5454 BE IT ENACTED BY THE PEOPLE OF THE STATE O F OKLAHOMA:
5555 SECTION 1. AMENDATORY 59 O.S. 2021, Section 650, is
5656 amended to read as follows:
5757 Section 650. A. This act section shall be known and may be
5858 cited as the “Oklahoma Interventional Pain Management and Treatment
5959 Act”.
6060 B. As used in this section:
6161 1. "Chronic pain" means a pain state which is subacute,
6262 persistent and intractable;
6363 2. “Fluoroscope” means a radiologic instrument equipped with a
6464 fluorescent screen on which opa que internal structures ca n be viewed

9191 as moving shadow images formed by the differential transmission of
9292 X-rays throughout the body
9393 "Fluoroscopy" means a medical imaging procedure that uses an X-
9494 ray beam to take real-time footage of moving internal body parts
9595 such as bones, muscles, joints, organs, and tissue to display a
9696 consistent radiographic picture progressively onto a screen ; and
9797 3. "Interventional pain management " means the practice of
9898 medicine delivery of health care servic es devoted to the diagnos is
9999 and treatment of chroni c pain, through the use of such techniques
100100 as:
101101 a. ablation of targeted nerves,
102102 b. percutaneous precision needle place ment within the
103103 spinal column with placement of drugs such as local
104104 anesthetics, steroid s, and analgesics in targeted
105105 areas of the spinal c olumn, or
106106 c. surgical techniques, such as laser or endoscopic
107107 diskectomy, intrathecal infusion pumps and spinal cord
108108 stimulators, or
109109 d. fluoroscopy.
110110 C. It shall be unlawful to practice or offer to practic e
111111 interventional pain man agement in this state unle ss such person has:
112112 1. Has been duly licensed under the provisions of the Oklahoma
113113 Allopathic Medical and Surgical L icensure and Supervision Act or the
114114 Oklahoma Osteopathic Medicine Act; or

141141 2. Is a certified registered nurse ane sthetist licensed in
142142 accordance with the Oklahoma Nurs ing Practice Act who holds a valid
143143 certification in Non surgical Pain Management from the National Board
144144 of Certification and Recertification for Nurse Anesthetists and
145145 practices in accordance with the certification.
146146 D. Nothing in this section shall be construed to forbid the
147147 administration of lumbar intra -laminar epidural steroid injections
148148 or peripheral nerve blocks by a certified registered nurse
149149 anesthetist when requested to do so by a physician and under the
150150 supervision of A certified registered nurse anesthetist who meets
151151 the criteria of subsection C of this section may:
152152 1. Practice interventional pain management , except for surgical
153153 techniques, in collaboration with an allopathic or osteopathic
154154 physician licensed in this s tate and under conditions in which
155155 timely on-site consultation by such allopathic or osteopathic
156156 physician is availab le.
157157 E. A certified registered nurse anesthetist shall no t operate;
158158 2. Operate a freestanding pain management fa cility without
159159 direct supervision of a in collaboration with an allopathic or
160160 osteopathic physician who is board -certified in interventional pa in
161161 management or its equivalent ; and
162162 3. Perform procedural sedation.
163163 E. Nothing in this section shall authorize a Certified
164164 Registered Nurse Anesthetist to prescribe or dispense any opioid or

191191 any other controlled dangerous substance to be taken by the pa tient
192192 off-site for the management of chronic pain .
193193 SECTION 2. This act shall become effective November 1, 2023.
