42	42	certain businesses; authorizing the State Purchasing
43	43	Director to prepare a bid-preference program;

52	52	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	53	SECTION 1. NEW LAW A ne w section of law to be codified
54	54	in the Oklahoma Statutes as Section 85.49 of Title 74, unless there
55	55	is created a duplication in numbering, reads as follows:
56	56	A. Beginning on July 1, 2024, five per cent (5%) of all state
57	57	contracts shall be awarded to busines ses that have been in operation
58	58	for less than five (5) years.
59	59	B. For competitive bids submitted to the state pursuant to the
60	60	Oklahoma Central Purchasing Act or pursuant to the Public
61	61	Competitive Bidding Ac t of 1974 by eligible new corporations, the
62	62	State Purchasing Director shall prepare and implement a bid-
63	63	preference program. The program shall require that if the

90	90	percentage of such funds expended on eligible new corporations is
91	91	less than ten percent (10% ), a percentage shall be added to the
92	92	price of the lowest bid, and if the eligible new corporation submits
93	93	a bid that falls below the lowest bid plus the percentage, it sha ll
94	94	receive the contract. As used in this subsection, "eligible new
95	95	corporation" means a corporation validly licensed as provided in the
96	96	applicable laws of this state on an d after the effective date of
97	97	this act.
98	98	SECTION 2. This act shall become effecti ve January 1, 2024.
