265 | 256 | | b. a hospital, physician's office or health clinic;, |

301 | 291 | | provisions of this section. The provisions of such ordinances shall |

307 | 297 | | F. For the purpose of this section: |

308 | 298 | | 1. "Cellular telephone" means an analog or digital wireless |

309 | 299 | | telephone authorized by the Federal Communications Commission to |
---|
310 | 300 | | operate in the frequency bandwidth reserved for cellular telephones; |
---|
311 | 301 | | 2. "Compose", "send" or "read" with respect to a text message |
---|
312 | 302 | | means the manual entry, sending or retrieval of a text message to |
---|
313 | 303 | | communicate with any person or device; |
---|
314 | 304 | | 3. "Electronic communication device" means an electronic device |
---|
315 | 305 | | that permits the user to manually transmit a communication of |
---|
316 | 306 | | written text by means other than through an oral transfer or wire |
---|
317 | 307 | | communication. This term does not include: |
---|
318 | 308 | | a. a device that is physically or electronically |
---|
319 | 309 | | integrated into a motor vehicle, |
---|
320 | 310 | | b. a voice-operated global positioning or navigation |
---|
321 | 311 | | system that is affixed to a motor vehicle, |
---|
351 | 340 | | use of either hand except to activate, deactivate or |
---|
352 | 341 | | initiate a feature or function, or |
---|
353 | 342 | | d. an ignition interlock device that has been installed |
---|
354 | 343 | | on a motor vehicle, or |
---|
355 | 344 | | e. amateur radio use or operation; and |
---|
356 | 345 | | 4. "Text message" includes a text-based message, instant |
---|
357 | 346 | | message, electronic message, photo, video or electronic mail. |
---|
358 | 347 | | G. A law enforcement officer shall not, witho ut the consent of |
---|
359 | 348 | | the person: |
---|
360 | 349 | | 1. Confiscate a cellular telephone or elect ronic communication |
---|
361 | 350 | | device for the purpose of determining compliance with this section; |
---|
362 | 351 | | 2. Confiscate a cellular telephone or electronic communication |
---|
363 | 352 | | device and retain it as eviden ce pending trial for a violation of |
---|
364 | 353 | | this section; or |
---|
365 | 354 | | 3. Extract or otherwise download information from a cellular |
---|
366 | 355 | | telephone or electronic communication device for a violation of t his |
---|
367 | 356 | | section unless: |
---|
368 | 357 | | a. the law enforcement officer has probable cause to |
---|
369 | 358 | | believe that the cellular telephone or electronic |
---|
370 | 359 | | communication device has be en used in the commission |
---|
371 | 360 | | of a crime, |
