2626 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
2727 SECTION 1. NEW LAW A new section of law to be codified
2828 in the Oklahoma Statutes as Section 14 -201 of Title 26, unless there
2929 is created a duplication in numbering, reads as follows:
3030 A. The Secretary of the State Election Board shall establish
3131 procedures with the same security measures as used in the submission
3232 of ballots from military and overseas voters to enable a voter with
3333 a disability to independently and privately mark a mail ballot or
3434 use an electronic voting device that produces a paper re cord using
3535 nonvisual access, low vision access or other assistive technology i n
3636 order for the voter to vote in a mail ballot election pursuant to
3737 Section 14-108 of Title 26 of the Oklahoma Statutes. The procedures Req. No. 6752 Page 2
3838 shall include an accessible method, to be determined by the
3939 Secretary, by which a voter with a disability may request s uch a
4040 ballot.
4141 B. Upon receipt of the ballot application by a voter with a
4242 disability, the secretary of the county election board shall
4343 transmit the ballot and balloting material s to the voter by
4444 electronic transmission .
4545 C. If a ballot application from a voter with a disability
4646 arrives after the jurisdiction begins transmitting ballots and
4747 balloting materials to voters, the secretary of the county electio n
4848 board shall transmit the ballot and balloting materials to the voter
4949 within seventy-two (72) hours after the receipt of the ap plication.
5050 D. A voter with a disability who receive s a ballot pursuant to
5151 this section shall:
5252 1. Return the ballot via electro nic transmission to the c ounty
5353 election board; or
5454 2. Print the ballot and return it to the county elec tion board
5555 via United States Postal Service or hand -delivery.
5656 Such ballot shall be received by the county election board before
5757 the close of polls on th e day of the election.
5858 SECTION 2. This act shall become effective November 1, 202 3.
