3099 SECTION 1. AMENDATORY 2 O.S. 2021, Section 3 -82, as
31100 amended by Section 11, Chapter 72, O.S.L. 2023 (2 O.S. Supp. 2023,
32101 Section 3-82), is amended to read as follows:

34102 Section 3-82. A. It shall be unlawful for any person to act,
35103 operate, or do business or advertise as a commercial, noncommercial,
36104 certified applicator, temporary certified applicator, service
37105 technician, or private applicator unless the person has obtained a
38106 valid applicator’s license issued by the State Board of Agriculture
39107 for the category of pesticide application in which the person is
40108 engaged, unless the person is applying to their his or her own
41109 property.

43110 B. A license may be is sued by the Board in any category of
44111 pesticide application if the applicant qualifies and the applicant
45112 is limited to the category of pesticide application named on the
46-license. The Board may establish categorie s of pesticide ENR. H. B. NO. 2185 Page 2

47114 application as necessary. Li censes shall be issued upon application
48115 to the Board on a form prescribed by the Board. The application

57149 conducting agricultural operations , and a copy of any other
58150 applicable certification as required by the Federal Aviation
59151 Administration for pesticide application . Applicants for an aerial
60152 license and pilots working under a license may be subject to a
61153 complete and thorough background examination.

63154 2. The Board shall promulgate rules regarding aerial
64155 applicators and applications consistent with federal law and shall
65156 solicit the assistance of the Federal Aviation Administration in the
66157 enforcement of this subsection .

68158 D. Each business location shall require a separate license and
69159 separate certified applicator except that a certified applicator for
70160 a noncommercial business location may also serve as the certified
71161 applicator for one commercial business location.

73162 E. A license shall not be issued for the category of pesticide

92203 3. The Board shall, to the extent practical, create uniformity
93204 between the requirements of Oklahoma and those prescribed by the
94205 Federal Insecticide, Fungicide , and Rodenticide Act.

96206 4. The Board is empowered to coop erate with and negotiate
97207 reciprocal agreements with the federal government or any state, or
98208 any department or agency of either for the purpose of fulfilling the
99209 intent of this section and securing uniformity of rules.

101210 5. The Board may inspect any work, re cords, or contracts of
102211 each applicator, manufacturer, or dealer to determine whether or not
103212 the work is performed according to the provisions of this section or
104213 rules promulgated thereunder.

106214 6. For the purpose of securing uniformity of rules, no city,
107215 town, county, or other political subdivision of this state shall
108216 adopt or continue in effect any ordinance, rule, regulation, or
109217 statute regarding pesticide sale or use that is more stringent than
110218 the rules of the Board , including, but not limited to, registr ation,
111219 notification, posting, advertising and marketing, distribution,
112220 applicator training and certification, storage, transportation,
113221 disposal, disclosure of confidential information, or product
114222 composition.

116249 7. The Board may take samples of pesticide mat erials in order
117250 to determine their concentration or residue level. If the Board
118251 finds that such samples are not within established standards, the
119252 Board’s finding shall be considered prima facie evidence that a
120253 violation has occurred.

122254 a. The concentration of an active ingredient for a
123255 pesticide concentrate , shall not exceed or be less
124256 than the concentration of active ingredient stated on
125257 the pesticide label by more or less than the tolerance
126258 for active ingredient concentration specified by this

232456 the state stated concentration on the pesticide
233457 label when analyzed,

235458 (2) when the stated concentration of active

254501 pesticide tank mix, as stated by the applicator and
255502 allowed by the pesticide label, shall not exceed or be

257504 stated by more or less than the tolerance for active
258505 ingredient concentration specified by this paragraph.
259506 Concentrations above or below the established
260507 tolerance shall be prima facie evidence of a use
261508 unsuitable, unsafe o r inconsistent with its label or
262509 labeling. No pesticide shall be formulated into a
263510 tank mix at a concentration in excess of or below that
264511 permitted by the pesticide label without written
265512 approval from an authorized agent of the Oklahoma
266513 Department of Agriculture, Food, and Forestry:

268514 (1) when the stated concentration or that allowed by
269515 the pesticide label is less than 0.51% fifty-one-
270516 hundredths of one percent (0.51%), the minimum

329647 e. The State Board of Agriculture may promulgate, by
330648 rule, maximum and minimum concentrations or thresholds
331649 for the other concentrate of pesticides in products,
332650 or soil residues.

334651 B. If registered by the United States Environmental Protection
335652 Agency, registered in Oklahoma, and used in accordance with all
336653 requirements as prescribed by the product label, any borate -based
337654 pesticide for termite control may be applied as a stand -alone
338655 termite treatment.

340656 C. Authorized agents of the Board shal l have the authority to
341657 issue notices of violation, citations, compliance orders, stop
342658 sales, or stop work orders to those persons committing violations of
343659 the laws or rules relating to pesticides or pesticide application in
344660 this state.

346661 C. D. 1. Examinations of pesticides or devices shall be made
347662 under the direction of the Board for the purpose of determining if
348663 there has been compliance with the requirements of this section.

350664 2. If it appears from examination that a pesticide or device
351665 fails to comply with the provisions of this section, and the Board
352666 contemplates instituting administrative proceedings against any
353667 person, the Board shall cause notice and an opportunity for a
354668 hearing given to the person pursuant to the Administrative
355669 Procedures Act.

357696 D. E. 1. Any pesticide or device distributed, sold, or offered
358697 for sale within this state or delivered for transportation or
359698 transported in intrastate or interstate commerce may be seized by
360699 the Oklahoma Department of Agriculture, Food, and Forestry in any
361-county of the state where it may be found and if: ENR. H. B. NO. 2185 Page 9

363701 a. in the case of a pesticide, it is adulterated or
364702 misbranded, it has not been registered, it fails to
365703 bear on its label the required information, or it is a
366704 white powder pesticide and it is not colored as
367705 required, or

369706 b. in the case of a device, it is misbranded.

371707 2. If the pesticide or device is condemned it shall, after
372708 entry of decree or judgment of a district court, be disposed of by
373709 destruction or sale as the court may direct. If the article is
374710 sold, the proceeds, less court costs, shall be paid to the State
375711 Department of Agriculture Revolving Fund.

377712 3. The court shall not order the sale or disposal of a
378713 condemned pesticide or device in a manner which would be a violation
379714 of this section or rules promulg ated thereto.

381715 4. The person or entity directed to dispose or sell the
382716 condemned pesticide or device shall do so in a manner that complies
383717 with the order of the district court and this section and rules
384718 promulgated thereto.

386745 5. The court may direct that th e pesticide or article be
387746 delivered to the owner for relabeling or reprocessing.

389747 6. If there is a person who is successful in intervening as
390748 claimant of the pesticide or device, when a decree of judgment of
391749 condemnation is entered against the pesticide or device, court
392750 costs, fees, storage, and other proper expenses shall be awarded
393751 against such claimant.

395752 E. F. The Board may, by publication in a manner as it may
396753 prescribe, give notice of all judgments entered in action,
397754 instituted under its authority.

399755 F. G. All authority vested in the Board shall with like force
400756 and effect be executed by its officers, employees, and authorized
401757 agents.

403758 G. H. EXCEPTION – The fines provided for violations may not
404759 apply to:

406760 1. Any carrier while lawfully engaged in transport ing a
407761 pesticide within this state, if the carrier permits the Board upon
408762 request to copy all records showing the transaction in and movement
409763 of the pesticide and devices involved;

411764 2. Public officials of this state and of the Federal Government
412765 federal government engaged in the performance of official duties;

414766 3. The manufacturer or shipper of a pesticide or device for
415767 experimental use only, by or under the supervision of an agency of
416768 this state or of the Federal Government federal government

418796 devices, or by others if the pesticide or the device is not sold or
419797 if the container is plainly and conspicuously marked “for
420798 experimental use only - not to be sold”, together with the
421799 manufacturer’s name and address, if a written permit has been
422800 obtained from the Board. Pesticides or devices may be sold for

455852 I. J. This section shall not prevent any political subdivision
456853 from complying with any applicable federal law or regulat ion. A
457854 political subdivision which takes any action prohibited by this
458855 title in order to comply with federal requirements shall notify the
459856 Board of its compliance plan prior to taking any action. The Board
460857 may assist the political subdivision in complyin g with federal
461858 requirements necessary to carry out the policy of this section. The
462859 Board may permit a political subdivision to impose standards more
463860 stringent than required by the Board if necessary for the political
464861 subdivision to comply with federal req uirements.

466862 SECTION 3. It being immediately necessary for the preservation

954+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
955+SECTION 4. AMENDATORY 2 O.S. 2021, Section 3-82, as
956+amended by Section 11, Chapter 72, O.S.L. 2023 (2 O.S. Supp. 2023,
957+Section 3-82), is amended to read a s follows:
958+Section 3-82. A. It shall be unlawful for any person to act,
959+operate, or do business or ad vertise as a commercial, noncommercial,
960+certified applicator, temporary certified applicator, servi ce
961+technician, or private applicator unless the person has obtained a
962+valid applicator's license issued by the State Board of Agriculture
963+for the category of pesticide application in which the person is
964+engaged, unless the person is applying to their own p roperty.
965+B. A license may be issued by the Board in an y category of
966+pesticide application if the applicant qualifies and the applicant

993+is limited to the category of pesticide application named on the
994+license. The Board may establish categories of pestici de
995+application as necessary. Licenses shall be issued upon application
996+to the Board on a form prescribed by the Board. The application
997+shall contain information regarding the applicant's qualifications,
998+proposed operations, and other information as speci fied by the
999+Board.
1000+C. 1. An aerial license shall not be issued or be valid unless
1001+the applicant files with the Board a copy of a valid document issued
1002+by the Federal Aviation Administration showing that the person is
1003+qualified to operate or supervise the operation of an aircraft
1004+conducting agricultural opera tions. Applicants for an aerial
1005+license and pilots working under a license may be subject to a
1006+complete and thorough background examination.
1007+2. The Board shall promulgate rules regarding aerial
1008+applicators and applications consistent with federal law and shall
1009+solicit the assistance of the Federal Aviation Administration in the
1010+enforcement of this subsection.
1011+D. Each business location shall require a separate license and
1012+separate certified applica tor except that a certified applicator for
1013+a noncommercial business location may also serve as the certified
1014+applicator for one commercial business location.
