40	40	An Act relating to health care; amending 59 O.S.

42	42	pain management; modifying, adding, and deleting
43	43	definitions; authorizing certified registered nurse
44	44	anesthetist to provide certain services and operate
45	45	certain facilities under specified condition s;
46	46	providing certain construction; and providin g an

54	54	BE IT ENACTED BY THE PEOPLE OF THE STATE O F OKLAHOMA:
55	55	SECTION 1. AMENDATORY 59 O.S. 2021, Section 650, is
56	56	amended to read as follows:
57	57	Section 650. A. This act section shall be known and may be
58	58	cited as the “Oklahoma Interventional Pain Management and Treatment
59	59	Act”.
60	60	B. As used in this section:
61	61	1. "Chronic pain" means a pain state which is subacute,
62	62	persistent and intractable;
63	63	2. “Fluoroscope” means a radiologic instrument equipped with a
64	64	fluorescent screen on which opa que internal structures ca n be viewed

92	92	X-rays throughout the body
93	93	"Fluoroscopy" means a medical imaging procedure that uses an X-
94	94	ray beam to take real-time footage of moving internal body parts
95	95	such as bones, muscles, joints, organs, and tissue to display a
96	96	consistent radiographic picture progressively onto a screen ; and
97	97	3. "Interventional pain management " means the practice of
98	98	medicine delivery of health care servic es devoted to the diagnos is
99	99	and treatment of chroni c pain, through the use of such techniques
100	100	as:
101	101	a. ablation of targeted nerves,
102	102	b. percutaneous precision needle place ment within the
103	103	spinal column with placement of drugs such as local
104	104	anesthetics, steroid s, and analgesics in targeted
105	105	areas of the spinal c olumn, or
106	106	c. surgical techniques, such as laser or endoscopic
107	107	diskectomy, intrathecal infusion pumps and spinal cord
108	108	stimulators, or
109	109	d. fluoroscopy.
110	110	C. It shall be unlawful to practice or offer to practic e
111	111	interventional pain man agement in this state unle ss such person has:
112	112	1. Has been duly licensed under the provisions of the Oklahoma
113	113	Allopathic Medical and Surgical L icensure and Supervision Act or the
114	114	Oklahoma Osteopathic Medicine Act; or

141	141	2. Is a certified registered nurse ane sthetist licensed in
142	142	accordance with the Oklahoma Nurs ing Practice Act who holds a valid
143	143	certification in Non surgical Pain Management from the National Board
144	144	of Certification and Recertification for Nurse Anesthetists and
145	145	practices in accordance with the certification.
146	146	D. Nothing in this section shall be construed to forbid the
147	147	administration of lumbar intra -laminar epidural steroid injections
148	148	or peripheral nerve blocks by a certified registered nurse
149	149	anesthetist when requested to do so by a physician and under the
150	150	supervision of A certified registered nurse anesthetist who meets
151	151	the criteria of subsection C of this section may:
152	152	1. Practice interventional pain management , except for surgical
153	153	techniques, in collaboration with an allopathic or osteopathic
154	154	physician licensed in this s tate and under conditions in which
155	155	timely on-site consultation by such allopathic or osteopathic
156	156	physician is availab le.
157	157	E. A certified registered nurse anesthetist shall no t operate;
158	158	2. Operate a freestanding pain management fa cility without
159	159	direct supervision of a in collaboration with an allopathic or
160	160	osteopathic physician who is board -certified in interventional pa in
161	161	management or its equivalent ; and
162	162	3. Perform procedural sedation.
163	163	E. Nothing in this section shall authorize a Certified
164	164	Registered Nurse Anesthetist to prescribe or dispense any opioid or

191	191	any other controlled dangerous substance to be taken by the pa tient
192	192	off-site for the management of chronic pain .
193	193	SECTION 2. This act shall become effective November 1, 2023.
