4942 An Act relating to motor vehicles; amending 47 O.S.

5245 11-901d), which relates to text messaging; modifying
5346 types of devices unlawful to us e while operating a

5548 fees; directing distribution of fine, costs, and
5649 fees; allowing for the use of certain technologies;
5750 modifying definition; disal lowing confiscation of
5851 certain devices and in formation; making certain

6560 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6661 SECTION 1. AMENDATORY 47 O.S. 2021, Section 11 -901d, as
6762 amended by Section 93, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 2022,
6863 Section 11-901d), is amended to read as follows:
64+Section 11-901d. A. It While a motor vehicle is in motion, it
65+shall be unlawful for any person to operate a motor vehicle on any
66+street or highway within this state while using:

96-Section 11-901d. A. It While a motor vehicle is in motion, it
97-shall be unlawful for any person to operate a motor vehicle on any
98-street or highway within this state while using:
9993 1. Using a hand-held electronic communication device or
10094 cellular telephone to manually compose, send or read an electronic
10195 text message while the motor vehicle is in motion; or
10296 2. Holding or using a h and-held cellular telephone.
10397 B. Any person who violates the provisions of subsection A of
10498 this section shall, upon con viction, be punished by a fine of not
10599 more than One Hundred Dollars ($100.00) Five Dollars ($5.00) and
106100 costs and fees not to exceed Ninety-five Dollars ($95.00). The
107101 court clerk shall collect the fine, costs, and fees and direct their
108102 distribution as follows:
109103 1. The sum of Thirty-three Dollars and seventy-two cents
110104 ($33.72) for each offense of which the defendant is convicted,
111105 irrespective of whether the sentence is deferred, shall cover
112106 docketing of the case, filing of all papers, issuance of process,
113107 warrants, order, and other services to the date of judgment;
114108 2. The sum of Eight D ollars and eighty cents ($8.80) shall be
115109 assessed and credited to the District Attorneys Council Revolving
116110 Fund, created pursuant to Section 215.28 of Title 19 of the Oklahoma
117111 Statutes, to defray the cost of prosecu tion;
118112 3. The sum of Eleven Dollars ($11. 00) shall be assessed and
119113 credited to the Oklahoma Court I nformation System Revolving Fund ,
114+created pursuant to Section 1315 of Title 20 of the Oklahoma
115+Statutes;

147-created pursuant to Section 1315 of Title 20 of the Oklahoma
148-Statutes;
149142 4. The sum of Four Dollars a nd fifty cents ($4.50) shall be
150143 assessed and credited to the She riff's Service Fee Account of the
151144 county in which the conv iction occurred for the purpose of enhancing
152145 existing or providing ad ditional courthouse security;
153146 5. The sum of One Dollar and thirt y cents ($1.30) shall b e
154147 assessed and credited to the Office of the Attorney General Victim
155148 Services Unit;
156149 6. The sum of One Dollar and thirty cents ($1.30) shall be
157150 assessed and credited to the Child Abuse Multidisciplinary Acc ount,
158151 created pursuant to S ection 1-9-103 of Title 10A of the Oklahoma
159152 Statutes;
160153 7. The sum of Two Dollars and twenty -five cents ($2.25) shall
161154 be assessed and credited to the Sheriff 's Service Fee Account of the
162155 sheriff of the county in which the arrest was made;
163156 8. The sum of Four Dollars and fifty cen ts ($4.50) shall be
164157 assessed and credited to the Council on Law Enforcement Education
165158 and Training (CLEET) Fund, created pursuant to Section 1313.2 of
166159 Title 20 of the Oklahoma Statutes;
167160 9. The sum of Four Dollars and fifty cents ($4 .50) shall be
168161 assessed. Four Dollars and ten cents ($4.10) of e ach fine, cost,
169162 and fee received pursuant to this paragrap h shall be credited to the
170163 A.F.I.S. Fund, pursuant to Section 150.25 of Title 74 of the
164+Oklahoma Statutes, and the remaining balance shall be deposited in
165+the General Revenue Fund by the court clerk. The payments shall be

198-Oklahoma Statutes, and the remaining balance shall be deposited in
199-the General Revenue Fund by the court clerk. The payments shall be
200192 made to the appropriate fund by t he court clerk on a monthly basis
201193 as set forth by subsection I of Section 1313.2 of Title 20 of the
202194 Oklahoma Statutes;
203195 10. The sum of Four Dollars and fifty cents ($4.50) shall be
204196 assessed. Four Dollars and twenty -eight cents ($4.28) of each fee
205197 received pursuant to this paragraph shall b e collected and sent to
206198 the Oklahoma State Bureau of Investigation f or deposit into the
207199 Forensic Science Improvement Revol ving Fund, pursuant to Section
208200 150.35 of Title 74 of the Oklahoma Statutes. The remaining balance
209201 shall be retained by the municipal court clerk;
210202 11. The sum of Nine Dollars ($9.00) shall be assessed and
211203 forwarded monthly in one ch eck or draft to the Dep artment of Public
212204 Safety to be deposited in the Department of Public Safety Patrol
213205 Vehicle Revolving Fund, created pursuant to Section 2 -143 of this
214206 title;
215207 12. Pursuant to subsection C of Sectio n 220 of Title 19 of the
216208 Oklahoma Statutes, the court clerk s hall assess an administrative
217209 fee of ten percent (10%) on fines, costs, and fees assessed in
218210 paragraphs 2, 4, 5, 6, 8, 9, 10 , and 11 of this subsection which
219211 shall be deposited in the Court Clerk 's Revolving Fund; and
220212 13. Pursuant to subsection D of Secti on 220 of Title 19 of the
221213 Oklahoma Statutes, the court clerk shall assess an administrative
214+fee of fifteen percent (15%) on fines, costs, and fees assessed in

249-fee of fifteen percent (15%) on fines, costs, and fees assessed in
250241 paragraphs 2, 4, 5, 6, 8, 9, 10 , and 11 of this subsection which
251242 shall be deposited in the District Court Revolving Fund.
252243 C. The Department of Public Safety shall not record or assess
253244 points for violations of this section on any license holder's
254245 traffic record maintained by Service Oklahoma.
255246 D. The provisions of subsection A of this section shall not
256247 apply if the person is using the cellular tel ephone or electronic
257248 communication device for:
258249 1. In conjunction with hands-free or voice-operated technology;
259250 or
260251 2. For the sole purpose of communicating with any of the
261252 following regarding an imminent emergency situation:
262253 1. An
263254 a. an emergency response operator;,
264255 2. A
265256 b. a hospital, physician's office or health clinic;,
266257 3. A
267258 c. a provider of ambulance services;,
268259 4. A
269260 d. a provider of firefighting services;, or
270261 5. A
271262 e. a law enforcement agency.
263+E. Municipalities may enact and municipal police officers may
264+enforce ordinances prohibiting and penalizing conduct under the

299-E. Municipalities may enact and municipal police officers may
300-enforce ordinances prohibiting and penalizing conduct under the
301291 provisions of this section. The provisions of such ordinances shall
302292 be the same as provided for in this section; the enforcement
303293 provisions of those ordinances shall not be more stringent than
304294 those of this section; and the fine and court costs for municipal
305295 ordinance violations shal l be the same or a lesser amount as
306296 provided for in this section.
307297 F. For the purpose of this section:
308298 1. "Cellular telephone" means an analog or digital wireless
309299 telephone authorized by the Federal Communications Commission to
310300 operate in the frequency bandwidth reserved for cellular telephones;
311301 2. "Compose", "send" or "read" with respect to a text message
312302 means the manual entry, sending or retrieval of a text message to
313303 communicate with any person or device;
314304 3. "Electronic communication device" means an electronic device
315305 that permits the user to manually transmit a communication of
316306 written text by means other than through an oral transfer or wire
317307 communication. This term does not include:
318308 a. a device that is physically or electronically
319309 integrated into a motor vehicle,
320310 b. a voice-operated global positioning or navigation
321311 system that is affixed to a motor vehicle,
312+c. a hands-free or voice-operated device that allows the
313+user to write, send or read a text message without the

349-c. a hands-free or voice-operated device that allows the
350-user to write, send or read a text message without the
351340 use of either hand except to activate, deactivate or
352341 initiate a feature or function, or
353342 d. an ignition interlock device that has been installed
354343 on a motor vehicle, or
355344 e. amateur radio use or operation; and
356345 4. "Text message" includes a text-based message, instant
357346 message, electronic message, photo, video or electronic mail.
358347 G. A law enforcement officer shall not, witho ut the consent of
359348 the person:
360349 1. Confiscate a cellular telephone or elect ronic communication
361350 device for the purpose of determining compliance with this section;
362351 2. Confiscate a cellular telephone or electronic communication
363352 device and retain it as eviden ce pending trial for a violation of
364353 this section; or
365354 3. Extract or otherwise download information from a cellular
366355 telephone or electronic communication device for a violation of t his
367356 section unless:
368357 a. the law enforcement officer has probable cause to
369358 believe that the cellular telephone or electronic
370359 communication device has be en used in the commission
371360 of a crime,
361+b. the information is extracted or otherwise downloaded
362+under a valid search warrant , or
363+c. otherwise authorized by law.
