51	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
52	49		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1992, is
53	50		amended to read as fol lows:
54	51		Section 1992. A. This section sha ll be known and may be cited
55	52		as the "Laser Safety Act".
56	53		B. Any person who knowingly and maliciously projects a laser,
57	54		as defined in this sect ion, on or at a law enforcement officer
58	55		without the consent of the office r while the officer is acting
59	56		within the scope of the official duties of the officer shall , upon
60	57		conviction, be guilty of a misdemeanor and upon conviction shall be
61	58		punished punishable by a fine of not more than One Hundred Dollars
62	59		($100.00) Five Hundred Dollars ($500.00), or by imprisonment in the
63	60		county jail for a period of no t more than one (1) year, or by both

91	87		such fine and imprisonment. Any person who commits a second or
92	88		subsequent violation of this section shall , upon conviction, be
93	89		guilty of a misdemeanor felony punishable by a fine of not more than
94	90		Five Hundred Dollars ($500.00) One Thousand Dollars ($1, 000.00), a
95	91		term of or by imprisonment in the county jail custody of the
96	92		Department of Corrections for a period of not more than six (6)
97	93		months two (2) years, or by both such fine and impris onment.
98	94		C. Anyone who knowingly aims the beam of a laser pointer at a n
99	95		aircraft in flight or at the flight path of an aircraft shall , upon
100	96		conviction, be guilty of a misdemeanor and upon conviction shall be
101	97		punished felony punishable by a fine of not more than One Hundred
102	98		Dollars ($100.00) One Thousand Dollars ($1,000.00), or by
103	99		imprisonment in the custody of the Depar tment of Corrections for a
104	100		period of not less than three (3) months nor more than two (2)
105	101		years, or by both such fine and impr isonment. Any person who
106	102		commits a second or subsequent violation of this section s hall, upon
107	103		conviction, be guilty of a misdemeanor felony punishable by a fine
108	104		of not more than Five Hundred Dollars ($500.00) Five Thousand
109	105		Dollars ($5,000.00), a term of or by imprisonment in the county jail
110	106		custody of the Depar tment of Corrections for a period of not less
111	107		than one (1) year nor more than six (6) months five (5) years, or by
112	108		both such fine and imprisonment.
113	109		D. This section does no t prohibit aiming a beam of a laser
114	110		pointer at an aircraft, or the flight path of such an aircraft by:

142	137		1. An authorized individual in the conduct of researc h and
143	138		development or fligh t test operations conducted by an aircraft
144	139		manufacturer, the Federal Avia tion Administration, or any other
145	140		person authorized by the Federal Aviation Administration to conduct
146	141		research and development or flight test operations;
147	142		2. Members or elements of th e Department of Defense or
148	143		Department of Homeland Security acting in an o fficial capacity for
149	144		the purpose of resea rch, development, operations, testing or
150	145		training; or
151	146		3. By an individual using a laser emergency signaling device to
152	147		send an emergency distr ess signal.
153	148		E. As used in this section:
154	149		1. "Laser" or "laser pointer" means any device designed or used
155	150		to amplify electromagnetic radiation by stimulated emission that
156	151		emits a beam designed to be used by the operator as a point er or
157	152		highlighter to indic ate, mark or identify a specific position,
158	153		place, item or object; and
159	154		2. "Law enforcement officer " means any police officer, peace
160	155		officer, sheriff, deputy sheriff, correctional offic er, probation or
161	156		parole officer, emergency man agement employee, judge, m agistrate, or
162	157		any employee of a governmental agency who is authorized by law to
163	158		engage in the investigation, arres t, prosecution, or supervision of
164	159		the incarceration of any person for any violation of law and has
165	160		statutory powers of arrest.
