AS INTRODUCED 
 
An Act relating to elections; establishing pro cedures 
for voters with a disability to request ballot; 
providing for ballot and balloting materials to be 
sent via electronic transmission ; providing for 
transmission and return of ballot by certain time; 
providing for codification; and providing an 
effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 14 -201 of Title 26, unless there 
is created a duplication in numbering, reads as follows: 
A.  The Secretary of the State Election Board shall establish 
procedures with the same security measures as used in the submission 
of ballots from military and overseas voters to enable a voter with 
a disability to independently and privately mark a mail ballot or 
use an electronic voting device that produces a paper re cord using 
nonvisual access, low vision access or other assistive technology i n 
order for the voter to vote in a mail ballot election pursuant to 
Section 14-108 of Title 26 of the Oklahoma Statutes.  The procedures  Req. No. 6752 	Page 2 
shall include an accessible method, to be determined by the 
Secretary, by which a voter with a disability may request s uch a 
ballot. 
B.  Upon receipt of the ballot application by a voter with a 
disability, the secretary of the county election board shall 
transmit the ballot and balloting material s to the voter by 
electronic transmission . 
C.  If a ballot application from a voter with a disability 
arrives after the jurisdiction begins transmitting ballots and 
balloting materials to voters, the secretary of the county electio n 
board shall transmit the ballot and balloting materials to the voter 
within seventy-two (72) hours after the receipt of the ap plication. 
D.  A voter with a disability who receive s a ballot pursuant to 
this section shall: 
1.  Return the ballot via electro nic transmission to the c ounty 
election board; or 
2.  Print the ballot and return it to the county elec tion board 
via United States Postal Service or hand -delivery.  
Such ballot shall be received by the county election board before 
the close of polls on th e day of the election. 
SECTION 2.  This act shall become effective November 1, 202 3.
