4040 An Act relating to schools; amending 70 O.S. 2021,

5454 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5555 SECTION 1. AMENDATORY 70 O.S. 2021, Section 14 -106, is
5656 amended to read as follows:
5757 Section 14-106. A. The 1. Except as provided in subsection B

9090 B. 2. Whenever the Department determines that any such a
9191 district or school has, and doe s not have a need for, equipment
9292 purchased wholly or partly with state or federal funds, it may, if
9393 consistent with federal laws and regulations, order the equipment
9494 transferred to the equipment pool; and the district or school, or
9595 its officials thereof, shall thereupon have the duty to comply with
9696 such the order. Provided, any equipment which has been purchased
9797 wholly or in part with local school funds shall require the
9898 concurrence of the governing board of that local school before the
9999 equipment shall be transferred to the state equipment pool.
100100 C. 3. Whenever the Department determines that a technology
101101 center school district or school supported by public funds has a
102102 need for any equipment in the equipment pool, the Department may
103103 transfer the equipment to such district or school.
104104 B. The board of education of a technology center school
105105 district is authorized, in its discretion , consistent with federal
106106 laws and regulations, and upon terms, conditions, and for such
107107 consideration as it deems advisable, to donate obsolete, surplus, or
108108 unneeded equipment, which it may have, to the board of education of
109109 a school district or technology center school district in the state
110110 for use in connection with any training, maintenance , or other
111111 similar educational program administered by the school district or
112112 technology center school district .

139139 D. C. The State Board of Career and Technology Education shall
140140 adopt and enforce such rules as it deems necessary to carry out the
141141 provisions of this section.
142142 SECTION 2. This act shall become effective November 1, 2023.
