5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. AMENDATORY 22 O.S. 2021, Section 1105.3, is
5252 amended to read as foll ows:
5353 Section 1105.3 A. Any county pursuant to the provisions of the
5454 Pretrial Release Act may establish and fund a pretrial program to be
5555 utilized by the district court in th at jurisdiction.
5656 B. 1. When a pretrial release program is established pursuant
5757 to the Pretrial Release Act and private bail has not been furnished,
5858 the judge may order a person to be evaluated through the pretrial
5959 program. After conducting an evaluation of the person applying for
6060 pretrial release, the pretrial program shall make a r ecommendation
6161 to the court. The recomm endation shall indicate any special
6262 supervisory conditions for pretrial release. The judge shall

8989 consider the recommendations and may grant or deny pretrial release.
9090 The presiding judge of the judicial district may issue a standing
9191 order outlining criter ia for cases that may automatically be
9292 evaluated for pretrial release by a pretrial program operating in
9393 the jurisdiction. The standing ord er may include amounts for bail
9494 and types of bonds deemed appropriate for cer tain offenses.
9595 2. When a pretrial release program is established pursuant to
9696 the Pretrial Release Act, the pr etrial program may conduct a
9797 criminal background investigation on all defenda nts arrested and
9898 placed in custody in a county jail and shall provide a copy of the
9999 criminal background investigation to the court for the purpose of
100100 conducting individualized bail hearings.
101101 C. Except as otherwise authorized by the provisions of this
102102 subsection, persons accused of or detained for any of the following
103103 offenses or conditions shall not be eligible for pretrial release by
104104 any pretrial program:
105105 1. Aggravated driving under the influence of an intoxicating
106106 substance;
107107 2. Any felony driving under the influence of an intoxicating
108108 substance;
109109 3. Any offense prohibit ed by the Trafficking In Illeg al Drugs
110110 Act;
111111 4. Any person having a violent felony conviction within the
112112 past ten (10) years;

140140 6. Arson in the first degree, including attempts to commit

142142 7. Assault and battery on a police officer;

147147 12. Distribution of a controlled dangerous substance, including

189189 23. Murder in the first degree, including attempts or
190190 conspiracy to commit murder in the first degree;
191191 24. Murder in the second degree, including attempts or
192192 conspiracy to commit murder in the second degree;
193193 25. Negligent homicide;
194194 26. Out-of-county holds;
195195 27. Persons currently on pretrial release who are arrested on a
196196 new felony offense;
197197 28. Possession, manufacture, use, sale or delivery of an
198198 explosive device;
199199 29. Possession of a controlled dangerous substance on Schedule
200200 I or II of the Controlled Dangerous Substances Act;
201201 30. Possession of a firearm or other offensive weapon during
202202 the commission of a felony;
203203 31. Possession of a stolen vehi cle;
204204 32. Rape in the first de gree, including attempts to commit rape
205205 in the first degree;
206206 33. Rape in the second degree, including attempts to commit
207207 rape in the second degree;
208208 34. Robbery by force or fear;
209209 35. Robbery with a firearm or dangerous weapo n, including
210210 attempts to commit robbery with a firearm or dangerous weapon;
211211 36. Sexual assault or violent offenses against children;

239239 38. Stalking or violation of a Victim Protection Order;
240240 39. Two or more prior felony convictions; or
241241 40. Unauthorized use of a motor vehicle.
242242 D. Other than a person accused of or detained for an offense
243243 provided for in paragraph 13 or paragraph 38 of subsection C of this
244244 section, a person not eligible for pretrial release pursuant to the
245245 provisions of subsection C of this section may be released upon
246246 order of a district judge, associate district judge or special judge
247247 under conditions prescribed by the judge, which may include an order
248248 to require the defendant, as a condition of pretrial release, to use
249249 or participate in any monitoring or testing including, but not
250250 limited to, a Global Positioning System (GPS) monitoring device and
251251 urinalysis testing. The court may further order the defendant to
252252 pay costs and expenses related to any super vision, monitoring or
253253 testing.
254254 E. Every pretrial services program operating pursuant to the
255255 provisions of the Pretrial Release Act shall meet the following
256256 minimum criteria:
257257 1. The program shall establish a procedure for screening and
258258 evaluating persons who are detained or have been arrested for the
259259 alleged commission of a crime. The program shall obtain criminal
260260 history records on detained persons through the National Crime
261261 Information Center (NCIC). The information obtained from the
262262 screening and evaluation process must be submitt ed in a written

289289 report without unnecessary delay to the judge who is assigned to
290290 hear pretrial release applications when the person is eligible for
291291 pretrial release;
292292 2. The program shall provide reliable information to the ju dge
293293 relating to the person app lying for pretrial release so a reasonable
294294 decision can be made concerning the amount and type of bail
295295 appropriate for pretrial release. The information provided shall be
296296 based upon facts relating to the person 's risk of danger to the
297297 community and the ri sk of failure to appear for court; and
298298 3. The program shall make all reasonable attempts to provide
299299 the court with information appropriate to each person considered for
300300 pretrial release.
301301 F. A pretrial program established pur suant to the Pretrial
302302 Release Act may provide different methods and levels of community -
303303 based supervision to meet any court -ordered conditions of release.
304304 The program may use existing supervision methods for persons who are
305305 released prior to trial. Pretr ial programs which employ peac e
306306 officers certified by the Council on Law Enforcement Education and
307307 Training (CLEET) are authorized to enforce court -ordered conditions
308308 of release.
309309 G. Each pretrial program established pursuant to the Pretrial
310310 Release Act shall provide a quarterly report to the presiding judge
311311 of the judicial district of the jurisdiction in which it operates.
312312 A copy of the report shall be filed of record with the court clerk

339339 of the jurisdiction. Each report shall include, but is not limited
340340 to, the following information :
341341 1. The total number of persons screened, evaluated or otherwise
342342 considered for pretrial release;
343343 2. The total number and nature of recommendations made;
344344 3. The number of persons admitted to pretrial release that
345345 failed to appear; and
346346 4. Any other information deemed appropriate by the reporting
347347 judicial district or that the program desires to report.
348348 H. Every pretrial release program established pursuant to this
349349 section shall utilize the services of local providers; provi ded,
350350 however, any program in c ontinuous existence since July 1, 1999,
351351 shall be exempt from the provisions of this subsection.
352352 SECTION 2. This act shall become effective November 1, 2023.
