6262 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6363 SECTION 1. NEW LAW A new section of law to be codified
6464 in the Oklahoma Statutes as Section 11-103.9c of Title 70, unless
6565 there is created a duplication in numbering, reads as follows:
6666 A. Beginning in the 202 4-2025 school year, each school district
6767 shall conduct an annual fitness assessment, as approved by the State
6868 Board of Education, each school year for students in grades three

9595 through twelve, to be conducted in a course that satisfies the
9696 physical education program required pursu ant to Section 11-103.9 of
9797 Title 70 of the Oklahoma Statutes or during the s chool year where
9898 the assessment can be administered by trained personnel, including,
9999 but not limited to, school nurses, physical education and health
100100 teachers, coaches and any othe r certified school employees. The
101101 assessments shall include methods deeme d by the Board as appropriate
102102 to ascertain levels of student physical fitness and factors and
103103 standards required in subsection B of this section. A school
104104 district shall not be required to conduct the annual fitness
105105 assessment for students with a disability or other condition that
106106 requires an exemption as determined by the State Department of
107107 Education.
108108 B. The State Department of Education shall adopt an assessme nt
109109 instrument to be used by all school districts in assessing student
110110 physical fitness that includes standards accessible to distric ts
111111 which adequately express the most current and widely accepted best
112112 practices and benchmarks in the areas of student health and physical
113113 education. The minimum required conten ts of the assessment shall
114114 address the measurements and assessment instrument to be used by a
115115 school district in assessing student physical fitness under this
116116 section. The assessment instrument shall:

143143 1. Be based on factors related to student health, inclu ding the
144144 following factors that have been identified as essential to overall
145145 health and function:
146146 a. aerobic capacity,
147147 b. body composition, and
148148 c. muscular strength, endurance and flexibility; and
149149 2. Include criterion-referenced standards specific to a
150150 student's age and gender and based on the physical fitness level
151151 required for good health.
152152 C. A school district shall annually report the results of each
153153 student's performance on the physi cal fitness assessment require d by
154154 this section to the Board and the State Department of Health. The
155155 results shall not contain the name of the student, the student 's
156156 Social Security number or the student's date of birth. The
157157 performance results provided to the Board pursuant to this
158158 subsection may be used for assessing the effectiveness of health
159159 programs and developing recommendations for modifications to
160160 physical education and health and wellnes s programs or related
161161 curriculum.
162162 D. Not later than the last day of the school year, a s chool
163163 district shall provide a parent or guardian with a copy of the
164164 results of the physical fitness assessment of the parent 's or
165165 guardian's child. The results provided to a parent or guardian

192192 under this subsection shall be clear, precise, and easy to
193193 understand.
194194 E. 1. The State Department of Education and the State
195195 Department of Health shall analyze the performance results provided
196196 pursuant to subsection C of this sect ion and identify, for e ach
197197 school district, any correlation between the results and t he
198198 following:
199199 a. student obesity,
200200 b. student attendance levels,
201201 c. student academic achievement levels,
202202 d. student disciplinary problems, and
203203 e. school meal programs.
204204 2. The State Department of Education may contract with a public
205205 or private entity for that entity to conduct all or part of the
206206 analysis required in paragraph 1 of this subsection. The State
207207 Department of Education's efforts may be supported with state,
208208 federal or private fu nding, or a combination thereof.
209209 F. The State Board of Educati on shall submit an annual report
210210 to the Governor, beginning October 1, 202 4, and annually thereafter.
211211 The report shall include the compliance status of each school
212212 district. The Governor may, in coordination with the Board,
213213 establish one or more recogniti on programs to acknowledge school
214214 districts and schools which ha ve most improved in their physical
215215 fitness assessments. The Governor may collaborate with private

242242 corporations in the development and implementation of recognition
243243 programs pursuant to this s ubsection, including providing monetary
244244 or other incentives to school districts or schools for attaining
245245 certain levels of health status. All school districts or schools
246246 receiving acknowledgment through a recognition program established
247247 by the Governor pursuant to this subsection shall also be recognized
248248 on the Board's website.
249249 SECTION 2. This act shall become effective November 1, 2023.
