44	41		2021, Section 1-171.1, which relates to street -legal
45	42		utility vehicle; modifying def inition; amending 47
46	43		O.S. 2021, Section 11-1116, which relates to self-
47	44		propelled or motor-driven cycles; updating statutory
48	45		reference; allowing street-legal utility vehicles to
49	46		operate on certain stretches of U.S. highways;
50	47		deleting divided highway crossin g prohibition for
51	48		all-terrain vehicles; and providing an effective
52	49		date.

57	56		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58	57		SECTION 1. AMENDATORY 47 O.S. 2021, Section 1 -171.1, is
59	58		amended to read as follows:
60	59		Section 1-171.1 A. A "street-legal utility vehicle" is any
61	60		motor vehicle having:
62	61		1. A bench seat or side -by-side seat for the use of each rider;
63	62		2. Four wheels in contac t with the ground, but excluding a
64	63		tractor;

92	90		3. A combustion engine with a pisto n or rotor displacement of
93	91		four hundred cubic centimeters (400 cc) or greater and capable of
94	92		maintaining speeds of forty -five (45) miles per hour or greater;
95	93		4. For each occupant, safety belts or safety shoulder harnesses
96	94		which shall be of a type and shal l be installed pursuant to 49
97	95		C.F.R., Section 571.208 et seq.; and
98	96		5. All equipment required by the provisions of Sections 12 -201
99	97		through 12-232 of Title 47 of the Oklahoma St atutes, with respect to
100	98		equipment on vehicles ; and
101	99		6. A windshield; however, street-legal utility vehicles shall
102	100		be exempt from the glass windshield requirements of Section 12 -406
103	101		of this Title.
104	102		B. A street-legal utility vehicl e operated on the streets a nd
105	103		highways of this state shall be registered as a motor vehicle.
106	104		C. The operator of a street-legal utility vehicle shall not be
107	105		required to have an "M" endorsement on the Class D license pursuant
108	106		to Section 6-110.1 of Title 47 of the Oklahoma Statutes . The
109	107		operator shall be at least sixteen (16) years of age and hold a
110	108		valid Oklahoma driver license.
111	109		SECTION 2. AMENDATORY 47 O.S. 2021, Section 11 -1116, is
112	110		amended to read as follows:
113	111		A. The self-propelled or motor-driven and operated vehicles
114	112		described in this section shall be prohibited from operating or

142	139		shall be limited in operation on the streets and highways of this
143	140		state.
144	141		B. Self-propelled or motor-driven cycles, known and commonly
145	142		referred to as "minibikes" and other similar trade names, shall be
146	143		prohibited from operating on the streets and highways of this s tate,
147	144		except:
148	145		1. When used in a parade; or
149	146		2. When registered, as required by subsection E of Section 1151
150	147		of this title, and operated in this state by food vendor serv ices
151	148		upon streets having a speed limit of thirty (30) miles per hour or
152	149		less.
153	150		All minibikes offered for sale in this state shall bear the
154	151		following notice to the customer: "This machine is not manufactured
155	152		or sold for operation on the public streets or hig hways. Since it
156	153		is not provided with equipment required by law for street or highway
157	154		use, all persons are cautioned that any operation of thi s vehicle
158	155		upon a public street or highway will be in violation of the motor
159	156		vehicle laws of this state and will su bject the violator to arrest."
160	157		C. Golf carts and utility vehicles, as defined by Sect ion 1102
161	158		of this title, shall not be operated on the st reets and highways of
162	159		this state except:
163	160		1. Golf carts or utility vehicles owned by the Oklahoma Tourism
164	161		and Recreation Department, and operated by employees or agents of
165	162		the Department or employees o f independent management companies

193	189		working on behalf of the Department, may be operated on the streets
194	190		and highways of this state during daylight hours or under rules
195	191		developed by the Oklahoma Tourism and Recreation Commission, when
196	192		the streets and highway s are located within the boundaries of a
197	193		state park. The Department shall have warning signs placed at the
198	194		entrance and other locations at those state parks allowing gol f
199	195		carts or utility vehicles to be operated on the streets and highways
200	196		of this state located within the boundaries of those state parks.
201	197		The warning signs shall state that golf carts and utility vehicles
202	198		may be operating on streets and highways and that m otor vehicle
203	199		operators shall take special precautions to be alert for the
204	200		presence of golf carts or utility vehicles on the streets and
205	201		highways;
206	202		2. The municipal governing body has adopted an ordinance
207	203		governing the operation of golf carts and/or utility vehicles on
208	204		city streets; provided, such ordinances shall include necessary
209	205		vehicle lighting and safety requirements;
210	206		3. Golf carts or utility vehicles may operate on state highways
211	207		only if making a perpendicular crossing of a state highway located
212	208		within the boundaries of a municipality which has adopted an
213	209		ordinance governing the operat ion of golf carts and/or utility
214	210		vehicles;

242	237		4. The board of county commissioners of a county has approved
243	238		the operation of golf cart and/or utility vehicle traffic on
244	239		roadways within the county, and:
245	240		a. the roadway has a posted speed limit of twenty -five
246	241		(25) miles per hour or less,
247	242		b. the roadway is located in an unincorporated area, and
248	243		c. appropriate signage, cautioning motorists of the
249	244		possibility of golf cart or utili ty vehicle traffic,
250	245		is erected by the board of county commissioners ; or
251	246		5. Street-legal utility vehicles that are registered as a motor
252	247		vehicle pursuant to subsection B of Section 1 1-171.1 of this act
253	248		title may be operated on the streets and highways of this state.
254	249		Provided, however, when traveling on U.S. highways, street-legal
255	250		utility vehicles are restricted to those highways with a posted
256	251		speed limit of forty-five (45) miles per hour or less. Street-legal
257	252		utility vehicles shall not be operated on the National System of
258	253		Interstate and Defense Highways or U.S. highways.
259	254		D. All-terrain vehicles shall not be operated on the streets
260	255		and highways of this state, except:
261	256		1. On unpaved roads which are located within the boundaries of
262	257		any property of the Fore st Service of the United States Department
263	258		of Agriculture;
264	259		2. On highways if:

292	286		a. the vehicle needs to make a direct crossing of the
293	287		highway while the ve hicle is traveling upon a
294	288		regularly traveled trail and needs to continue travel
295	289		from one area of the tr ail to another and, if the
296	290		vehicle comes to a comple te stop, yields the right -of-
297	291		way to all oncoming traffic that constitutes an
298	292		immediate hazard, and cr osses the highway at an angle
299	293		of approximately ninety (90) degrees to the direction
300	294		of the street or highway. This exception shall not
301	295		apply to divided highways or highways with a posted
302	296		speed limit of more than thirty-five (35) miles per
303	297		hour in the area of the crossing,
304	298		b. the vehicle needs to travel on a highway in order to
305	299		cross a railroad track . In that event, the all-
306	300		terrain vehicle may travel for n ot more than three
307	301		hundred (300) feet on a highway to cross a railroad
308	302		track,
309	303		c. the operator of the a ll-terrain vehicle making the
310	304		crossing at a highway has a valid driver license, and
311	305		d. the operator of the vehicle makes a crossing on a
312	306		highway during daylight hours only;
313	307		3. On streets and highways within a municipality if the
314	308		municipal governing body h as adopted an ordinance governing the

342	335		operation of golf carts, utility vehicles or all -terrain vehicles on
343	336		streets and highways within the municipality ; or
344	337		4. On roadways within unincorpor ated areas of a county if those
345	338		roadways are not part of the state highway system or the National
346	339		System of Interstate and Defense Highways; provided, however, that
347	340		the driver is a licensed driver.
348	341		E. Mopeds, as defined by Section 1-133.2 of this title, m ay be
349	342		operated on the streets and highways of this state if:
350	343		1. The municipal governing body has adopted an ordinance
351	344		governing the operation of mopeds on city streets; provided, such
352	345		ordinances shall include neces sary vehicle lighting and safety
353	346		requirements; or
354	347		2. The board of county commissioners of a county has appr oved
355	348		the operation of mopeds on roadways w ithin the county, not including
356	349		roadways within a municipalit y.
357	350		SECTION 3. This act shall become effective November 1, 2023.
