26 | 26 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

27 | 27 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
28 | 28 | | in the Oklahoma Statutes as Section 14 -201 of Title 26, unless there |
---|
29 | 29 | | is created a duplication in numbering, reads as follows: |

30 | 30 | | A. The Secretary of the State Election Board shall establish |
---|
31 | 31 | | procedures with the same security measures as used in the submission |
---|
32 | 32 | | of ballots from military and overseas voters to enable a voter with |
---|
33 | 33 | | a disability to independently and privately mark a mail ballot or |
---|
34 | 34 | | use an electronic voting device that produces a paper re cord using |
---|
35 | 35 | | nonvisual access, low vision access or other assistive technology i n |
---|
36 | 36 | | order for the voter to vote in a mail ballot election pursuant to |
---|
37 | 37 | | Section 14-108 of Title 26 of the Oklahoma Statutes. The procedures Req. No. 6752 Page 2 |

38 | 38 | | shall include an accessible method, to be determined by the |
---|
39 | 39 | | Secretary, by which a voter with a disability may request s uch a |
---|
40 | 40 | | ballot. |
---|
41 | 41 | | B. Upon receipt of the ballot application by a voter with a |
---|
42 | 42 | | disability, the secretary of the county election board shall |
---|
43 | 43 | | transmit the ballot and balloting material s to the voter by |
---|
44 | 44 | | electronic transmission . |
---|
45 | 45 | | C. If a ballot application from a voter with a disability |
---|
46 | 46 | | arrives after the jurisdiction begins transmitting ballots and |
---|
47 | 47 | | balloting materials to voters, the secretary of the county electio n |
---|
48 | 48 | | board shall transmit the ballot and balloting materials to the voter |
---|
49 | 49 | | within seventy-two (72) hours after the receipt of the ap plication. |
---|
50 | 50 | | D. A voter with a disability who receive s a ballot pursuant to |
---|
51 | 51 | | this section shall: |
---|
52 | 52 | | 1. Return the ballot via electro nic transmission to the c ounty |
---|
53 | 53 | | election board; or |
---|
54 | 54 | | 2. Print the ballot and return it to the county elec tion board |
---|
55 | 55 | | via United States Postal Service or hand -delivery. |
---|
56 | 56 | | Such ballot shall be received by the county election board before |
---|
57 | 57 | | the close of polls on th e day of the election. |
---|
58 | 58 | | SECTION 2. This act shall become effective November 1, 202 3. |
