 medicine but not a device or a com ponent, part or
554554 accessory of a device;
555555 9. "Obstetrician/gynecologist ", also known as OB/GYN, means a
556556 licensed physician w ho specializes in the care of w omen during
557557 pregnancy and childbirth and in the diagnosi s and treatment of

585585 women's health issues such as menopa use, hormone problem s,
586586 contraception or birth control, and infertility;
587587 10. "Physician" means any person fully licensed by and in good
588588 standing with the State Board of Medical Lic ensure and Supervision
589589 or the State Board of Osteopathic Examiners to practice medicine in
590590 this state. The term includes medical doctors and doctors of
591591 osteopathy;
592592 11. "Pregnant" or "pregnancy" means that female reproductive
593593 condition of having an unborn child in the mother's uterus;
594594 12. "Provide" or "provision" means, when used regarding
595595 abortion-inducing drugs, any act o f giving, selling, dispensing,
596596 administering, transferring possession to or otherwise p roviding or
597597 prescribing an abortion-inducing drug; and
598598 13. "Terminal fetus" means a fetus who has a genetic
599599 abnormality and the fetus has no medical chance of survival post -
600600 delivery; and
601601 14. "Unborn child" means an individual organism of the species
602602 Homo sapiens, beginning at fertilization, until th e point of being
603603 born-alive as defined in Title 1 U.S.C., Section 8(b).
604604 SECTION 4. This act shall become effec tive November 1, 2023.
