40	40	An Act relating to schools; amending 70 O.S. 2021,
41	41	Section 14-106, which relates to the Oklahoma
42	42	Department of Career and Technology Edu cation
43	43	equipment pool; creating an exception for use of
44	44	equipment pool; authorizing technology center school
45	45	district board of education to donate certain
46	46	equipment; providing for terms of donation;
47	47	specifying eligible recipients of donation ; and

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55	55	SECTION 1. AMENDATORY 70 O.S. 2021, Section 14 -106, is
56	56	amended to read as follows:
57	57	Section 14-106. A. The 1. Except as provided in subsection B
58	58	of this section, the Oklahoma Department of Career and Technology
59	59	Education may operate and maintain an equipment pool, at which there
60	60	shall be kept equipment for the use of technolo gy center school
61	61	districts and schools supported by publi c funds, and said department
62	62	the Department and schools shall be eligible for surplus property
63	63	and equipment.

90	90	B. 2. Whenever the Department determines that any such a
91	91	district or school has, and doe s not have a need for, equipment
92	92	purchased wholly or partly with state or federal funds, it may, if
93	93	consistent with federal laws and regulations, order the equipment
94	94	transferred to the equipment pool; and the district or school, or
95	95	its officials thereof, shall thereupon have the duty to comply with
96	96	such the order. Provided, any equipment which has been purchased
97	97	wholly or in part with local school funds shall require the
98	98	concurrence of the governing board of that local school before the
99	99	equipment shall be transferred to the state equipment pool.
100	100	C. 3. Whenever the Department determines that a technology
101	101	center school district or school supported by public funds has a
102	102	need for any equipment in the equipment pool, the Department may
103	103	transfer the equipment to such district or school.
104	104	B. The board of education of a technology center school
105	105	district is authorized, in its discretion , consistent with federal
106	106	laws and regulations, and upon terms, conditions, and for such
107	107	consideration as it deems advisable, to donate obsolete, surplus, or
108	108	unneeded equipment, which it may have, to the board of education of
109	109	a school district or technology center school district in the state
110	110	for use in connection with any training, maintenance , or other
111	111	similar educational program administered by the school district or
112	112	technology center school district .

139	139	D. C. The State Board of Career and Technology Education shall
140	140	adopt and enforce such rules as it deems necessary to carry out the
141	141	provisions of this section.
142	142	SECTION 2. This act shall become effective November 1, 2023.
