52 | 49 | | SECTION 1. AMENDATORY 21 O.S. 2021, Section 1992, is |

56 | 53 | | B. Any person who knowingly and maliciously projects a laser, |

59 | 56 | | within the scope of the official duties of the officer shall , upon |
---|
60 | 57 | | conviction, be guilty of a misdemeanor and upon conviction shall be |

151 | 146 | | 3. By an individual using a laser emergency signaling device to |

152 | 147 | | send an emergency distr ess signal. |
---|
153 | 148 | | E. As used in this section: |
---|
154 | 149 | | 1. "Laser" or "laser pointer" means any device designed or used |
---|
155 | 150 | | to amplify electromagnetic radiation by stimulated emission that |
---|
156 | 151 | | emits a beam designed to be used by the operator as a point er or |
---|
157 | 152 | | highlighter to indic ate, mark or identify a specific position, |
---|
158 | 153 | | place, item or object; and |
---|
159 | 154 | | 2. "Law enforcement officer " means any police officer, peace |
---|
160 | 155 | | officer, sheriff, deputy sheriff, correctional offic er, probation or |
---|
161 | 156 | | parole officer, emergency man agement employee, judge, m agistrate, or |
---|
162 | 157 | | any employee of a governmental agency who is authorized by law to |
---|
163 | 158 | | engage in the investigation, arres t, prosecution, or supervision of |
---|
164 | 159 | | the incarceration of any person for any violation of law and has |
---|
165 | 160 | | statutory powers of arrest. |
