5756 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5857 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1 -171.1, is
5958 amended to read as follows:
6059 Section 1-171.1 A. A "street-legal utility vehicle" is any
6160 motor vehicle having:
6261 1. A bench seat or side -by-side seat for the use of each rider;
6362 2. Four wheels in contac t with the ground, but excluding a
6463 tractor;

9290 3. A combustion engine with a pisto n or rotor displacement of
9391 four hundred cubic centimeters (400 cc) or greater and capable of
9492 maintaining speeds of forty -five (45) miles per hour or greater;
9593 4. For each occupant, safety belts or safety shoulder harnesses
9694 which shall be of a type and shal l be installed pursuant to 49
9795 C.F.R., Section 571.208 et seq.; and
9896 5. All equipment required by the provisions of Sections 12 -201
9997 through 12-232 of Title 47 of the Oklahoma St atutes, with respect to
10098 equipment on vehicles ; and
10199 6. A windshield; however, street-legal utility vehicles shall
102100 be exempt from the glass windshield requirements of Section 12 -406
103101 of this Title.
104102 B. A street-legal utility vehicl e operated on the streets a nd
105103 highways of this state shall be registered as a motor vehicle.
106104 C. The operator of a street-legal utility vehicle shall not be
107105 required to have an "M" endorsement on the Class D license pursuant
108106 to Section 6-110.1 of Title 47 of the Oklahoma Statutes . The
109107 operator shall be at least sixteen (16) years of age and hold a
110108 valid Oklahoma driver license.
111109 SECTION 2. AMENDATORY 47 O.S. 2021, Section 11 -1116, is
112110 amended to read as follows:
113111 A. The self-propelled or motor-driven and operated vehicles
114112 described in this section shall be prohibited from operating or

142139 shall be limited in operation on the streets and highways of this
143140 state.
144141 B. Self-propelled or motor-driven cycles, known and commonly
145142 referred to as "minibikes" and other similar trade names, shall be
146143 prohibited from operating on the streets and highways of this s tate,
147144 except:
148145 1. When used in a parade; or
149146 2. When registered, as required by subsection E of Section 1151
150147 of this title, and operated in this state by food vendor serv ices
151148 upon streets having a speed limit of thirty (30) miles per hour or
152149 less.
153150 All minibikes offered for sale in this state shall bear the
154151 following notice to the customer: "This machine is not manufactured
155152 or sold for operation on the public streets or hig hways. Since it
156153 is not provided with equipment required by law for street or highway
157154 use, all persons are cautioned that any operation of thi s vehicle
158155 upon a public street or highway will be in violation of the motor
159156 vehicle laws of this state and will su bject the violator to arrest."
160157 C. Golf carts and utility vehicles, as defined by Sect ion 1102
161158 of this title, shall not be operated on the st reets and highways of
162159 this state except:
163160 1. Golf carts or utility vehicles owned by the Oklahoma Tourism
164161 and Recreation Department, and operated by employees or agents of
165162 the Department or employees o f independent management companies

193189 working on behalf of the Department, may be operated on the streets
194190 and highways of this state during daylight hours or under rules
195191 developed by the Oklahoma Tourism and Recreation Commission, when
196192 the streets and highway s are located within the boundaries of a
197193 state park. The Department shall have warning signs placed at the
198194 entrance and other locations at those state parks allowing gol f
199195 carts or utility vehicles to be operated on the streets and highways
200196 of this state located within the boundaries of those state parks.
201197 The warning signs shall state that golf carts and utility vehicles
202198 may be operating on streets and highways and that m otor vehicle
203199 operators shall take special precautions to be alert for the
204200 presence of golf carts or utility vehicles on the streets and
205201 highways;
206202 2. The municipal governing body has adopted an ordinance
207203 governing the operation of golf carts and/or utility vehicles on
208204 city streets; provided, such ordinances shall include necessary
209205 vehicle lighting and safety requirements;
210206 3. Golf carts or utility vehicles may operate on state highways
211207 only if making a perpendicular crossing of a state highway located
212208 within the boundaries of a municipality which has adopted an
213209 ordinance governing the operat ion of golf carts and/or utility
214210 vehicles;

242237 4. The board of county commissioners of a county has approved
243238 the operation of golf cart and/or utility vehicle traffic on
244239 roadways within the county, and:
245240 a. the roadway has a posted speed limit of twenty -five
246241 (25) miles per hour or less,
247242 b. the roadway is located in an unincorporated area, and
248243 c. appropriate signage, cautioning motorists of the
249244 possibility of golf cart or utili ty vehicle traffic,
250245 is erected by the board of county commissioners ; or
251246 5. Street-legal utility vehicles that are registered as a motor
252247 vehicle pursuant to subsection B of Section 1 1-171.1 of this act
253248 title may be operated on the streets and highways of this state.
254249 Provided, however, when traveling on U.S. highways, street-legal
255250 utility vehicles are restricted to those highways with a posted
256251 speed limit of forty-five (45) miles per hour or less. Street-legal
257252 utility vehicles shall not be operated on the National System of
258253 Interstate and Defense Highways or U.S. highways.
259254 D. All-terrain vehicles shall not be operated on the streets
260255 and highways of this state, except:
261256 1. On unpaved roads which are located within the boundaries of
262257 any property of the Fore st Service of the United States Department
263258 of Agriculture;
264259 2. On highways if:

292286 a. the vehicle needs to make a direct crossing of the
293287 highway while the ve hicle is traveling upon a
294288 regularly traveled trail and needs to continue travel
295289 from one area of the tr ail to another and, if the
296290 vehicle comes to a comple te stop, yields the right -of-
297291 way to all oncoming traffic that constitutes an
298292 immediate hazard, and cr osses the highway at an angle
299293 of approximately ninety (90) degrees to the direction
300294 of the street or highway. This exception shall not
301295 apply to divided highways or highways with a posted
302296 speed limit of more than thirty-five (35) miles per
303297 hour in the area of the crossing,
304298 b. the vehicle needs to travel on a highway in order to
305299 cross a railroad track . In that event, the all-
306300 terrain vehicle may travel for n ot more than three
307301 hundred (300) feet on a highway to cross a railroad
308302 track,
309303 c. the operator of the a ll-terrain vehicle making the
310304 crossing at a highway has a valid driver license, and
311305 d. the operator of the vehicle makes a crossing on a
312306 highway during daylight hours only;
313307 3. On streets and highways within a municipality if the
314308 municipal governing body h as adopted an ordinance governing the

342335 operation of golf carts, utility vehicles or all -terrain vehicles on
343336 streets and highways within the municipality ; or
344337 4. On roadways within unincorpor ated areas of a county if those
345338 roadways are not part of the state highway system or the National
346339 System of Interstate and Defense Highways; provided, however, that
347340 the driver is a licensed driver.
348341 E. Mopeds, as defined by Section 1-133.2 of this title, m ay be
349342 operated on the streets and highways of this state if:
350343 1. The municipal governing body has adopted an ordinance
351344 governing the operation of mopeds on city streets; provided, such
352345 ordinances shall include neces sary vehicle lighting and safety
353346 requirements; or
354347 2. The board of county commissioners of a county has appr oved
355348 the operation of mopeds on roadways w ithin the county, not including
356349 roadways within a municipalit y.
357350 SECTION 3. This act shall become effective November 1, 2023.
