12	43		An Act relating to alcoholic beverages; providing
13	44		that a holder of a small fa rm winery, winemaker, or
14	45		small brewer license may serve free samples and s ell
15	46		other items; providing that wine or beer may be
16	47		served at off-premises locations; providing that at
17	48		public events the location occupied by the small farm
18	49		winery, winemaker, or small brewer licensee becomes a
19	50		licensed premises and extension of the license
20	51		holder; requiring a licens ee to establish a serving
21	52		area; providing that multiple licensees may combine
22	53		their serving areas; providing that a small farm
23	54		winery, winemaker, or small brewer licensee shall not
24	55		be required to control a consumer leaving the
25	56		premises once served; providing there shall not be
26	57		any permit or license require d by the event

33	65		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	66		SECTION 1. NEW LAW A new section of law to be codified
36	67		in the Oklahoma Statutes as Section 2-162 of Title 37A, unless there
37	68		is created a duplication in numbering, reads as follows:

39	69		A holder of a small farm winery, winemaker, or small brewer
40	70		license, which serves wi ne or beer for on-premises or off-premises

42	99		the property owner, shall be allowed to serve free samples of, sell,
43	100		or serve Oklahoma-manufactured beer, wine, mulled wine, or spiced
44	101		wine, mixed with nonalcoholic beverages or food items, such as
45	102		water, sugar, fruits and vegetables, at any temperature, wine

47	104		including but not limited to festivals, trade shows, boat shows, RV
48	105		shows, home and garden shows, fairs, car shows, swap meets, sport ing
49	106		events, city events, county events, state events, for either on-
50	107		premises or off-premises consumption, including any public events
51	108		that are held at the premises which hold a retail beer license,
52	109		retail spirits license, mixed beverage license, beer and wine
53	110		license, caterer's license, special event license, public event
54	111		license, winemaker license, small farm winery license, charitable
55	112		auction license, or brewpub license. When attending a public event ,
56	113		the location within the event occupied by the small farm wi nery,
57	114		winemaker, or small brewer licensee becomes a licensed premises and
58	115		extension of the licensed small farm winery, winemaker, or small
59	116		brewer license. The licensee shall set up and define an area
60	117		contiguous to their booth space as a serving area where the wine or
61	118		beer is dispensed. The licensee may only serve the wine or beer in
62	119		the serving area. In the event that multiple winemakers or small
63	120		brewers are at the same public event, they may combine their serving
64	121		areas into one area as long as they are contiguous to the

66	150		winemaker, or small brewer licensee shall not be required to cont rol
67	151		the consumer leaving the premises once served Oklahoma-manufactured
68	152		beer, wine, mulled wine, or spiced wine, mixed with nonalcoholic
69	153		beverages or food items , such as water, sugar, fruits and
70	154		vegetables, at any temperature, wine produced at the winery or
71	155		blended on-site at the public event. There shall not be an y special
72	156		permit, permit, or license required by the event originator,
73	157		coordinator, manager, or property owner to have a small farm winery,
74	158		winemaker, or small brewer licensee at his or her event.
