30 | 56 | SECTION 1. AMENDATORY 12 O.S. 2021, Section 2503.1, is | |

33 | 58 | Section 2503.1 A. As used in this section: | |

35 | 59 | 1. An "interpreter" is a qualified legal interpreter for the | |
36 | 60 | deaf or hard-of-hearing, as defined by Section 2 408 of Title 63 of | |
37 | 61 | the Oklahoma Statutes , or a spoken language inte rpreter for a | |
38 | 62 | Limited English Proficient (LEP) person; | |

40 | 63 | 2. A "deaf or hard-of-hearing person" is a person whose sense | |
41 | 64 | of hearing is nonfunctional for the ordinary purposes of life; and | |

51 | 98 | prevent an interpreter from disclosing such person 's confidential | |
52 | 99 | communication made while such interpreter is acting in the capacity | |
53 | 100 | as an interpreter for persons who are deaf or hard-of-hearing or | |
54 | 101 | LEP. | |

56 | 102 | C. The privilege may be claimed by the interpreter, by the LEP | |
57 | 103 | or deaf or hard-of-hearing person, by the guardian o r conservator of | |
58 | 104 | the LEP or deaf or hard-of-hearing person, or by the personal | |
59 | 105 | representative of the LEP or deaf or hard-of-hearing person if the | |
60 | 106 | LEP or deaf or hard-of-hearing person is deceased. | |

62 | 107 | D. An interpreter who is employed to interpret, transliter ate | |
63 | 108 | or relay a conversation between a person who can hear and speak | |
64 | 109 | English and a LEP or deaf or hard-of-hearing person is a conduit for | |
65 | 110 | the conversation and may not disclose or be compelled to disclose, | |
66 | 111 | through reporting or testimony , or by judicial process or subpoena, | |
67 | 112 | the contents of a confidential communication. | |

69 | 113 | E. There is no privilege pursuant to thi s section for | |
